Malta: Gay Rights Group Objects to President's Comments About Marriage

The Malta Gay Rights Movement has complained about statements made by, among others, President George Abela, during the national conference on the family “yesterday, today, tomorrow” held over the past weekend.

“The first address of the day was delivered by President George Abela. One of his first misguided statements was a definition of family that was so narrow as to exclude a significant minority. Dr Abela defined the family as a man and a woman, in a life-long committment, linked to procreation. He also emphasised the need for both the need of a mother and a father for the family to exist,” the movemnet said.

“Whether intentionally or not, he therefore excluded all those married couples who could not have children including childless couples, adoptive parents and foster parents; single parents; cohabiting couples and any children they might have; and of course gay and lesbian parents,” the moverment said.

CA: Proposed Law Would Take Away One of Prop 8's Main Arguments

San Francisco state Sen. Mark Leno supports gay marriage – but he doesn’t think clergy should have to perform the ceremonies. Leno, who is gay, is introducing legislation that says no religious leader would be forced to perform a marriage that goes against their own beliefs or that of their faith. The bill would also re-emphasize the tax-exempt status of churches, and states that they would not lose this status by refusing to perform same-sex marriages.

Leno, a Democrat, contends the bill would not actually change the law because the First Amendment already offers these protections.

Instead, Leno said, it is a clarification aimed right at the ongoing debate over Proposition 8, the 2008 initiative that ended California’s brief experiment with same sex marriage. The measure won by six points after a campaign in which proponents sought to mislead voters, Leno contends.

OK: Law on the Books Criminalizes Performance of Gay Marriages

Here is the OK marriage law section §43-14. Penalty for performing unlawful marriage.
Any minister of the Gospel, or other person authorized to solemnize the rites of matrimony within this state, who shall knowingly solemnize the rites of matrimony between persons prohibited by this chapter, from intermarrying shall be deemed guilty of a felony, and upon conviction thereof shall be fined in any sum not exceeding Five Hundred Dollars ($500.00) and imprisonment in the State Penitentiary not less than one (1) year nor more than five (5) years.

R.L. 1910, § 3896. Amended by Laws 1997, c. 133, § 461, eff. July 1, 1999; Laws 1999, 1st Ex.Sess., c. 5, § 335, eff. July 1, 1999.

All the proposed bill does is strike “State Penitentiary” and insert “custody of the Department of Corrections”. According to this blog post, this is just a shell bill that Nelson filed, to have on hand ‘just in case’. Certainly worth keeping an eye on him, but there seems to be nothing really threatening happening with this particular bill as it stands.

CA: Prop 8 Trial Update Day 11

Today was one of the most dramatic days of the trial, with startling admissions by the proponents’ two expert witnesses: Professor Kenneth Miller, testifying about the political power of gay people, and David Blankenhorn, testifying about the purposes of marriage.

The morning began with the conclusion of David Boies’s cross-examination of Professor Miller. Boies confronted Prof. Miller with several of Prof. Miller’s own earlier writings, which were highly critical of the ballot initiative process and particularly highlighted the risk that majorities will use the initiative process to target minority groups. Prof. Miller admitted that ballot measures can, and have, drawn upon anti-minority sentiment. Indeed, one of Prof. Miller’s own articles cited Proposition 22, the California initiative prohibiting marriage for same-sex couples that passed in 2000, as an example of such an anti-minority initiative.

Following the conclusion of Prof. Miller’s testimony, the afternoon was taken up by questioning of the proponents’ final witness, David Blankenhorn, the president of a private think tank called the Institute for American Values. Blankenhorn is best known as the author of a book called Fatherless America, in which he argued that fatherlessness is “the most harmful demographic trend of this generation” and the leading cause of “our most urgent social problems, from crime to adolescent pregnancy to child sexual abuse to domestic violence against women.” Blankenhorn is also one of the most visible and culturally influential opponents of marriage for same-sex couples.

Glee Star Jane Lynch to Marry Partner in May

At the 2010 Golden Globes on Sunday, Jan. 17, “Glee” star Jane Lynch told the New York Times Carpetbagger blog that she plans to marry her girlfriend Dr. Lara Embry in May.

The couple met at a National Center for Lesbian Rights event in May 2009. Embry was receiving the organization’s Justice Award, while Lynch was there to introduce “The L Word” creator Ilene Chaiken, who received the NCLR’s Voice and Visibility Award.

Lynch has been vaulted into the TV spotlight this season as Sue Sylvester on “Glee,” garnering award nominations for her performance and wins for Best Ensemble.

Portugal: 52% Support 43% Oppose Gay Marriage

Fifty-two percent of Portuguese support legalization of same-sex marriage, according to a new Eurosondagem poll for Rádio Renascença, SIC TV, and the Expresso newspaper.

Parliament voted 125-92 to legalize same-sex marriage on Jan. 8. Barring unexpected complications, the first gay weddings will take place in April or shortly thereafter.

The bill that legalized same-sex marriage specifically excluded access to adoption for married same-sex couples.

India: Gay Prince to Marry Partner in Nepal

Manvendra Singh Gohil, the openly-gay Indian prince, is set to marry his partner in a ceremony in Nepal, raising hopes that the war-ravaged country will begin to rake in business from gay tourists.

Prince Gohil, who rose to international attention after appearing on Oprah and the BBC publicizing his search for a lover, plans to marry his Nepalese partner Pajwal Miskin in a Hindu ceremony in Kathmandu.

Nepal’s tourism industry ground to a halt after a brutal decade-long civil war that ended in 2006. In 2008, Nepal’s Supreme Court ordered the government to enact laws to guarantee the rights of gays and lesbians after bowing to pressure from the Blue Diamond Society, run by parliament member and gay-oriented travel mogul Sunil Babu Pant. The country’s new constitution is currently being drafted and is expected to define marriage as a union between two adult individuals, regardless of gender, and to outlaw discrimination based on sexual orientation.

Guam: Civil Union Bill Debate Delayed As Catholic Church Prepares Attack

The Catholic Church in Guam has submitted a petition opposing plans to legalise same-sex civil unions in the US territory. The controversial Bill 185 on civil unions was due to be discussed this week, but has been delayed again until next month, giving the church more time to garner support for their argument that legalising gay unions will promote homosexuality.

PODGER: Bill 185 aims to give people in committed same-sex relationships the right to enter into civil unions, thereby enjoying the same responsibilities, rights benefits and protections as marriage. Guam Senator Benjamin Cruz, who tabled the proposed legislation late last year, says it’s unfair to deny homosexual citizens in long-term relationships the same rights as their heterosexual counterparts.

CRUZ: It is a civil rights issue. You’re denying individuals the right to unions that they should be able to get into. But more importantly you’re denying them the equal protection of the law. A professor at the university who, like 100 other professors at the university, paid his bi-weekly dues for retirement; when he retires his significant other will not be able to receive the retirement survivor benefits after he dies. But one of his other fellow professors could marry some 18-year-old girl that he meets online from some foreign country and, after one year, die and she would for the rest of her life be able to receive the benefits.

Obama to Address Don't Ask, Don't Tell in State of the Union?

Carl Levin dropped a hint earlier today about something being up on the DADT front and how the issue might pop up in the state of the union. Are we in store for a surprise announcement tomorrow? The White House would probably want to get out in front of it a day early so that news coverage the day after the speech is dominated by jobs talk instead of a minor hot-button issue:

Levin told reporters today that he has delayed plans to hold Senate hearings to examine the current “Don’t Ask Don’t Tell” policy at the request of administration officials. Why would they want him to hold off? The officials Levin talked to said they expect the President will address the issue of homosexuals serving in the military during the State of the Union Address.

“I don’t know if it was the White House, but somebody representing them from the Pentagon said that the President was expected, they thought, to state that policy in the State of the Union and they thought it made more sense for him to state the policy and for us to have a hearing right before the policy with the people who will be defending that policy. They don’t know what it is,” said Levin, who added that he hopes any new policy is well-thought-out and that senior military leaders are on board.

China: Newly Married Gay Couple Want Official License

China’s first gay couple, who openly “got married” on Jan 3, want more understanding from society and hope to get an official marriage certificate, the Beijing News reported today. The couple, Zeng Anquan and Pan Wenjie, “fell in love at first sight” when they met at a bar in Chengdu, the capital city of Sichuan province.

Zeng is 46 years old and has a daughter from a 26-year marriage. Pan, 27, confessed to his parents that he is more into men after the failure of many blind-dates arranged by his family.

“I don’t feel well when I am with a woman, but I could not speak about it in the past. When Pan planned a surprise wedding for me, I was shocked at first but on second thought, said, ‘Why not’” Zeng said.
