Malta: Being Gay in This Mediterranean Country

There are major cases of discrimination against gay and lesbian people everywhere, including in employment and the social rights sphere, said a Malta Gay Rights Movement representative last Wednesday during a debate entitled ‘Move Opens the Closet’.

The debate was organised by the progressive students organisation Move and led by Alistair Bugeja. Psychologist and university lecturer Mary Borg Cunen, Cyrus Engerer from the Malta Gay Rights Movement, Anthony Galea, a psychologist from LGBT Labour and Xarabank presenter Peppi Azzopardi were on the panel. A number of students (although much fewer than the number of those who confirmed attendance on facebook) participated.

Mr Engerer, who is also a Nationalist Party councillor, said the road ahead was very long but we must start with defining family and adoption regulations in state legislation. Cohabitation, adoption and marriage rights were MGRM’s priority, he noted. Pointing out that single people and heterosexual couples who lived together could adopt children but gay or lesbian couples could not, Mr Engerer said this was unfair. Moreover, several LGBT people were having children from heterosexual encounters just for the sake of having children. Even children’s rights were not being protected because of lack of legislation, he said.

India: Gay Couple Married in Manipur

In the first same-sex marriage in Manipur, a 25-year-old ‘groom’ married his companion of six years, a 28-year-old man, at a private function on Thursday. The two exchanged bouquets to solemnise the wedding in the presence of a modest gathering at a community hall in the heart of the city.

Sandip, the ‘groom’, and Nikhil, the ‘bride’ were in a relationship for the past six years and decided to wed.

The parents of the couple were opposed to the marriage. The wedding was attended by a number of well-wishers and friends.

Zimbabwe: President Confirms No Gay Rights in New Constitution

Zimbabwe’s president says gay rights will not be protected in a constitution being drawn up under a power-sharing deal. State radio on Friday quoted President Robert Mugabe saying that Western rights groups have called for constitutional reforms to include gay rights. He calls that “insanity.”

Same-sex acts are illegal in Zimbabwe. Mugabe once described homosexuals as “lower than pigs and dogs.”

Condemnation of gays is common in Africa. Ugandan lawmakers have proposed imposing the death penalty on some gays. A gay couple is on trial in Malawi, charged with unnatural acts and gross indecency.

PA: Another Lesbian Couple Denied Divorce

Carole Ann Kern and Robin Lynn Taney, a lesbian couple who wed in Massachusetts in 2009, filed for divorce recently in Pennsylvania. Berks County Common Pleas Court Judge Scott E. Lash denied the divorce based on the fact that Pennsylvania does not recognize the marriage in the first place.

The couple would have filed back in Massachusetts where the same-sex marriage was granted, but there is a one year residency requirement for filing for divorce there. The couple’s only recourse at this point is to have the court declare their marriage void.

The judge’s opinion in this case as reported by Law.com says that Pennsylvania’s law “represents a reasonable protection and a proper and lawful exercise of the police power of the Commonwealth, which is available to preserve the public health, safety, welfare, and morals of its citizens.”

Lithuania: Parliament Tries to Shut Down Pride Parade

Fifty members of Lithuania’s Parliament have petitioned the Prosecution Office to stop the Vilnius city government from permitting a gay pride parade in May.

The MPs say the parade would violate the new “Law on the Protection of Minors Against the Detrimental Effect of Public Information.”

The law, which took effect March 1, bans information that promotes sexual relationships, “denigrates family values” or encourages a non-heterosexual concept of marriage and family. Such information is prohibited wherever it could be accessed by a minor.

Ireland: Amendments to Civil Partnership Bill Could Be Too Close to Marriage, Justice Minister Says

A LEGAL requirement for an attempt at reconciliation before granting the dissolution of a civil partnership would bring civil partnership closer to marriage and could give rise to a constitutional challenge, according to Minister for Justice Dermot Ahern.

An amendment that recognised the contribution either partner made to the rearing of children in the relationship could also give rise to such a challenge, he said.

Mr Ahern was responding to proposed amendments from Fine Gael’s spokesman on justice Charlie Flanagan, who had proposed inserting into the Civil Partnership Bill a requirement that a solicitor acting for partners seeking a dissolution of their relationship should be required to draw their attention to the options of reconciliation or mediation.

Australia: Opposition Leader Backpeddles on Harsh Gay Remarks

OPPOSITION Leader Tony Abbott has extended an olive branch to the gay and lesbian community, back-pedalling on recent remarks in which he described the lifestyle as “threatening”. He also offered in-principle endorsement of recognition of same-sex relationships and stronger anti-discrimination laws.

Choosing a gay and lesbian community radio station in Melbourne to launch his mea culpa, Mr Abbott said his recent comments were ill considered and a “poor choice of words”.

“I think blokes of my generation and upbringing do sometimes find these things a bit confronting,” he said. “Anything that is different can be a bit challenging.” Mr Abbott reiterated his opposition to gay marriage but said he favoured formal recognition of same-sex relationships. He was “very happy to look at” civil unions.

Pentagon to Relax Enforcement of Don’t Ask Don’t Tell

The Pentagon announced Thursday that it will relax enforcement of the “don’t ask, don’t tell” rules that prevent gays from serving openly in the military, a decision that officials described as a temporary measure until Congress can take permanent action.

Defense Secretary Robert M. Gates said the military will no longer open investigations into the sexual orientation of service members based on anonymous complaints, will restrict testimony from third parties and will require high-ranking officers to review all cases. The changes will take effect immediately.

Gates had asked Pentagon lawyers to review whether the Defense Department had the legal discretion to enforce the “don’t ask, don’t tell” law more loosely after President Obama urged its repeal in his Jan. 27 State of the Union address.

CA: New Poll Shows 50% of Californians Now Support Gay Marriage

Less than two years after Californians approved a ban on gay marriage, a new poll found that more residents support same-sex union than oppose it.

According to the Public Policy Institute of California poll, 50% of respondents support gay marriage and 45% oppose it. The PPIC said it marks the highest level of support for gay marriage their polls have recorded in California.

Some gay rights activists had planned to ask voters to repeal the ban on gay marriage, Proposition 8, this year. But several key groups decided to push back that effort until at least 2012.
