TN: School Backs Off Censorship of Gay Student

The American Civil Liberties Union of Tennessee and Lambda Legal has announced that they have received assurances from officials at Greenbrier High School that the school will stop censoring a student from wearing shirts expressing pro-gay messages.

As part of a settlement, the school will also have to provide training on its anti-bullying policy to ensure that it is clear that harassment of any student, regardless of sexual orientation, is not acceptable, by either other students or faculty members.

“Students not only have a First Amendment right to be out at school, but the right to an education free from discrimination and harassment,” said Tricia Herzfeld, ACLU of Tennessee staff attorney. “We applaud the school for recognizing this and taking steps to ensure that they are providing a safe and equal learning environment for all students.”

Argentina: Gay Marriage Chaos, 4 Gay Weddings, 3 Annulled, Then 1 Un-Annulled

Judicial rulings have thrown Argentina into same-sex marriage chaos, this month. Three gay couples and one lesbian couple have been allowed to marry in recent months following judicial rulings that applied specifically to each couple.

But other judges then came along and, upon the request of hostile parties, annulled three of the four same-sex marriages. Then, on April 19, one of the three annulled marriages was un-annulled by a judge.

The annulled marriages include the groundbreaking Dec. 28 marriage of Buenos Aires gay activists Alex Freyre and Jose María Di Bello that took place in the far southern province of Tierra del Fuego.

UK: Government Apologizes for Leaked Document Suggesting the Pope Bless a Gay Marriage

Britain’s foreign office has apologised for a memorandum by a civil servant suggesting Pope Benedict should open a hospital abortion ward when he visits Britain this year. The document, which was leaked to the Sunday Telegraph newspaper, also included proposals that the Pope should bless a gay marriage and launch papal-branded condoms when he comes to Britain in September.

The paper said the ideas, ridiculing the teachings of the Catholic Church against abortion and contraception, resulted from a “brainstorm” session. It said Britain’s ambassador to the Vatican had expressed the government’s regret to senior officials there.

“This is clearly a foolish document that does not in any way reflect UK government or FCO policy or views,” a spokesman for the Foreign and Commonwealth Office said.

Lebanon: Gays March With Others to Demand Secular Government

THOUSANDS of Lebanese marched to parliament in Beirut on Sunday in a peaceful rally demanding the secularisation of a state long built on sectarianism.

The rally, organised by independent grassroots movement Laique Pride, joined women, men and children of all ages who blocked the main road leading to parliament as they waved Lebanese flags and chanted, ‘Secularism’.

Gay rights activists too made a strong show in the rally, waving gay pride flags and banners that read: ‘Queers for secularism’.

Yemen: Gay Rights Article Prompts Death Threats

A Yemeni filmmaker is facing a smear campaign from conservative and religious groups in his home country after publishing an article in a local magazine promoting gay rights. The Paris-based author, Hamid Aqabi, wrote that homosexuality was “part and parcel of our society.” He called on the parliament to extend more rights to gay people and went as far as to suggest that the Yemeni government should consider allowing gay marriages, just like in the West.

The article tackled several thorny issues and appeared in A-Thaqafiyya, a cultural magazine funded by the government and issued by the Al-Jumhouriyya institution. Like in most of the Arab world, in Yemen homosexuality is controversial and rarely discussed topic.

“Yemen is the same as other Arabic societies – homosexuality is practiced in private,” Ali Hilli, the pen-name of a London-based gay rights activist and director of Iraqi LGBT told The Media Line. “Freedom of speech is very important and should not be subject to prison sentences. Threats or intimidation are a very dangerous weapon against human rights activists and journalists in the Middle East and governments should tackle this issue,” he said.

Finland: New Poll Shows 1 in 3 Favor Gay Church Weddings, 60% OK With Blessing

Around one in three of Finns interviewed for a new opinion poll say that they would allow same-sex couples to have church-sanctioned weddings. The figure came from a survey by the pollster Taloustutkimus that was commissioned by the Tampere-based newspaper Aamulehti. The poll also found that over 60% of those suveyed are in favour of some type of church blessing for same-sex unions. The highest levels of support were found among young women.

On the basis of the poll, nearly half of all Finns also think that opponants of women clergy within the Lutheran Church should establish their own religious community. The Synod of the Evangelical Lutheran Church is scheduled to convene soon to make a decision on its stand concerning gay and lesbian couples. The Church’s episcopal conference recently suggested recognizing such unions with prayer only.

The Aamulehti-published poll was based on telephone interviews with 1000 people in mid-April.

WA: Is State’s Referendum 71 Supreme Court Brief Poorly Written?

On Wednesday, the proponents of Referendum 71 ( the unsuccessful effort to repeal last year’s everything but marriage domestic partnership law) will face off against the State of Washington in the United States Supreme Court to determine whether the First Amendment protects against the release of the identity of initiative/referendum petition signers under the Washington Public Records Act. Though this dispute has been the subject of prior articles, I reviewed the briefs filed before the Supreme Court to see how the parties’ respective arguments developed.

The Briefs of the Referendum 71 proponents are very strong. They focus well on the notion that signing an initiative is political speech subject to the broadest protection of the first amendment against intimidation, arguing corruption and intimidation are the two biggest threats to a democracy. The biggest weaknesses of their argument are (1) the lack of a record of harassment in connection with referendum 71 and (2) the question whether signing a petition is an anonymous act.

The Proponents anticipated both these issues by arguing the record of harassment during the Proposition 8 campaign in California (the successful effort to constitutional the ban on gay and lesbian marriage) and constructing a multi-step analysis of anonymity suggesting that while signers agreed to disclose their identities to the petition signature gatherers and other signers who see their signatures and to the State to confirm the validity of the signatures, they did not agree to disclose their identities to the public through the public records act.

Portugal: President Will Veto Gay Marriage Bill After Pope Arrives

Portuguese President Anibal Cavaco Silva will veto a gay marriage bill approved by lawmakers in February, Radio Renascenca reported. Cavaco Silva will veto the bill soon after Pope Benedict’s arrival on May 11.

Last month, the president, a Roman Catholic and a member of the PSD party, groups which oppose the legalization of gay marriage, forwarded four out of five of the bill’s articles to the country’s Constitutional Court, setting aside a measure that prohibits gay adoption. He said he did so because he doubted the bill’s constitutionality, but refused to say why he did not include the article on adoption.

The court’s majority, however, ruled the four articles to be constitutional earlier this month. The president has 20 days from the ruling’s official publication – which has yet to happen – to either reject the measure or allow it come into force.
