NJ: Supreme Court Rejects Gay Marriage Case on 3-3 Vote

The New Jersey Supreme Court will not consider whether the state’s civil union law provides equal rights to gay couples before the case is heard in a lower court.

The court announced Monday that it could not consider the merits of the claim by six same-sex couples that New Jersey’s civil union law is unconstitutional, until there is a trial record.

Gay couples unsuccessfully sued New Jersey four years ago for the right to marry. They claimed that by creating civil unions, the state did not fulfill a court order to treat them the same as heterosexual couples seeking to marry.

DC: What’s Next for Gay Marriage Law

In yet another important win for marriage equality, the District of Columbia’s highest court ruled July 15 that the city government acted lawfully when it rejected a local minister attempt to place a referendum before voters that sought to roll back equal marriage rights for gay couples in the nation’s capital.

The ruling leaves intact marriage equality legislation, in effect in the District City Council since early March. But the ruling may not be the end of the battle for Washington, D.C. The U.S. Supreme Court and Congress may have the final word.

There were two questions before the D.C. Court of Appeals, which is the equivalent of a state supreme court. First, whether the proposed ballot measure was discriminatory or not, and second, whether the D.C. City Council had the authority to restrict a ballot initiative that violated a provision of city’s Human Rights Act, which bans discrimination based on the basis of sexual orientation and other categories.

Australia: Lesbian Labor Minister Speaks Out Against Marriage Equality

OPENLY lesbian Climate Change Minister Penny Wong is under fire from the gay community after declaring her opposition to gay marriage. Australian Marriage Equality spokesperson Alex Greenwich said Senator Wong’s rationale for opposing marriage equality was hypocritical. Mr Greenwich said Senator Wong would never have made it into politics if discrimination against gays and Asians had not been opposed.

“By opposing marriage equality, Penny Wong has betrayed gay and lesbian Australians, and by using culture, religion and history to justify this opposition she has betrayed the principles of tolerance and inclusion that have given her immense opportunities as a lesbian woman of Chinese descent,” he said.

On the Ten Network yesterday, Senator Wong said she respected Labor’s view of marriage as an institution between a man and a woman.

MO: Governor Expands Anti Discrimination Policy to Cover Gays/Lesbians

It’s relatively basic: Laws are created after the Legislature approves a bill and the governor signs it. But that is not the only way for chief executives to enact policy.

Gov. Jay Nixon used such an alternative method earlier this month, approving an executive order that expands Missouri’s nondiscrimination policies to cover people who are gay and those who served in the military.

Under the order – which applies to the executive branch of state government – people cannot be treated differently based on sexual orientation or veteran status for jobs and various state services such as licensing, job training and financial assistance.

Anti Gay Marriage Arguments – Why Does it All Sound So Familiar?

Have you ever been listening to the ramblings of a lunatic and thought to yourself, “This just sounds too familiar?”

Maggie Gallagher and other anti-equality figureheads have said a lot of interesting (and by interesting, I mean profoundly moronic) things with regards to the LGBT rights movement. But every time I hear one of them prattle on about how equality for gay people is a horrifying threat to the world as we know it, I can’t help but wonder why I feel as though I’ve heard it all before.

And then I realize: I have heard it all before, coming from my US History teachers. George Wallace – if you ask pretty much anyone other than him – was racist. In fact, Wallace became a symbol of racism back in 1963 when, as governor of Alabama, he stood in front of a University of Alabama doorway and literally tried to block the black students from entering the school.

MN: Target Supports Anti Gay Candidate for Governor

Target, the perceived LGBT-friendly department store chain, has contributed $150,000 to Minnesota Forward, a political action committee that supports Minnesota Republican gubernatorial candidate Tom Emmer, an opponent of gay marriage, reports NBC Bay Area.

Emmer, who says “I believe marriage is the union between one man and one woman,” received the money for TV ads.

Website SFist reports that Emmer is also friends with controversial musician Bradlee Dean, of the Christian rock band called You Can Run But You Cannot Hide.

OH: NOM Rally Draws 20 People

At a sparsely attended stop Friday in Columbus, Ohio, Maggie Gallagher returned to helm NOM’s anti-gay marriage Summer for Marriage Tour 2010 bus tour. The campaign is sponsored by the National Organization for Marriage (NOM), the group behind measures in Maine and California that have repealed gay marriage at the ballot box, and is expected to end with a Washington D.C. rally on August 15.

Gay activists once again outnumbered rally attendees in the Ohio capital. One head count put NOM supporters at 20 and counter protesters at 70. Gay activists chanted, “2, 4, 6, 8 time for you to leave the state,” as they attempted to shout down NOM’s speakers.

The event marked the return of Maggie Gallagher, who stepped aside as the group’s president in April. She now serves on the group’s board and Brian Brown took over the helm. Brown, who’s spoken at every previous event, was noticeably absent.
