CA: State Expands Unemployment Benefits for Gay, Lesbian Couples

The California State Senate passed the Unemployment Benefits Act (AB 2055) yesterday in a 23-11 vote. The bill seeks to ensure that same-sex couples in California have access to unemployment benefits. Previously approved by the State Assembly, the bill was introduced by Assemblymember Hector De La Torre (D-South Gate) and sponsored by Equality California.

“Because domestic partnerships are not the same as marriage, the California legislature took another necessary step toward eliminating discrimination against same-sex couples,” said Geoff Kors, executive director of Equality California. “The Unemployment Benefits Act will provide same-sex couples in committed relationships who plan to register as domestic partners equal access to benefits that affect the wellbeing and security of their families.”

Currently, heterosexual couples who are planning to marry are eligible for unemployment benefits if one of the partners loses his or her job. This bill would extend the same rights to same-sex couples planning to enter into a domestic partnership.

CA: Senate Dumps Gay “Cure” Law From the Books

The California state senate passed measures Monday to reverse an archaic law that requires the state mental health agency to research “cures” for homosexuality, and to call on President Barack Obama and Congress to repeal the Defense of Marriage Act. According to the Associated Press, Sen. Roy Ashburn (pictured above), who came out this year after a drunk driving incident involving a gay bar, carried the bill to reverse the gay “cure” law, which the assembly already approved. It passed on a 36-0 vote with no debate.

“The law passed in 1950 classifies gays as sexual deviants,” reported the AP. “It requires the Department of Mental Health to research the causes and potential cures for homosexuality.”

The senate also approved a resolution already passed in the assembly calling on the president and federal lawmakers to repeal the discriminatory DOMA. The vote was 22-12, according to the AP.

WY: Gay Couple Files Lawsuit Against Gay Marriage Ban

A gay couple from Cheyenne has filed a federal lawsuit challenging the Wyoming law that defines marriage as existing only between a man and a woman. David Shupe-Roderick, 25, and Ryan Dupree, 21, filed the lawsuit Aug. 13 after the Laramie County Clerk’s Office refused to issue them a marriage license.

Shupe-Roderick said he began to consider litigation after the third rejection. “If we’re the Equality State, then (Wyoming) needs to live up to the name,” he said. Shupe-Roderick and Dupree are acting as their own attorneys in the case, but Shupe-Roderick said he is discussing the complaint with attorneys and may find legal representation.

He added that a pre-trial conference is scheduled for next month. Wyoming attorney general Bruce Salzburg declined to comment on the case because he hadn’t reviewed the lawsuit yet.

CA: One in Seven Unmarried Same Sex Couples Lives in California

Of the 700,266 same-sex unmarried partners counted by the U.S. Census Bureau, one in seven of them reside in California, according to an analysis by Social Explorer.

The Social Explorer website provides demographic analysis in a limited free format and via a more robust subscription service. The site blog also features certain stats pertinent to current social events.

With the recent overturning of California’s ban on same-sex marriage, which voters passed as Proposition 8 in November 2008, Social Explorer parsed out the Census data.

Catholics For Equality Forms to Support Gay Rights Efforts

A group of LGBT activists and allies have formed Catholics For Equality. From their about page: “Drawing on the rich tradition of Catholic social justice teachings, American Catholics are among the strongest supporters of equality for LGBT people of any religious group in the U.S.

“Yet the official voice of the hierarchy is increasingly one favoring discrimination and opposing just, humane, and reasonable efforts to secure legal equality for LGBT Americans. Far too often, that anti-equality voice is portrayed as representing the values of American Catholics.

“We believe this trend is a repudiation of Catholic teaching about the equal dignity of every person as well as the American and constitutional values of fairness and equality under the law. Catholics for Equality was founded in 2010 to support, educate, and mobilize equality-supporting Catholics to advance LGBT equality at federal, state, and local levels. We’re here to help pro-equality Catholics make a difference.”

No Gay Couples Qualify for Today’s Wedding Contest

The “Today” show decided last month to allow gay couples to apply to participate in its annual wedding contest. But now, the NBC program has revealed the four couples who will compete in the contest – and there are no same-sex couples in the group.

There was public pressure on NBC from gay rights groups earlier in the summer to change the rules for the contest. Previously, same sex couples had been excluded from participating because of the restrictions on gay marriage in New York. After meeting with gay rights group GLAAD in July, though, NBC announced that it would be changing its rules, since New York’s marriage laws recognize gay marriages performed in other states.

However, the finalists were revealed Monday, and no gay couples made it through.

IL: Legislature May Have Votes for November Vote in Civil Unions

Civil unions for same-sex partners in Illinois may be on the agenda for the November legislative veto session. A leading gay-rights activist said Senate Bill 1716 has garnered enough votes among lawmakers to pass both Democratic-controlled chambers.

“Whenever the legislature is back in session, we can do it,” said Rick Garcia of Equality Illinois, an advocacy group for gay, lesbian, bisexual and transgender individuals.

But the sponsor of the legislation said Garcia may be too optimistic. “I would like to do this as soon as possible,” said Rep. Greg Harris, D-Chicago. “But every member of the General Assembly has two priorities on their mind right now: jobs and the economy, and the terrible state the budget is in.”

17 States Now Past 50% Support for Marriage Equality

Gay marriage is not going away as a highly emotional, contested issue. Proposition 8, the California ballot measure that bans same-sex marriage, has seen to that, as it winds its way through the federal courts. But perhaps the public has reached a turning point.

A CNN poll this month found that a narrow majority of Americans supported same-sex marriage – the first poll to find majority support. Other poll results did not go that far, but still, on average, showed that support for gay marriage had risen to 45 percent or more (with the rest either opposed or undecided). That’s a big change from 1996, when Congress passed the Defense of Marriage Act. At that time, only 25 percent of Americans said that gay and lesbian couples should have the right to marry, according to an average of national polls.

The more important turning points in public opinion, however, may be occurring at the state level, especially if states continue to control who can get married. According to our research, as recently as 2004, same-sex marriage did not have majority support in any state. By 2008, three states had crossed the 50 percent line. Today, 17 states are over that line (more if you consider the CNN estimate correct that just over 50 percent of the country supports gay marriage).
