MT: Bozeman City Council Backs Gay Marriage Lawsuit Unanimously

The Bozeman City Commission got a standing ovation Monday night after unanimously approving a resolution backing seven same-sex couples suing the state of Montana for the same rights as married couples.

No other city in the state has taken a stance on the issue. Bozeman is the first to do so and city commissioners plan to forward their resolution to the governor, attorney general and state legislators.

“This is an opportunity to lead,” Mayor Jeff Krauss said. “It’s an opportunity to convince those individuals – those open-minded individuals – to respect the minority.”

Don’t Ask Don’t Tell Repeal – Where Are We Now?

An excellent update as to where things stand on the effort to end the military’s gay ban. It’s not long, and worth a read. Of particular note is ThinkProgress’s accurate (I think) prognosis that there’s little chance of DADT legislation being passed during any lame duck session between the elections and the installation of a new Congress in January.

Which begs the question: Why did White House deputy chief of staff Jim Messina basically promise an audience in Montana just a few days ago that DADT would be repealed this year?

I suspect the answer is that Messina is simply trying to buy off gay voters, between now and the election, with more false hope. The administration often seems to think in terms of short-term strategy – if they can convince progressive critics to back down in the near term, it doesn’t matter if in the long term things go terribly south.

NC: Greensboro Paper Changes Stance, Allows Gay/Lesbian Couples in Contest

Sometimes challenging convention in support of equality does pay off. The Greensboro News & Record, is now going to allow same-sex couples to fully participate in its wedding contest, dropping its requirement for a NC marriage license. John Robinson, the editor of the paper, contacted me just a few moments ago with the news.

“We’ve dropped the rule about the N.C. marriage license from the wedding contest.

“Thanks for your challenge and feedback about inclusivity. It took a little longer than we would have liked because we needed to discuss it with the other ‘wedding’ partners and then get the lawyer’s OK to change the rules after the contest started.”

NY: Gay Group Calls on Gillibrand to Amend Civil Rights Act to Include Sexual Orientation, Gender Identity

Ten days after Lady Gaga tried to enlist Sen. Kirsten Gillibrand in the fight against “Don’t Ask Don’t Tell,” gay activists are petitioning the junior senator from New York to help them amend the Civil Rights Act. On Monday, members of the Queer SOS! action campaign started a vigil outside Gillibrand’s Manhattan campaign headquarters, at 15 W. 26th Street, that will continue indefinitely from 10 a.m. to 6 p.m.

The group wants to amend the 1964 Civil Rights Act to make it illegal to discriminate based on sexual orientation and gender identity

If Gillibrand has not pushed for a bill by Oct. 11, National Coming Out Day, the activists plan to extend their vigil to 24 hours a day. If there is no movement by Nov. 2, election day, some of the activists say they will institute a water-only fast.

RI: Third NOM Pre-Emptive Lawsuit Against Campaign Finance Laws

A group seeking to head off the legalization of same-sex marriage in Rhode Island has gone to court seeking the right to spend thousands of dollars on TV and radio ads for and against candidates for governor and the General Assembly, free from the state’s contribution limits and “extensive reporting requirements.”

The lawsuit was filed in U.S. District Court earlier this month by the National Organization for Marriage, a nonprofit group with a multimillion-dollar war chest.

Framed as a First Amendment legal battle, the suit was one of three filed in recent weeks by the James Madison Center for Free Speech and lenge the restrictions on political advertising and campaign-finance disclosure requirements in New York, Florida and Rhode Island.

Poland: Politician Outs Man on National TV

Elżbieta Radziszewska, Poland’s equality minister, who recently gave an interview in which she declared her belief that Catholic schools should be allowed to terminate gay and lesbian teachers, outed the gay politician on live television last week. The man, Krzysztof Śmiszek, deputy president of the Polish Society of Anti-Discrimination Law, was appearing alongside her on a program at the time of the outing.

Reports Pink News:

The pair were arguing about her remarks on gay teachers when Ms Radziszewska used Mr Śmiszek as an example of why cases should be treated individually.

According to the Warsaw Business Journal, she said: “If, for example, Mr Śmiszek, in a situation when we know that he is a member of the homosexual society and an activist for the Campaign Against Homophobia and it;s no secret who his partner is…”

Australia: Warringah City Council Plans Commitment Registry

WARRINGAH could soon follow the lead of City of Sydney Council in creating a “commitment register” that would recognise both same-sex and opposite-sex relationships. Cr Jason Falinski has put forward the proposal, which would allow unmarried couples to register their commitment to each other through a process managed by council.

Couples would also be given the option of holding a ceremony to celebrate their declaration. There is currently no civil union scheme in NSW, but a commitment relationship register is available to all residents of the state.

City of Sydney’s register was established in 2005.

FL: NOM Files Another Lawsuit Trying to Weasel Out of Campaign Finance Laws

The National Organization for Marriage, which opposes same-sex marriage, claims Florida’s campaign law unconstitutionally chills its right to free speech. The nonprofit, which describes itself as nonpartisan, claims it should be excused from “a panoply of burdens: including registration, recordkeeping and extensive reporting requirements,” because complying with those burdens “would simply not be worth it”.

The group has filed similar lawsuits in Maine, New York and California. In its federal complaint in Florida, NOM says it intends to spend more than $5,000 in Florida to publish ads on radio, television, by direct mail and on the Internet against candidates for the Florida Legislature who it believes support same-sex marriage legislation.

“NOM does not wish to reveal the candidates’ names in this complaint, because it does not wish to divulge its strategy at this early date,” the complaint states. It says it fears that without court intervention, the Florida Secretary of State will use the state’s campaign law to stymie its efforts.
