The DOMA Cases: The Tenth Amendment Tango

The last amendment in the Bill of Rights sounds simple: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” It is pretty clear that this clause was animated by the anti-Federalist concern about a strong central government and the amendment’s inclusion in the Bill of Rights was central to gaining enough votes to ratify the Constitution. It is also clear that this clause is less protective of states’ rights than its predecesor in the Articles of Confederation and the Framer’s decision to include broad language in Article I — the section that grants powers to Congress — belies the simple anti-government meme.

The 10th Amendment has become increasingly important in legal circles over the last thirty years, as conservative scholars have sought constitutional bulwarks against the welfare state and social legislation. It is not surprising, then, that the 10th Amendment figures into LGBT law, specifically with regard to the Defense of Marriage Act (DOMA).

NM: GOP Lawmaker Introduces Gay Marriage Ban

Nora EspinozaYesterday Tea Party-backed GOP state Rep. Nora Espinoza introduced a state-level version of DOMA. Equality New Mexico reports on their Facebook page:

This very concept of creating less equal classes of people has been fought against for generations in New Mexico and is contrary to our state’s proud traditions of providing equal protection and opportunity for her citizens from every background and community.

Similar legislation was defeated last year when it was tabled in the Senate Rule Committee. This year, however, promises greater challenges given the much more conservative make up of both our state legislature and governor’s office.

IA: Senate GOP Tries to Block Rule Change That Would Help Stymie Gay Marriage Ban

The first test in the Iowa Senate on the issue of a proposed constitutional amendment to ban gay marriage could come as soon as Thursday, lawmakers said today.

Minority Republicans who support a constitutional prohibition on same-gender marriage are accusing leaders of the Democratic majority of parliamentary maneuvering intended to prevent the issue from coming to a full Senate vote. Democrat leaders strongly deny such an effort is underway and say that they are only following traditional policies of running the Senate that have been in place for decades.

However, Senate Majority Leader Michael Gronstal, a Council Bluffs Democrat, has previously vowed to fight Republican efforts to push for a statewide vote on a constitutional amendment banning gay marriage. Gronstal has said he won’t allow discrimination to be placed in the Iowa Constitution.

MI: Partners of State Employees Can Receive Benefits

Michigan CapitolThe Michigan Civil Service Commission has decided to allow benefits for domestic partners of state employees.

Previously, only legal spouses were allowed benefits from the state.

A spokeswoman for Equality Michigan, a lesbian, gay, bisexual and transgender advocacy and anti-violence organization, said in a news release Monday that the organization applauds the commission’s decision.

17 States Have Majority Support for Marriage Equality

Gay Marriage PollA majority of people in 17 states now support giving gay and lesbian couples the right to marry.

According to a special reported titled Polling Shows Americans Support LGBT People On All Issues released Wednesday by the Human Rights Campaign (HRC), the nation’s largest gay rights advocate, support for gay marriage has increased in all 50 states.

“While the American people embrace their LGBT friends and neighbors, government remains a lagging indicator of acceptance,” HRC President Joe Solmonese said in a statement. “The numbers don’t lie. Americans want equal rights for LGBT citizens and lawmakers should heed their call.”

ID: Legislators Consider Adding Sexual Orientation to Protected Classes

Idaho Capitol BuildingLegislators will again look at adding sexual orientation and gender identity to classes protected under the state’s anti-discrimination law.

Senate Minority Leader Edgar Malapeai, D-Pocatello, has put forward a bill that would make it illegal to fire (or refuse to hire) someone, or deny someone housing, because he or she is gay. A similar bill was introduced in 2008, but it died in committee.

Malapeai said it’s simply the right thing to do to add sexual orientation and gender identity to the state Human Rights Act, which already covers creed, color, sex, and national origin. The senator said that as things are people who feel they have been fired from a job because they are gay have no recourse.

NC: Faith Leaders Ask Asheville to Support Full LGBT Equality

In a district represented by conserva-Dem Heath Shuler on the Hill, Asheville remains a progressive island. An interfaith group, People of Faith for Just Relationships, calls for support of an equality resolution at a news conference today.

More than twenty-five local faith leaders from a variety of traditions gathered on the front steps of the First Congregational United Church of Christ to release a Resolution in Support of Full Equality for All Asheville Citizens.

People of Faith for Just Relationships spokesperson, the Rev. Joe Hoffman, explained, “The Resolution’s purpose is to stimulate Asheville and City Council to take a leadership role in a statewide effort to recognize the need for equal civil rights, employment rights, and family rights and protection from bullying for LGBT (Lesbian, Gay, Bisexual, and Transgender) citizens.”

MD: Poll Shows Marriage Equality Support at 51%

Maryland Gay Marriage PollA just-released poll reveals that a slim majority of Maryland residents now support same-sex marriage.

According to Annapolis-based pollster Gonzales Research, 51 percent of Maryland residents support gay marriage. Endorsements break down along party lines, with 65 percent of Democrats and 52 percent of independents favoring same-sex marriage, while only 24 percent of Republicans back the concept.

The poll has a margin of error of plus or minus 3.5 percent. Maryland has a de facto form of legal civil union. Employers must offer benefits to same-sex domestic partners of employees. Maryland Attorney General Douglas Gansler has issued an opinion that Maryland must recognize same-sex marriages performed elsewhere.

HI: Civil Unions Bill Passes Out of Senate Committee

Hawaii lawmakers have begun debate and have passed a bill to provide civil unions, offering benefits and responsibilities identical to marriage, for unmarried couples that is nearly identical to a measure that passed the Hawaii Legislature last year before it was vetoed by then- Republican Gov. Linda Lingle.

According to KITV.com, the civil unions legislation has the support of a majority of lawmakers and new Gov. Neil Abercrombie.

So, the goal of supporters is to pass the controversial legislation early in the season so it does not become a distraction or get delayed as other issues take lawmakers’ attention.
