US: Feds Drop Defense of Two More DOMA Cases

Marriage EqualityThe Department of Justice followed Wednesday’s withdrawal from two DOMA cases in the Second Circuit, including GLAD’s Pedersen v. OPM by notifying the clerk of the First Circuit that they will also “cease to defend” the two consolidated DOMA cases, Gill v. Office of Personnel Management and Massachusetts v. HHS.

The DOJ has not sent a letter to the Congress declining to defend DOMA in toto in the Gill case, so its determination may only apply to the extent the court determines that heightened scrutiny is the proper standard of review for DOMA’s constitutionality. No matter what happens, the case will proceed with DOJ as the attorneys for the government defendants.

“It is increasingly clear to everyone what has been clear to gay and lesbian families for years – that DOMA’s denial of protections available to all other married families is discriminatory, harmful, and unjustifiable,” said Mary L. Bonauto, GLAD’s Civil Rights Project Director and lead attorney on both Gill and Pedersen.

KS: Anti Gay Bill Tabled in Committee

Kansas State CapitolWell, that was quick. It seems that lots of people were displeased about Kansas House Bill 2260. You know, the bill that says you can hate on gay and trans people all you want, as long as you do it in the name of God.

This is amazing news, and, to be honest, was a little unexpected. According to the Kansas Equality Coalition, there was no debate on the bill. Once it came up in committee, there was an immediate motion to table the legislation. And it wasn’t even close! The motion passed by either a 12-8 or 13-7 majority (KEC says the vote happened so quickly that it was hard to count). Wowza!

Technically, the bill is only tabled, so it could come up again in this legislative session, but since the session is about half over at this point, it’s unlikely to be picked back up again this year.

Italy: Berlusconi Reiterates Stance Against Marriage Equality

Silvio Berlusconi“As long as we rule the country, gay marriages will never be on a par with traditional families”, stated Mr Berlusconi.

Speaking at a conference for Christian-reformists, the Prime Minister also went on to say that “as long as we are in charge, there will never be a possibility for gay singles nor gay couples to adopt.”

NH: House Panel to Vote on Gay Marriage Ban This Week

New Hampshire Gay MarriageA House committee votes this week on two bills that would repeal New Hampshire’s gay marriage law.

The Judiciary Committee meets Tuesday to decide whether to hold onto the bills until early next year or to recommend that the full House act on them by the end of March. The sponsors asked the committee to retain the bills so lawmakers can focus on fiscal issues.

Nearly 600 people signed up to testify at a hearing on the issue with most opposed to repeal. Many urged the committee to put the issue to rest this session.

Slovenia Considering Marriage Equality Bill

The Slovenian Parliament should adopt the new Family Code proposed by the Slovenian Government, Human Rights Watch said today in a letter to parliament members. The law would extend civil marriage to lesbian and gay couples and put heterosexual and homosexual partnerships on equal legal footing, including the right of same-sex partners to adopt.

“In recent years many European states have extended civil marriage and adoption rights to same-sex couples,” said Boris Dittrich, acting director of the Lesbian, Gay, Bisexual and Transgender Rights Program at Human Rights Watch. “The proposed Family Code is Slovenia’s chance to join others in Europe in enabling same-sex couples to participate fully in family life.”

Many governments within Europe have grasped the urgency of ending discrimination in access to civil marriage and adoption, Human Rights Watch said. The Netherlands’ legislature extended full civil marriage and adoption rights to same-sex couples in 2001; Belgium did the same in 2003 for civil marriage and in 2006 for adoption. Spain followed suit in 2005. Same-sex marriage became legal in Norway on January 1, 2009; in Sweden on May 1, 2009; in Portugal on June 5, 2010; and in Iceland on June 27, 2010. Outside Europe, South Africa, Canada, Argentina, Mexico City, and several states within the US recognize same-sex marriage.

CA: Imperial County Tries to Intervene in Prop 8 Case, Again

Imperial County has renewed its effort to defend the state’s gay marriage ban in a federal lawsuit. The sponsors of Proposition 8 so far have taken the lead in defending the voter-approved law in court, after former Gov. Arnold Schwarzenegger and former Attorney General Jerry Brown refused to do so.

But the sponsors’ right to keep defending the law recently came under question, threatening the viability of the case before the 9th U.S. Circuit Court of Appeals. If successful, the move by Imperial County could salvage the appeal, allowing county officials to step in as the primary defendants if the sponsors are removed.

Imperial County officials claim they should be allowed to intervene as defendants, saying they are directly affected by the law because they would be forced to perform gay marriages.

MD: House Plans to Vote on Marriage Equality Bill By End of Next Week

A day after the Maryland Senate voted to legalize same-sex marriage, leaders of the House of Delegates signaled the chamber would move quickly on the legislation, probably putting it to a vote by the end of next week.

A lengthy House hearing on the bill Friday offered a preview of the upcoming debate, with advocates on both sides making impassioned pleas about whether the state should drop its requirement that marriage be between a man and a woman.

“This debate is not about abstractions,” said Del. Heather R. Mizeur (D-Montgomery), one of six openly gay House members to testify before the Judiciary Committee. “While it’s love that makes a family, it’s marriage that protects it.”

Is Gay Marriage Losing it’s “Wedge Issue” Power for the GOP?

President Obama’s decision to abandon his legal support for the Defense of Marriage Act has generated only mild rebukes from the Republicans hoping to succeed him in 2012, evidence of a shifting political climate in which social issues are being crowded out by economic concerns.

The Justice Department announced on Wednesday that after two years of defending the law — hailed by proponents in 1996 as an cornerstone in the protection of traditional values — the president and his attorney general have concluded it is unconstitutional.

In the hours that followed, Sarah Palin’s Facebook site was silent. Mitt Romney, the former governor of Massachusetts, was close-mouthed. Tim Pawlenty, the former governor of Minnesota, released a Web video — on the labor union protests in Wisconsin — and waited a day before issuing a marriage statement saying he was “disappointed.”

India: New Bill Would Ban Gay Couples From Using Surrogate Services

Gay couples are to be banned from using surrogate mothers in India as part of a clampdown on British “rent-a-womb” tourists. A Bill going through India’s Parliament will reform the #1.5 billion-a-year “baby factory” industry.

Indian officials say it is intended to stop vulnerable women being exploited but it will bar all same-sex couples from the private clinics. Single mothers and unmarried couples will be allowed to use surrogates but all Western women will have to prove they cannot bear a child.

They will also have to be supported by doctors who will be encouraged to provide counselling for any surrogate mother who suffers from post-natal depression.
