Hawaii Gets Civil Unions; Will Guam Follow Suit?

Governor Neil Abercrombie signed same-sex civil unions legislation into law making Hawaii the seventh state to allow such unions. The gay community on Guam is with the action and many are hopeful that the island will follow suit soon after legislation failed to make it to session floor last year.

“It’s encouraging to Guam and I think the tide of sentiment throughout the nation is shifting and has shifted quite dramatically, really in the past five to tem years, noted Attorney Bill Pesch. He tells KUAM News that he’s optimistic that tide will hit the pacific sooner than later, especially with the historic repeal of the military’s “Don’t Ask, Don’t Tell” policy. “I see that as the harbinger of major social change,” he continued, “because if you look at any of the major social changes in the United States over the past several decades, whether it be gender equality, racial equality, and now I think sexual preference and equality, the military really has always led the way.”

But even with the social mindset shifting, one major obstacle for the gay community especially locally has been the Catholic Church vehemently opposed to gay marriage or same sex civil unions. Even after Abercrombie signed the legislation into law, the Hawaii Catholic Conference expressed concerns that the passage of the legislation is a step toward legalizing same sex marriage.

When a ‘Defense’ is Indefensible

Into what kind of knots should a government twist itself to defend its own discredited policies? In a highly unusual move Wednesday, President Barack Obama in effect declared the twisting on one law, the Defense of Marriage Act, is over and done. The administration announced that it would no longer defend the law, nicknamed DOMA, against legal challenges.

The law, approved in 1996, banned federal recognition of same-sex marriages and allowed states to ignore same-sex marriages performed across state lines. Many people then feared Hawaii was on the verge of approving same-sex marriages and that other states would be forced to follow suit.

And, indeed, under the Constitution’s Full Faith and Credit Clause, states are generally obligated to recognize the public acts, judicial proceedings and records — including marriages — of every other state. It’s hard now to reconstruct the emotional ferocity of that moment. But the Defense of Marriage Act was signed into law by President Bill Clinton, we should note, and even people previously perceived as gay-rights supporters went along with it.

Rep. Earl Blumenauer, D-Ore., for one, has called his vote in support of the Defense of Marriage Act in 1996 “the worst vote of my political career.” His belief was that passage of the new law would take the steam out of an effort to mobilize the Republican base, but instead, he acknowledged in 2009, it only inflamed animosity.

NY: Court Says Gay Spouse Can Inherit After Canadian Weddng

A survivor of a same-sex marriage can inherit as a spouse, an appeals court said Thursday in a ruling a gay-rights legal group called the first appellate decision of its kind in New York. While same-sex couples can’t wed in the state, J. Craig Leiby and H. Kenneth Ranftle were legally married in Canada, so Leiby is entitled to recognition as the surviving spouse in a dispute over Ranftle’s estate, the appellate judges said in upholding a lower court’s decision.

Leiby and Ranftle married in Montreal on June 7, 2008, after being together for nearly 25 years, according to court papers. Financial and professional services workers, they lived and worked in New York City. Ranftle died of lung cancer Nov. 1, 2008, according to an obituary notice.

One of Ranftle’s brothers, Richard, sought to contest the will and challenged the legitimacy of the marriage, saying it violated public policy in New York. The will left most of the estate to Leiby, with bequests to Richard Ranftle, other brothers and a goddaughter. “New York’s long-settled marriage recognition rule affords comity to out-of-state marriages” that are valid where they are made, the state Supreme Court’s Appellate Division wrote.

MD: Senate Sends Marriage Equality Bill to House

Senator Richard MaldalenoThe Maryland Senate on Thursday approved a gay marriage bill. After a lengthy debate, one Republican, Senator Allan Kittleman, crossed the aisle to join 24 Democrats in voting for the bill.

Senator Richard S. Madaleno Jr., a Democrat and the chamber’s only openly gay member, argued that giving gay and lesbian couples the benefits of marriage is a matter of fairness.

“It provides full equality under the law for thousands of same-gender couples in our state, couples like Mark and myself,” he said, referring to his partner of more than a decade, with whom he’s raising two children.

Conservatives Promise to Make Marriage Equality a Campaign Issue in 2012

Angered conservatives are vowing to make same-sex marriage a front-burner election issue, nationally and in the states, following the Obama administration’s announcement that it will no longer defend the federal law denying recognition to gay married couples.

“The ripple effect nationwide will be to galvanize supporters of marriage,” said staff counsel Jim Campbell of Alliance Defense Fund, a conservative legal group.

On the federal level, opponents of same-sex marriage urged Republican leaders in the House of Representatives to intervene on their own to defend the 1996 Defense of Marriage Act, or DOMA, against pending court challenges.

MT: State Senate Passes Repeal of Anti-Gay Sex Law

Montana Gay RightsMontana voted to strike an obsolete law criminalizing gay sex on Wednesday:

The Montana Supreme Court struck down the law in 1997, and Senate Bill 276 carried by Sen. Tom Facey would remove it from state code. The Missoula Democrat said the measure would provide equal protection under the law for all Montanans.

The Senate endorsed the bill 41-9 with 19 of 28 Senate Republicans supporting the measure. It has one more usually procedural vote before it goes to the House. Republican backing for the measure goes against years of support for outlawing homosexual acts, which became part of the official party platform after the 1997 Supreme Court decision.

DC: Respect for Marriage Act to Repeal DOMA To Be Re-Introduced in House

In September 2009, Congressman Jerrold Nadler (D-NY), together with Congresswoman Tammy Baldwin (D-WI) and Congressman Jared Polis (D-CO), along with Congressman John Conyers (D-MI), Congressman John Lewis (D-GA), Congresswoman Nydia Velazquez (D-NY) and Congresswoman Barbara Lee (D-CA), introduced the Respect for Marriage Act in the House of Representatives. This legislation would have repealed the Defense of Marriage Act (DOMA), the 1996 law which discriminates against lawfully married same-sex couples.

Back in 2009, the Congressman noted that the 13-year-old DOMA “singles out legally married same-sex couples for discriminatory treatment under federal law, selectively denying them critical federal responsibilities and rights, including programs like social security that are intended to ensure the stability and security of American families.”

At the time many activists were angered by the fact that some key democratic members of the House, sych as Rep. BarenyFrank, had refused to sign on as a co-sponsor to the repeal legislation. At the time I was informed by a Rep. Frank senior staffer, that the Congressman would not sign as he believed DADT and ENDA should be the focus and pass first, before DOMA’s repeal would be viable.

Ireland: New Poll Says More Than 60% Favor Marriage Equality

THE majority of people want gay marriage to be legalised. More than six out of every 10 voters believe same-sex marriages should be recognised by the State, according to the latest Irish Independent/Millward Brown Lansdowne survey. The figures show just 27pc of voters are opposed to the idea of gay marriage.

The issue has proved hugely divisive in the past year. Last July, President Mary McAleese signed the Civil Partnership Bill into law, in the face of protests from senior bishops.

The legislation, which came into effect last month, gives legal recognition to same-sex relationships together with a range of rights and protections including maintenance obligations, protection of a shared home, pension rights and succession. However, some campaigners within the lesbian, gay, bisexual and transgender (LGBT) community have argued that the laws do not go far enough by stopping short of gay marriage.

A Whole New Ball Game on DOMA and Same Sex Marriage

Back in July 2010, Judge Tauro in the federal district court in Massachusetts issued a pair of decisions overturning the Defense of Marriage Act (and offering some rather creative tenth amendment rhetoric). I was quoted in the New York Times as saying “What an amazing set of opinions … No chance they’ll be held up on appeal.”

I can’t say that now.

The Obama Administration announced today that it has taken the official position that DOMA is unconstitutional and refuses to defend it in litigation in the Second Circuit. Moreover, The Obama Administration now takes the position that legislation like that in DOMA, which discriminates on the basis of sexual orientation, should be subjected to heightened scrutiny, rather than rational basis scrutiny.

As Jason Mazzone points out, Holder has also said in a letter to the Speaker of the House that in those circuits that hold as a matter of precedent that the rational basis test applies to distinctions based on sexual orientation, the Justice Department’s position is that there is a rational basis for DOMA. (Judge Tauro of Massachusetts, it should be noted, sits in the First Circuit, where courts have held that only rational basis applies). Nevertheless, the Justice Department’s view is that these lower court precedents are incorrect and that rational basis should not apply.
