NY: Governor Cuomo Promises Marriage Equality Vote Within 6-8 Weeks

New York Gay MarriageAfter making Albany heel when it comes to the budget, Gov. Andrew Cuomo has promised a gay marriage vote in the upcoming six to eight weeks.

Cuomo has always promised he would tackle marriage equality, so this is no shock. Will it pass the legislature? Hard to say. Sure a late January Quinnipiac University poll showed 56 percent of state voters support gay marriage. Power players like Mayor Michael Bloomberg, U.S. Sens. Chuck Charles Schumer and Kirsten Gillibrand are on board. Let’s not forget two former Big Apple Mayors, David Dinkins and Ed Koch, made their support public. Finally there are the famous, such as Russell Simmons and Joan Rivers (go the New Yorkers for Marriage Equality if you want to see their vids).

High polling figures, a popular governor playing point, and positive buzz. It wouldn’t shock if some see gay marriage in New York a slam dunk.

CO: House Democrats Push For Full House Vote on Civil Unions Bill

Colorado Civil UnionsActivists, lobbyists and citizens this week have been pressing for at least one of six Republican members of the state House Judiciary Committee to vote in favor of sending Pat Steadman’s same-sex civil unions bill to the House floor for debate. On Tuesday, the House Democratic caucus officially joined the campaign.

“Civil Unions are clearly an important issue to the people of Colorado. This bill deserves to be debated by all 65 members of the State House,” said House Minority Leader Sal Pace, D-Pueblo. “I call on Speaker McNulty, Judiciary Committee Chair Rep. Bob Gardner and the House Republicans to join House Democrats in sending the bill to the full House so that civil unions can have a robust debate and a straight up or down vote. Coloradans deserve that much.”

Denver Senator Pat Steadman introduced SB 172 in February. The bill would grant gay couples extended domestic partnership rights.

Austrian Constitutional Court Rejects Gay Rights Lawsuit

Austria’s Constitutional Court has rejected a case aimed at including gays and lesbians under laws that protect against incitement to hatred and against discrimination in non-workplace settings.

The court was asked to strike down Criminal Code Article 283, “Incitement to Hatred,” and sections of the Federal Equal Treatment Act because they exclude gays and lesbians.

According to the group Rechtskomitee Lambda, Austria’s government defended the status quo, arguing that incitement to hatred against gays and lesbians differs from incitement targeting religious or racial groups because the former lacks “dangerous close-range and long-range effects.”

Australia: Election Night a Setback for Marriage Equality

As the election count continues it seems unlikely the Greens can seize the balance of power in the Legislative Council, with that falling instead to the Shooters and Fishers Party and the Christian Democrats.

On the surface it looks grim — Greens with the balance would have forced serious debate on reforming the NSW Anti-Discrimination Act. That debate is now unlikely to begin for another three years, while actual reform could be a decade away. A better outcome for our community would have been a Coalition majority in both houses and no need to deal with Fred Nile.

But in terms of public support for the Christian Democrats, this has not been a victory election. All Nile has succeeded in doing is winning back the seat he lost when Gordon Moyes defected to form Family First NSW, and his party’s high-profile campaign against our community in Sydney seems to have backfired.

IN: Marriage Equality Protesters Disrupt Senate

Indiana Marriage Equality ProtestersProtesters from Jesus Metropolitan Community Church, a congregation of 400 located on the northeast side of Indianapolis, held signs reading “Would Jesus Discriminate?” and conducted a loud protest atthe Indiana Statehouse today as the Senate took a preliminary vote approving an amendment that would ban same-sex marriage and civil unions in the state.

The vote came after an attempt to strike civil unions the anti-gay legislation.

WIBC reports:

For the second time in six days, senators have rejected civil unions as a potential middle ground in the gay-marriage debate. On a 36-11 party-line vote, the Senate shot down a proposal by Anderson Democrat Tim Lanane to delete a ban on civil unions from a proposed constitutional amendment banning same-sex marriage. The Senate Judiciary Committee had rejected a similar attempt by Lanane last week.

USA: Barney Frank to Introduce ENDA in House This Week

Barney Frank, ENDAChris Geidner at Metro Weekly reports that the reintroduction of the Employment Non-Discrimination Act is coming this week:

Rep. Barney Frank (D-Mass.) plans to introduce the Employment Non-Discrimination Act in the House on Wednesday, according to two LGBT equality advocates with direct knowledge of the congressman’s plans. Frank’s communications director, Harry Gural, confirmed that the plans are “to formally announce ENDA this week,” although he added over the weekend that specifics are not yet nailed down and were expected to be so by this afternoon.

The bill, which Gural says will be the same exact bill as that introduced in the 111th Congress, would prohibit most employers from discriminating in hiring and promotions on the basis of sexual orientation or gender identity.

Brazilian Lawmaker Will Introduce Marriage Equality Legislation Today

Brazil Gay Marriageby On Top Magazine Staff

Brazil’s first openly gay lawmaker, Jean Wyllys, is widely expected on Tuesday to introduce legislation that would legalize gay marriage.

Wyllys, who parlayed a 2005 Big Brother Brazil win into a political career, will introduce the legislation with the support of leaders from two countries which have already approved the institution.

Argentine National Deputy Vilma Ibarra, who played a prominent role in last year’s effort to legalize gay marriage in her country, and the Spanish socialist Pedro Zerolo will assist Wyllys in the effort. Spain legalized marriage for gay and lesbian couples in 2005.

Binational Couples Allowed to File for Green Card While DOMA Constitutionality Debated

Immigration Equality, the national experts on immigration rights for lesbian, gay, bisexual and transgender people, hailed an announcement today from U.S. Citizenship and Immigration Services (USCIS) that the agency will allow Americans with spouses from abroad to apply for green cards while courts weigh constitutional challenges to the federal Defense of Marriage Act.

“USCIS has issued guidance to the field,” USCIS Spokesman Christopher Bentley announced, “asking that related cases be held in abeyance while awaiting final guidance related to distinct legal issues.”

“Today’s statement is the first domino to fall for LGBT Americans with foreign national spouses,” said Rachel B. Tiven, the group’s executive director. “As Immigration Equality noted in our letters to both the Department of Homeland Security and the Department of Justice, we believe that no spousal application should be denied until DOMA’s constitutionality is settled. Immigration Equality has been fighting for LGBT immigrant families since 1994. In that time we have counseled more than 10,000 families — and for them, today’s news is a sign that relief is finally on the way.”

CO: Civil Unions Bill Hilights Republican Divide

Colorado Civil UnionsThe coming debate in the Colorado House Judiciary Committee on same-sex civil unions bill SB 172 will center on Republican arguments for and against the legislation. The debate scheduled to take place under the Dome in Denver Thursday will underline the dynamics shaping the larger national debate on gay rights- a debate that now pits Republicans against Republicans because Democrats and Independents have already made up their minds on the matter.

As expected, Denver Senator Pat Steadman’s bill passed out of the Democratic-controlled Senate late last week. With all of the Senate Democrats signed on as co-sponsors, their support was a foregone conclusion. Yet the bill picked up the support of three moderate Republican lawmakers whose opinions about protecting families and securing individual rights and liberties clashed with their colleagues’ views about the threat the bill posed to traditional one-man-one-woman marriage.

“Fundamentally, as a Republican, what I have to look at is: Does [this bill] fit my core beliefs?” said Durango Republican Ellen Roberts last week, leading GOP support for the bill in the Senate. “I believe strongly in protecting individual core rights and liberties.”
