WA: Time for Marriage Equality

Washington Marriage EqualityNEW YORK’S passage of a gay-marriage law prompts an obvious question: When should Washington pursue such legislation? The answer is soon — next year, if requisite legislative votes can be rounded up.

Washington should move into the modern era of equity and fairness for gay and lesbian couples in committed relationships.

State Sen. Ed Murray and Rep. Jamie Pedersen, two openly gay legislators from Seattle, are considering a new push for a gay-marriage bill in January. Similar bills have been introduced every two years since 1997. Timing is always a consideration, but Murray and Pedersen are right to move ahead and at least count the votes.

USA: Religious Youth Support Marriage Equality

The Public Religion Research Institute today released “Generations at Odds: The Millennial Generation and the Future of Gay and Lesbian Rights,” a report based on the Millennials, Religion & Gay and Lesbian Issues Survey. The survey notes the generational pattern, even among conservative political and religious groups such as evangelical Protestants.

Traditionally, people assume that religious groups generally oppose LGBT equality. However, the survey found that all people in all major religious groups support employment discrimination protections for gay and lesbian Americans. Even among the more contentious issue of marriage equality, major religious groups fall on both sides of the debate.

Dr. Robert P. Jones, CEO of Public Religion Research Institute, noted that support for LGBT people has moved into a majority position. “Overall trends and the strongly supportive attitudes of the Millennial generation suggest that we will look back on 2011 as the year marking a sea change in American attitudes on gay and lesbian issues.”

CA: Prop 8 Trial Video Tape Update

Prop 8 Trial Video TapesIn January 2010, in advance of the historic trial to determine the constitutionality of California’s ban on same-sex marriage, the U.S. Supreme Court stepped into the proceeding. The San Francisco federal judge overseeing the trial, Chief Judge Vaughn Walker, had obtained permission from the U.S. Court of Appeals for the Ninth Circuit to have video of the trial streamed live over the Internet.

Gay marriage opponents filed an emergency appeal at the Supreme Court, arguing that the broadcast would create a media frenzy and intimidate expert witnesses testifying in favor of California’s ban. The high court ducked that question but barred the broadcast on narrow procedural grounds.

Judge Walker nevertheless had the trial videotaped. He told lawyers on both sides that he’d use the tape in his chambers to help him decide the case. As the trial concluded in May 2010, the judge also said the two sides could use video in closing arguments. He provided copies of the videotape to the parties under a protective order.

Looking at The Defense of Marriage Act Six Months Later

Defense of Marriage ActIt was only six months ago that Attorney General Eric Holder sent the letter to House Speaker John Boehner (R-Ohio), informing Boehner that he and President Obama had concluded that courts examining classifications based on sexual orientation should apply ”heightened scrutiny” to them.

Under such a heightened scrutiny – which the letter explained is a decision made by courts about whether, under constitutional guarantees of equal protection, a law’s classification is suspect – Holder went on to tell Boehner that the administration had determined that Section 3 of the Defense of Marriage Act was unconstitutional and that the Department of Justice would no longer defend the law in court.

Section 3, which defines ”marriage” and ”spouse” in federal law as referring only to opposite-sex marriages, was under challenge in two cases that Holder explained necessitated the decision about what level of scrutiny – rational basis, intermediate scrutiny like that applied to sex-based classifications, or strict scrutiny like that applied to race-based classifications – should be applied to sexual orientation classifications.

Israel: Rabbis Back Out of Gay Marriage Initiative

Senior Religious Zionism Rabbis Yaakov Ariel, Haim Drukman and Elyakim Levanon have withdrawn their support from a recent initiative seeking to match between religious homosexuals and lesbians until the religious and ethical aspects of the issue are clarified, Ynet has learned.

The three even demanded that the Kamoha association, which is part of the matchmaking initiative, immediately remove their names from the list of supporters on the association’s website – until further notice.

In the past few days, the rabbis have been asked to explain their support for the initiative. They clarified that despite being involved in the matter, they did not approve the final version of the initiative, which was made public.

CA: Hearing Tomorrow on Prop 8 Trial Videotapes

Prop 8 Trial Video TapesFirst, there was a federal court trial. Then, there was a hearing on whether to sequester videotapes of the trial; Monday, there will be a hearing on whether to release the videotapes of the trial.

But even before the August 29 hearing takes place on whether to release to the public videotapes of the landmark trial challenging California’s same-sex marriage ban — Proposition 8 — there has already been decision to prohibit the recording of the hearing on whether to release the trial videotapes.

Such has been the Proposition 8 trial -Perry v. Brown (formerly known as Perry v. Schwarzenegger). It is a court battle so contentious it has already involved 34 judges and the filing of over a thousand documents, said Chad Griffin. Griffin is head of the American Foundation for Equal Rights, an organization formed specifically to finance the legal challenge to Proposition 8.
