Judge Dismisses Binational Couple’s Case Against DOMA

Defense of Marriage Act Lawsuit DismissedThe case of Indonesian citizen Handi Lui and American Michael Ernest has been dismissed by a federal judge who relied upon a homophobic and outdated court ruling from 1982 rather than contemporary information regarding same-sex marriage.

Lui and Ernest married in Massachusetts in 2009, and the two sued the government after US Citizenship and Immigration Services denied the couple’s marriage-based petition for permanent residency for Lui. The lawsuit argued that the USCIS violated the Immigration and Nationality Act’s wording regarding discrimination on the basis of sex and that the immigration officials interpreted the Defense of Marriage Act was unconstitutional.

House Speaker John Boehner’s pet anti-LGBT lawyers moved to dismiss the case. Judge Stephen V. Wilson dismissed it saying that immigration officials did not err in their decision. The problem is that he went further. He relied upon a 1982 case involving a gay male couple that were denied immigration sponsorship rights. In that case, the rejection of the petition was based upon the fact that the attorneys for the couple had “failed to establish that a bona fide marital relationship can exist between two faggots.”

Australia: 20,000 Attended Twitter Marriage Equality Forum

Australia Gay Marriage ForumThursday night’s Twitter forum on same-sex marriage reached more than 20,000 people, and made thousands more individual impressions, with the former NSW premier Kristina Keneally, the Star Observer, New Mardi Gras and Australian Marriage Equality all taking part alongside high profile community members including dancer Ripley Waters, DJs Seymour Butz and Dan Murphy, and puppet drag queen Queen Miss Left Titter.

Following the forum, organiser Toro Productions tweeted “A quick analysis of the last 50 tweets: We reached 21,144 ppl and exposed 35,262 impressions http://t.co/R6XSTTHX AMAZING! #Equality.”

In her contributions to the forum Keneally urged people to find common ground with supportive people of faith on the issue and warned that civil unions would “undermine marriage for straight families” as well as same-sex couples if introduced instead of full marriage equality.

Pentagon Says Military Chaplains Will Be Allowed to Officiate at Gay Weddings

After months of legal review, the Department of Defense announced Friday that military chaplains may officiate in same-sex wedding ceremonies of service members in states where gay marriage is legal. Such ceremonies can be performed on military bases, officials wrote in a Friday memorandum.

From the DoD memo, issued by Under Secretary of Defense for Personnel and Readiness Clifford L. Stanley:

“A military chaplain may participate in or officiate any private ceremony, whether on or off a military installation, provided that the ceremony is not prohibited by applicable state and local law. Further, a chaplain is not required to participate in or officiate a private ceremony if doing so would be in variance with the tenets of his or her religion or personal beliefs. Finally, a military chaplain’s participation does not constitute an endorsement of the ceremony by DoD.”

NOM: Marriage Equality Now the “Manhattan Conspiracy”

Manhattan ConspiracyMuch like the GOP likes to characterize anything from the Democrats as “San Francisco values,” NOM has begun calling the marriage equality movement “the Manhattan conspiracy.” Because you know what’s in Manhattan? Jews, dirty queers and illegal brown people!

“Gay-marriage advocates from Bloomberg to Tim Gill to Ken Mehlman look across the pond and see that the party of Margaret Thatcher, the “Conservative” Party in Great Britain, is now threatening to pass a gay marriage bill. Could the same thing happen to the party of Ronald Reagan? Not while you and I live and breathe and exercise our God-given ability to act!”

History Lesson: The Passage of the Defense of Marriage Act

Defense of Marriage Act PassageBy the time the Senate passed the Defense of Marriage Act on Sept. 10, 1996, there was no question what President Bill Clinton was going to do when the bill was presented to him.

Months earlier, May 23, 1996, Clinton made his first comments on DOMA, jumbling the specific effect of the bill but echoing comments from his press secretary that he would sign it. On July 11, 1996, the administration issued a Statement of Administration Policy: ”The President … has long opposed same sex marriage. Therefore, if H.R. 3396 were presented to the President as ordered reported from the House Judiciary Committee, the President would sign the legislation.”

But, asked if that was the only path, people around at the time — from LGBT advocates to Clinton staffers — almost universally say no. As the then-head of the Human Rights Campaign, Elizabeth Birch, says of the impact of a Clinton veto of DOMA at the time, “He could have survived it. Absolutely.”

NY: Ledyard Town Clerk to Be Represented by Anti-Gay Alliance Defense Fund

New York Marriage LicensesA town clerk in New York may go to court over her refusal to sign marriage licences for gay couples. Rose Marie Belforti, the town clerk for Ledyard, says God does not want her to condone same-sex relationships.

The 57-year-old has refused to sign any marriage licences – for gay or straight couples – since New York legalised gay marriage. Instead, the clerk, who was elected ten years ago, has appointed a deputy to provide marriage licences.

Ms Belforti is being represented by the Alliance Defense Fund, an Arizona-based Christian group which will argue that her beliefs must be protected by the law.
