Has the GOP Even Read the Iowa Marriage Equality Decision?

Iowa Marriage Equality DecisionNow that the campaign is ending in Iowa, here’s a question: Why have the candidates gone around the state bashing the Iowa Supreme Court decision that said persons of the same sex have the right to marry one another? For that matter, why have their fundamentalist and evangelical supporters been bashing it?

Perhaps it’s time — after 2 years — for those folks to read the 69-page decision. All of it. If they do, they’ll hold it to their breasts. For Varnum v. Brien is a ringing endorsement of the freedom all of us — right and left and center and believer and non-believer and candidate and non-candidate — hold dear, the freedom of religion.

“I actually campaigned in Iowa against those justices” who were ousted after the decision, the devoutly evangelical Rick Santorum proudly said during a debate. Newt Gingrich, who lately has said that as president he would ignore court decisions he doesn’t like, helped finance Bob Vander Plaats’s campaign against the three justices who were on the ballot for an up-or-down vote in 2010.

5. Brian Brown gets laughed at on Fox News

In 2011, a curious thing happened to the National Organization for Marriage. As the organization battled against marriage equality in several states — successfully in Maine and unsuccessfully in New York — NOM’s leaders seemed be slowly backing away from giving interviews and having debates on news programs.

Now it could be that they were shying away from the press so they didn’t have to answer ever growing questions about NOM’s finances. But one could also point out the simple fact that as NOM’s people gave more interviews and took part in more debates, their argument became less credible.

What We Won in 2011

2011 in ReviewThe year 2011 may not have seemed like a noteworthy year to some in regard to LGBTQ rights. But in fact, we witnessed significant changes throughout the world, and in America in particular, when it comes to gay rights. From strides in immigration to marriage equality, 2011 was a year full of change for same-sex couples all over America.

Anti-Discrimination Laws

Throughout the nation, we saw a variety of anti-discrimination laws passed in 2011, significantly protecting against discrimination based on gender identity. In Massachusetts, Governor Deval Patrick signed into law HB 3810, which prohibits employers from discriminating against employees and applicants on the basis of gender identity. Governor Patrick also signed an executive order banning discrimination against state employees based on gender identity. The Nevada Legislature passed a bill banning employment and housing discrimination in the state on the basis of gender identity.

In October, California Governor Jerry Brown signed the Gender Nondiscrimination Act, which makes it illegal to discriminate in employment, education, and housing based on gender identity. The legislature and Governor Brown also corrected some of the inequities affecting same-sex couples by passing the Domestic Partnership Equality Act. Also in October, Connecticut became the 15th state to ban discrimination in employment and housing based on gender identity. The other states with similar bans are California, Colorado, Hawaii, Illinois, Iowa, Maine, Minnesota, New Jersey, New Mexico, Oregon, Rhode Island, Vermont and Washington, as well as the District of Columbia.

HI: Judge Denies Churches’ Request to Block Civil Unions Law

Hawaii Civil Unions LawsuitCome the New Year couples can officially enter into Civil Unions in Hawaii. “We have countless couples ready to enter into Civil Unions on January 1st and January 2nd,” says Alan Spector, Equality Hawaii. But, a lawsuit filed this week, tried to stop it from happening.

Emmanuel Temple, the House of Praise in Wahiawa and Lighthouse Outreach Assembly of God in Waipahu filed for a temporary restraining order and preliminary injunction to block the implementation of the Civil Union law, saying the law violates their civil rights and constitutional protections for religious freedom.

“The law hasn’t even gone into effect yet and they’re suing, claiming they will be forced to host Civil Union ceremonies in their churches when that hasn’t happened,” says Spector.

NY: With Marriage Equality a Reality, School District Cuts Benefits for Domestic Partners

New York School District Cuts Domestic Partner BenefitsFor years, the City School District has granted benefits to partners of employees in domestic partnerships, allowing them to participate in health plans even when the state banned same-sex couples from marrying.

But now, with the passage of the law legalizing same-sex marriage in New York state, some of those partners will lose those health plans and other benefits.

After the Marriage Equality Act went into effect in July, the district decided to stop offering domestic partnership benefits at the end of the calendar year.

Equality Delaware President and Partner to Be Among First to Enter Into Civil Union

Delaware Civil UnionsLisa Goodman of Equality Delaware and her partner will be the first couple to enter a civil union in Delaware on New Year’s Day, the AP reported.

The state’s first law to recognize the unions of gay and lesbian couples takes effect at 10AM on January 1, 2012. However, government offices are scheduled to be closed on January 1 and on January 2 for the New Year holiday.

New Castle County Clerk of the Peace Ken Boulden has announced he’ll open Sunday, January 1 to issue licenses by appointment only. But he won’t perform civil unions ceremonies in his office until January 5.

Now or Never for Marriage Equality Push in Maryland?

Marriage Equality in MarylandMaryland’s governor won’t be on the ballot, and the state is highly unlikely to play much of a role in the presidential election. But 2012 is nonetheless shaping up to be a riveting year in Maryland politics. Here are four major stories to watch in the year to come.

A bill to legalize gay marriage cleared the Maryland Senate relatively quickly in 2011, only to stall in the House of Delegates. Advocates will have some formidable advantages this time around. Building on the experience of lawmakers in New York, which legalized gay marriage a few months after the legislation failed here, advocates have developed a smart, coordinated campaign to win over a few more supporters. But their biggest coup was getting Gov. Martin O’Malley to agree to sponsor the legislation and make it a priority for this General Assembly session.

The key voting bloc is likely to be in the black caucus. Large, predominantly African-American churches, particularly in Prince George’s County, helped scuttle the bill last year, and advocates are clearly targeting their pitch to black voters.

CA: Should International Law Influence the Ninth Circuit’s Prop 8 Decision?

Prop 8 DecisionThe US Court of Appeals for the Ninth Circuit is currently considering the constitutionality of Proposition 8, the 2008 initiative that amended the California Constitution to provide that only marriage between a man and a woman would be recognized by the state. In determining the initiative’s constitutionality, the court will follow the approach of Judge Vaughn Walker of the US District Court for the Northern District of California, subjecting Proposition 8 to analysis under the Due Process and Equal Protection Clauses of the Fourteenth Amendment of the US Constitution. These clauses will invite scrutiny of the validity of asserted governmental interests in confining marriage to opposite-sex couples. However, traditional constitutional analysis does not involve examination of US obligations under international human rights law. Neglecting to analyze these obligations removes a valuable reference favoring same-sex marriage recognition, bucking an increasing trend among foreign courts.

The principal obligations relevant to the issue of same-sex marriage are contained in the International Covenant on Civil and Political Rights (ICCPR). The US signed the ICCPR in 1977 and ratified it in 1992, subject to a number of reservations, understandings and declarations. Article 26 of the ICCPR provides that all persons are equal before the law and entitled to equal protection under it. In this respect, state parties must guarantee equal and effective protection against discrimination on a number of grounds, including sex, race and “other status.”

The Human Rights Committee is a body of independent experts charged with overseeing the implementation of the ICCPR by state parties, and it carries out this task in two ways. First, it periodically issues “general comments” that interpret the rights set out in the ICCPR. Second, it sits in a quasi-judicial capacity and makes non-binding recommendations in response to communications by nationals against those state parties that have acceded to the First Optional Protocol to the ICCPR.
