Prop 8 RepealAs the fight to repeal Proposition 8 on the November ballot begins, Love Honor Cherish has partnered with the NOH8 Campaign to create a public education campaign telling voters why marriage equality is important.

The partnership will launch at a party being organized by nonprofit group “Reason to Party” in San Francisco this Sunday, Jan. 22.

Can the court over turn Prop 8 or do we have to use the initiative process?

This really makes me feel uneasy. Prop 8′s literal day in court (in the Federal 9th circuit) was just a month ago and AFER’s arguments are powerful. If Prop8 is suddenly repealed by the public initiative process just like it was created, the Federal-level case instantly dissolves. A court win against Prop8 would be 100x stronger than just a simple majority initiative vote. Isn’t that what we hated about 2008: a proposition passing with under 4% majority dictating law? Propositions in CA are just a long, expensive “hail Mary” shot at an elusive basket that’s based on the whims of the public (who’s susceptible to negative/lying ads as we saw in 2008). I love public education on marriage but this entire approach ignores the very important Federal case that’s set to be ruled on literally any day now. ::sigh::

I think everyone agrees that if the 9th circuit rules in our favor AND LIFTS THE STAY there is no point to an initiative. But if the stay remains then there is no telling how many years this will take to get through the courts. And even then you will have the right wing whining about activist judges. I don’t have years to wait for this to happen. Let’s stand up for our rights now and show the courts and everyone else that public opinion is swinging in our favor.
