USA, New Mexico: GOP to Sue Dona Ana County Clerk Over Marriage Licenses

New Mexico State Senator William SharerTaking a page from the national GOP in the DOMA and Prop 8 cases, New Mexico republicans are preparing to sue stem the tide of marriage licenses for same sex couples. On Top Magazine reports:

State Senator William Sharer of Farmington told the AP that a lawsuit seeking a court order to stop Dona Ana County Clerk Lynn Ellins from issuing such licenses would be filed as earlier as this week. “It has to do with a county clerk cannot make law. That is the Legislature’s job,” said Sharer, a Republican who in 2011 sponsored a constitutional amendment to define marriage as a heterosexual union. Sharer said that more than two dozen GOP lawmakers had agreed to join the lawsuit.

“It has to do with a county clerk cannot make law.” Um, aren’t there some words missing in there?
