Lebanon: Judge Rules Gay Relations Don’t Contradict the Laws of Nature

A positive ruling for LGBT rights in Lebanon.

A transgender woman was accused by the state of having a same-sex relationship with a man. However, Judge Naji El Dahdah, of Jdeide Court, Beirut threw out the case on January 28, 2014. The woman on trial was born with an intersex condition but was assigned a male identity. However, after growing up feeling that she was female, she underwent gender reassignment surgery in the 1990s. Despite the surgery, she was still listed as a male on her identity papers, which led to Lebanese authorities believing she had breached Article 534 of Lebanon’s penal code, which criminalizes same-sex sexual intercourse and subsequently same-sex relationships. El Dahdah, however, rejected the case based on a previous ruling by Judge Mounir Suleiman in 2009.

One small step forward in a part of the world that usually sees very little progress on LGBT rights.

  1. Though the judge’s ruling is welcome, one wonders what the “laws of nature” are, how they are determined, and who determind them.

    At least this much may be said with certainty: by 1999, zoologists had observed homosexual activity in almost 1500 species (besides human beings) — from primates to gut worms — and documented them in detail for about 500 (see the entry “Homosexual behavior in animals” in Wikipedia, which needs to be updated).

    Obviously, gut worms, fruit flies, and bed bugs (to name just three kinds of creatures in which homosexual activity has been observed) do not have the intelligence to make choices about their sexual orientation and it is unlikely that gay gut worms, fruit flies, or bed bugs “recruit” straight members of their species and “convert” them to “the gay lifestyle.”

    Consequently, the gay-haters’ claims that homosexuality in humans is a choice (rather than a sexual orientation, which is beyond the control of humans) and that gays “recruit” straights and make them gay find no support in zoology.

    On the contrary, the findings of zoologists corroborate the consensus of medical people, including psychiatrists, that the sexual orientation of human beings is not the result of choice nor can it be changed.

  2. After reading the body of the article (when posting our comment below, we had read just the headline), we believe the headline to be inappropriate.

    The import of the judge’s ruling is not that homosexual relations are permissible but that the state should recognize the person’s current gender (despite what her certificate of birth says): she is now a woman. Therefore, her having sex with a male does violate the law.
