North Carolina may vote yes due to voters lack of understanding

Will gay marriage be stopped in North Carolina?

 If the numbers hold up, anti-gay marriage advocates will continue their near perfect record when it comes to the voting booth.

On Tuesday, North Carolina citizens will have an opportunity to decide on Amendment One. If passed, the legislation will ban the state from recognizing civil unions, strip away domestic partner benefits and could eliminate legal protections for all unmarried couples.

As reported by Public Policy Polling, 55 percent intend to vote yes  next Tuesday (8 May). Only 41 percent are opposed.

The pollsters argue that one of the reasons why the numbers are so lopsided is because voters do not understand how far reaching the legislation is. More than half, 55 percent, of Tarheel voters support some type of  legal recognition of gay relationships — from civil unions to marriage.

‘When we informed poll respondents the amendment banned both gay marriage and civil unions and then asked how they would vote, only 38 percent continued to support it with 46 percent opposed,’ the polling organization wrote.

NY: Anti Gay New York Senator Expelled From Legislature

Late on Tuesday, the New York state senate voted 53-8 to expel Senator Hiram Monserrate, convicted last year of attacking his girlfriend, slashing her face with glass, and dragging her through his apartment building.

As you may recall, Monserrate is a Democrat from Queens who voted against the marriage equality bill when it came up late last year.

The NYT: “…rather than bringing the issue to a close, the expulsion vote could be the beginning of a lengthy legal fight that could create further instability in Albany’s volatile political atmosphere. Mr. Monserrate said on Tuesday that he planned to run in the special election. Even as the Senate moved forward with the vote, Mr. Monserrate’s lawyers were drafting a temporary restraining order seeking to have him reinstated. One of the lawyers, Norman Siegel, said the order would be filed Wednesday in federal court in Manhattan.”

Prop 8 Trial Update, Day 7

It was a phenomenal day in the courtroom, in particular testimony from Ryan Kendall about forced conversion therapy that moved many to tears. We also heard surprising revelations from experts who were supposed to support Prop 8 but whose opinions instead clearly shored up our side. After today, I wish more than ever that the public could be watching the video of this trial – I have truly never seen anything like it. Fortunately, daily transcripts of the trial are now being released with a one day delay and are available on AFER’s website.

The morning began with an argument over whether the court should allow excerpts to be played from the depositions of two of the defense’s expert witnesses, Dr. Paul Nathanson and Dr. Katherine Young. Before trial, each side submitted a list of the witnesses they expected to call, and the Prop 8 proponents said they would call Dr. Nathanson and Dr. Young as experts. Both experts were deposed prior to trial, and their deposition testimony was recorded. Recently, however, the proponents withdrew both witnesses from testifying, suggesting that the experts had requested not to be called due to fears stemming from the proposed broadcasting of the trial. This morning, the plaintiffs asked to play some of those witnesses’ testimony, and the Prop 8 proponents objected. Judge Walker allowed the evidence in.

It was immediately clear why the Prop 8 proponents had really withdrawn these two expert witnesses — their testimony strongly supported the plaintiffs’ claims, not the defense. Indeed, many in the courtroom appeared to be shocked by how much the defense’s experts sounded like they should have been testifying for the plaintiffs. In particular, Dr. Young testified that: (1) homosexuality is a normal variant of human behavior; (2) there have been sub-traditions of allowing marriage between same-sex couples in a number of cultures; (3) allowing same-sex couples to marry enhances their security and well-being and is good for their children; and (4) studies show that there is no harm to children from being raised by gay parents and there is “no reason to predict harm.” Dr. Nathanson testified that, in the past, religion has been used to justify discrimination against people based on race and gender in the name of “protecting the family.” This testimony from the Prop 8 proponents’ own witnesses powerfully refutes the defendants’ claims.

IN: Senate Committee Sends Anti Gay Marriage Bill to Full Senate

Earlier this week I posted that Indiana was set to discuss a Senate Joint Resolution regarding marriage equality, SJR-13. Well that happened this morning and it’s not good news. The Senate Judiciary Committee passed it by a vote of 6 to 4. Which means that it is now eligible for consideration by the full Senate. Breaking Legislative News- Amendment to go to Full Senate: SJR-13 – Marriage Discrimination Amendment Moves to Full Senate

This morning, Wednesday, January 20, 2010, the Indiana Senate Judiciary Committee passed Senate Joint Resolution 13 (SJR-13) by a vote of 6 to 4. Approving the bill were Senators Bray, Zakas, Head, Holman, Schneider, and Steele. Voting no were Senators Lanane, Randolph, Taylor, and Broden. Senator Alting was not in the room for the vote. The Marriage Discrimination Amendment is now eligible for consideration by the full Senate.

HI: Anti Gay Protesters Rally Ahead of Civil Unions Vote

Social conservatives in Hawaii held a large rally Sunday at the State Capitol to protest a bill that would recognize gay couples with civil unions. The bill ran aground during last year’s legislative session after over 6,000 anti-gay protesters stormed the Capitol the Sunday before a key Senate committee vote. The bill deadlocked on a 3-3 vote in the Senate Judiciary Committee. The final tally came after a grueling 18 hour marathon hearing that ended at 3AM.

Six senators voted in favor of pulling the bill from committee and putting it up for a vote, but the effort fell short of the 9 votes needed to move the bill. A second effort just days before the end of the legislative session succeeded in retrieving the bill.

Senators quickly amended the bill to include both gay and straight couples but the session ended without a vote on the measure.
The amended bill needs the approval of both chambers of the Legislature to move to the governor’s desk. Previously, the House approved the original bill on a 33 to 17 vote.

DC: Anti Gay Marriage Lawsuit Dismissed

A District of Columbia Superior Court Judge has dismissed a lawsuit aimed at putting marriage equality in the District of Columbia to a vote. In September, a group led by an Anti- Gay Maryland preacher, Bishop Harry Jackson, had asked the D.C. Board of Elections and Ethics to approve a ballot measure establishing that “only marriage between a man and a woman is valid or recognized in the District of Columbia.”

However, finding that that such a referendum would violate the D.C. Human Rights Act by discriminating against gays and lesbians, the board decided to deny that request and Jackson sued, arguing that the Human Rights Act could not be used to stop citizens from putting ballot initiatives to a vote. Earlier this month Yesterday Thirty-nine Republican legislators, including 37 members of the House and two senators, also filed an amicus brief to Jackson’s lawsuit and were supporting a public vote on the issue.

Yesterday, Judge Judith N. Macaluso ruled in favor of a District motion asking the suit be dropped and agreed with Board of Elections and Ethics decision, saying the board’s action were justified because the initiative would in effect authorize and “ostracize a disfavored minority in violation of District of Columbia law.”

DC: Anti Gay Marriage Group Buying Metro Ads

First we learned that the newly passed DC gay marriage law is under attack by Congressman Jason Caffetz. Earlier today we learned about Bob King, who petitioned Congress to allow the issue to go to popular vote.

Now we’re hearing that Stand for Marriage DC, a group that opposes same-sex marriage in the nation’s capital has bought ads from the DC metro system.

In response, another group, Full Equality Now DC, has demanded the Washington Metropolitan Area Transit Authority (WMATA) remove the ads from metro buses. The group feels that it disrespects and discriminates against the LGBT community, an issue of indecency and in direct violation of WMATA’s own policy against discrimination.

Uganda: Canadian PM Tells Uganda to Nix Anti Gay Bill

Uganda’s president got an earful from Prime Minister Stephen Harper over the African nation’s proposed law targeting gays. The Ugandan “anti-homosexuality bill” would imprison and even execute homosexuals.

But the proposed law barely drew a mention at this weekend’s Commonwealth summit in Trinidad and Tobago — despite calls before the conference for the country’s suspension from the organization.

Harper said leaders generally don’t talk about specific laws during the Commonwealth meetings.

Anti Gay Blog Claims Gays Cost the Economy, Causes Furor at Purdue University

Bert Chapman knows that his reason for opposing what he calls “the homosexual lifestyle” — that it differs from his view of Biblical norms — won’t win many arguments these days in the secular world. So Chapman, a blogger who is also a librarian at Purdue University, turned to economics. And at his Conservative Librarian blog, he argues that gay people are an economic drain.

He cites the billions spent on fighting AIDS “without recognizing the morally aberrant sexual behavior … causing its spread” and the “sad practice” of colleges and other employers offering domestic partner benefits in a way that “prevents them from providing additional coverage to those of us adhering to traditional sexual moral standards”; he goes on to say that gay people are causing economic problems in fields such as real estate and divorce law.

“Guess who has to pay for these increased costs and potentially lower investment returns? We do, regardless of whether or not we approve of the homosexual lifestyle. The next time some one tells you how wonderful is the ‘progress’ gays have made in recent decades ask them if they have ever thought about the multiple economic consequences of this ‘progress’ as described in this posting,” he wrote.

US Diplomat Condemns Proposed Uganda Anti Gay Law

Diplomatic representatives from the USA and France are the latest to condemn a recently tabled anti-gay Bill in Uganda, which calls for the death penalty for “aggravated homosexuality”.

Humanitarian groups have called the legislation “appalling”. But there is deep concern about the number of religious figures inside and outside the country who have supported, condoned or failed to speak out on a measure which the US embassy in Kampala told news agency AFP yesterday (4 November 2009) “would mark a major setback in the promotion of human rights” if it became law.

“If adopted, a bill further criminalising homosexuality would constitute a significant step backwards for the protection of human rights in Uganda,” the embassy’s public affairs officer Joann Lockard declared.

“We urge states to take all necessary measures to ensure that sexual orientation or gender identity may under no circumstances be the basis for criminal penalties, in particular executions, arrests, or detention.”
