DC: Marriage Equality Opponents Go to Court For the Fourth Time, Are Denied Again

With Washington, D.C.’s same-sex marriage law expected to take effect on March 3, marriage equality opponents have stepped up their efforts to try to halt the law’s implementation by forcing a public referendum. Today, opponents went to court seeking a preliminary injunction, which would have stayed the effective date of the Religious Freedom and Civil Marriage Equality Act of 2009.

After hearing from both sides, Judge Holeman tentatively denied the motion from the bench, ruling that the court lacked the power “to usurp the legislative process,” that opponents did not establish a substantial likelihood of success on the merits and that they would not suffer irreparable harm if the law were to take effect as scheduled.

Judge Holeman’s ruling is the latest in legal setbacks for opponents of marriage equality in D.C., where for decades the law has presciently prohibited initiatives and referenda that cause discrimination under the Human Rights Act. Three times now the Board of Elections & Ethics has rejected proposed initiatives and referenda that would invalidate legislation overwhelmingly passed by the Council and signed by the mayor recognizing same-sex marriages. The courts have uniformly rejected opponents’ claims that they are being denied a right to vote and have upheld D.C.’s strong anti-discrimination protections.

NJ: Garden State Equality to Take Gay Marriage Back to Court in February

In spite of their recent set-back, LGBT activists in New Jersey continue to push forward with their efforts to extend marriage to same-sex couples The New Jersey State Senate voted 20-14 earlier this month against a bill that would have allowed gays and lesbians to marry in the Garden State. While many supporters left Trenton devastated, Steven Goldstein, chair and chief executive director of Garden State Equality, reiterated his vow to move forward.

“In no way is this back to the drawing board,” he told EDGE. “The community has moved seamlessly and so rapidly towards the next phase, which is winning marriage equality in court. In order to win in a court of law, we have to win in the court of public opinion.”

Goldstein’s organization continues to work alongside Lambda Legal to mount a legal challenge. The state Supreme Court ruled in 2006 it was unconstitutional to treat same-sex couples differently than their straight couples. Kevin Cathcart, executive director of Lambda Legal, hopes to have similar success in light of the state Senate’s vote.

European Human Rights Court to Hear Russia Gay Pride Case

The European Court of Human Rights has combined cases stemming from Moscow Mayor Yuri Luzhkov’s bans on gay-pride events in 2006, 2007 and 2008, and instructed Russian authorities to file a response by Jan. 20. “Our actions and pressure finally made them move,” said plaintiff Nikolai Alekseev. “It means that in one year we should have a decision.”

In February, Alekseev and others picketed the court demanding that the cases be prioritized. “This case is about a systematic denial of freedom of assembly for LGBT people in Russia since 2006,” Alekseev said. “But it goes beyond the LGBT borders and will help all human rights defenders and political groups as it will force Russia to change its law on demonstrations and public events.”

“We hope to have a decision before the fifth Moscow Pride scheduled for May 29, 2010,” he said. “Justice always comes, it’s only a matter of time.”

Russian Court Denies Lesbian Couple Marriage

A Russian lesbian couple have been barred from marrying by a court.

The Tverskoi District Court ruled that Irina Fedotova-Fet and Irina Shipitko cannot marry as Russia law states marriage is between a man and a woman.

The district court was upholding an earlier ruling by the city’s civil registry. The couple had tried to marry in May but had been turned away.
