US: Referendum 71 Signature Case Decision Due by Mid January

John Doe vs. Sam Reed could well determine once and for all whether Washington’s Public Records Act, which seeks transparency of all government records, violates the First Amendment rights of voters who sign ballot petitions. The high court will decide at a Jan. 15 meeting whether to accept or reject the case and then announce later that day — or the following Monday, Jan. 18 — if it will hear arguments.

If justices take the case, attorneys representing the state and Protect Marriage Washington, which brought the original lawsuit, will likely argue before the court in April, with a decision likely by the end of June.

If the Supreme Court decides not to hear it, a 9th U.S. Circuit Court of Appeals decision allowing release of the names will take effect, according to the Secretary of State’s Office.

Referendum 71 in Washington Continues Slim Lead

When Referendum 71 qualified for the ballot a few months ago, it made gay and lesbian couples uneasy.

The ballot measure was going to allow voters to decide whether same-sex partners would get many of the same rights as married couples. Post-election ballot tallies were putting their fears to rest, with their cause holding a slim but steady statewide edge on Wednesday.

“This is a historic vote,” said Joshua Friedes, campaign manager for Approve 71. “It is the first time that any state has affirmatively voted to protect gay and lesbian families with a system of comprehensive legal protections.”

Volusia County, Florida Councilman Wants to Pass Domestic Partner Ordinance

When hospitalized with illness or injury, you decide who can visit, have access to your medical information and make decisions for you if you become incapacitated. That is, if you’re conscious when you arrive.

But if you are so injured or sick you cannot speak and haven’t drawn up a document naming a health care surrogate, only your next of kin will be afforded those rights. For County Councilman Joshua Wagner, that’s not good enough. That’s because it means local unmarried couples — both gay and straight — could miss an important moment or be excluded from a decision that could change their lives forever, Wagner said. That could result because they lack a marriage certificate.

Russian Evangelicals Joining Forces with No on Referendum 71 in Washington

Among the protesters rallying against gay rights this weekend: Russian-speaking evangelicals.

“It’s important — a big issue,” said Aleksey Borisov, 24, a construction worker who drove all the way from Eastern Washington with several other members of Light of the Gospel, a Slavic Baptist church in Spokane, to participate. The rally was a visible demonstration of the increasingly active role that members of Russian-speaking conservative evangelical churches are playing in marriage and gay-rights issues, including the battle over Referendum 71.”

Washington Domestic Partnership Opponents Register New PAC to Funnel Money Into State

The scenario that gay-rights advocates had feared may be coming true.

Vote Reject R-71, a political action committee, registered with the state’s Public Disclosure Commission yesterday to campaign against Referendum 71, thereby attempting to repeal the state’s domestic-partnership law.

Dave Mortenson, a conservative campaign consultant who filed the PAC, says, “A bunch of individuals contacted me to see if we could raise some money really quick.” He says, “I am not going to share who I’ve been talking to, but if we do get the money, we will report it.” Are these religious groups, corporations, wealthy donors? “We are working them all,” says Mortenson.

13% Remain Undecided in Washington Referendum 71 Fight

A new KING5/SurveyUSA poll shows that next month’s vote on whether to uphold the state’s new “everything but marriage” same-sex domestic partner law will likely be close.

Referendum 71 was put on the ballot by people seeking to strike down the law passed by the Legislature this year. A “yes” vote keeps the law in place; a “no” vote strikes it down.

According to the survey:

–45 percent of likely voters say they are certain to approve R-71.
–42 percent say they are certain to reject it.
–13 percent are undecided.

Microsoft Donates $100k to Support Washington Domestic Partnership Law

The Microsoft corporation has demonstrated its continued commitment to gay rights even in the face of conservative backlash. The organization donated 100,000 dollars to approve referendum 71 in Washington state which would keep domestic partnership rights.

Seattle City Council Urges Approval of Ref 71, Domestic Partnerships

The Seattle City Council has approved a resolution urging voters to approve Referendum 71, the Washington State ballot measure that puts a gay-inclusive domestic partnership law up for a vote in November.

On Monday, lawmakers unanimously approved the resolution that backs the law dubbed the “everything but marriage” law by the media and passed it to Mayor Greg Nickels, a supporter of the law.

If passed, Referendum 71 would extend a 2007 domestic partnership law for a second time, granting gay and lesbian couples all the remaining state-provided rights, benefits and responsibilities of marriage.

Nevada Domestic Partner Law Takes Effect October 1st

Nevada officials say they are expecting 1,400 couples to apply for a gay-inclusive domestic partnership on Thursday, October 1, the first day the law goes into effect.

The state began accepting applications for domestic partnerships in late August.

“We have received nearly 700 registration forms,” Pam duPré, a spokesperson for Secretary of State Ross Miller, told On Top Magazine in an email. DuPré added that officials expect to hand out an additional 700 applications on Thursday.
