TX: AG Tries to Block Lesbian Couple's Divorce

Texas Attorney General Greg Abbott is arguing that divorce, like marriage, according to Texas law, is reserved solely for a man and a woman. A state district judge in Austin granted a divorce last week between Sabina Daly, of San Antonio, and Angelique Naylor, of Austin.

The two were married under Massachusetts law in 2004.

A day after the judge’s decision, Abbott filed a motion to block the divorce before it was entered into the official record. Abbott told the San Antonio Express-News that the marriage was not valid in Texas, and therefore neither is the divorce.

Gay/Lesbian Couples Married in Canada Tripped Up By 1 Year Residency Requirement for Divorce

The phrase “till death do us part” has taken on a very literal meaning for same-sex couples seeking to end their marriage. Many same-sex couples from the U.S. travel to Canada to get married, but what happens when the honeymoon’s over and forever is just too long? Couples who live in states that do not recognize same-sex marriage are also living in states that do not recognize same-sex divorce.

“It would be a nullity in law, because they don’t recognize [same-sex couples] to be married — so of course they won’t divorce them,” says barbara findlay, a B.C. lawyer whose practice focuses on human rights and family law. “In other words, if [the state] recognizes them [as married] for the purpose of divorce, they’d have to recognize them for the purpose of everything else and they don’t want to do that.”

But heading back to Canada to obtain a divorce is not as simple as it sounds. In Canada, the Divorce Act states that one of the spouses must have been “ordinarily resident in the province for at least one year immediately preceding the commencement of the proceeding.”

Man in Texas Gay Divorce Not "A Poster Child" for Gay Marriage

A Dallas man seeking a divorce from his male spouse in Texas appeared publicly for the first time Sunday, saying he is not “a poster child” for efforts to legalize gay marriages in Texas and other states.

The man, who identifies himself only as “J.B.,” said on ABC’s “Good Morning America Weekend” that his petition for a divorce from his spouse of three years was not intended to be a “test case” for expanding gay rights.

“This is not about gay and lesbian marriage,” he said.

The case drew attention after Dallas Judge Tena Callahan ruled Thursday that Texas’ 4-year-old ban against gay marriages is unconstitutional because it stands in the way of gay divorces.
