CA: Defense May Need Imperial County Involvement to Appeal Possible Prop 8 Court Loss

Last December 15, local marriage equality activist Fernando Lopez found himself involved in the marriage equality issue in an unexpected way when the Board of Supervisors in Imperial County voted 3-2 to intervene in Perry v. Schwarzenegger, the federal court challenge to California’s Proposition 8.

According to Lopez, the Alliance Defense Fund, one of the organizations involved first in passing Proposition 8 and then defending it in court, sought out Imperial County Board of Supervisors chair Wally Leimgruber and asked him to get the county involved in the case. Lopez said that the Alliance Defense Fund offered to pay all costs for the county if it agreed to intervene in the case on the side of upholding Proposition 8. Leimgruber told the ivpressonline.com Web site that the Board was acting in the interest of the more than 69% of country voters who supported Proposition 8, to “uphold what they voted on.”

“Wally’s up for re-election, and so with the conservative base there he took it up and brought it to the board,” Lopez recalled. “It actually wouldn’t have passed, but one of the seats there was just vacated by a progressive Democrat, and Governor Schwarzenegger appointed a Republican to fill his seat. So it passed on a 3-2 vote.”

CA: Too Late for Imperial County to Intervene in Prop 8 Case, Plaintiffs Argue

It’s too late for Imperial County to intervene in gay marriage litigation, claim plaintiffs opposing the county’s intervention filed in federal court. Lawyers for the plaintiffs filed the opposition Wednesday, according to court documents. They ask the court to deny the motion to intervene because the county has failed to satisfy the requirements to intervene in the case.

The county voted Dec. 15 to join the federal case involving Proposition 8, which made same-sex marriage illegal in California. The lawsuit, filed after Proposition 8 was passed in November 2008, claims the proposition is unconstitutional.

The county made a motion to intervene as defendants in the case, which would allow it to appeal should Proposition 8 be overturned, County Counsel Michael Rood said in a previous interview.

CA: Alliance Defense Fund Behind Surprise Imperial County Move in Prop 8 Lawsuit

While I live and work in San Diego, I hail from the Imperial Valley.



Very upset over the actions of my home county, I picked up the phone and eventually was able to have an hour long conversation with the Chair of the County Board of Supervisors, Wally Leimgruber, and the County Executive Officer, Ralph Cordova, who both attempted to assure me that their interest was in protecting the will of the voters in their county. In questioning how they were able to bring up the motion, the topic was avoided and I can only assume that it was then brought into their agenda as an “emergency item.” EMERGENCY?! REALLY?! It was quite transparent that the Chair was using this opportunity to appease the voters as he attempts to run for re-election.

Mr. Wally also informed me that he was approached by the Alliance Defense Fund (the anti-equality guys with money) to bring the issue to the board with the promise that they would pay all of the county’s expenses with regards to the case. This, I must mention, is a good sign for our side. Our opposition is so desperate for support that they sought out a small county to help add legitimacy to their case.

CA: County Wants to Join Prop 8 Defenders in Lawsuit

Imperial County officials want to join the sponsors of California’s gay marriage ban in defending Proposition 8 during an upcoming trial. The Imperial County Board of Supervisors voted in favor of an emergency motion Tuesday to intervene in the case. Supervisors say the county’s participation is needed because Attorney General Jerry Brown supports overturning the voter-approved measure, while Governor Arnold Schwarzenegger has taken a neutral position on it.

The case is scheduled to go to trial on Jan. 11. A final pretrial hearing is scheduled in San Francisco on Wednesday.

The papers filed by the county say that 70 percent of Imperial’s voters supported Proposition 8.
