OH: Lawsuit Against Cleveland Domestic Partner Registry Proceeding

Thursday, February 18th, 2010

Lambda Legal filed a friend-of-the-court brief today in support of the city of Cleveland in a lawsuit brought by an anti-gay group attempting to strip away the newly enacted domestic partnership registry for same-sex couples and their families. The brief was filed in the Court of Appeals of Ohio, Eighth Appellate District.

“To suggest to same-sex couples and their families that a domestic partnership registry somehow resembles marriage is preposterous. The domestic partnership law in Cleveland and the state constitutional amendment barring same-sex couples from marriage are not in conflict with each other,” said Christopher Clark, senior staff attorney in Lambda Legal’s Midwest Regional Office based in Chicago.

“We hope this court will rule as other courts across the country have ruled and dismiss this mean-spirited attack on same-sex couples and their families.”

OH: Cambridge Paper Rejects Gay Wedding Announcement

Friday, February 12th, 2010

A daily newspaper is refusing to publish the marriage announcement of a same-sex couple. While it is not the first time an Ohio newspaper has refused to honor gay and lesbian couples, this time the pair are legally married.

Bryon Humphrey-Elkins, 36, and Darrell Humphrey-Elkins, 23, were married in Connecticut on December 11. The couple lives in Columbus and wanted to run the announcement in their hometown newspaper in Cambridge, about 60 miles east, where both have family.

Bryon said his sister Tina Elkins called the Cambridge Daily Jeffersonian to place the announcement shortly after their wedding and spoke to the paper’s lifestyle editor, Pam Harmon. Harmon made arrangements with Elkins and asked for a photograph.

OH: Cleveland Adds Transgender to List of Protected Classes in Housing & Employment

Wednesday, December 2nd, 2009

Existing city codes prohibit businesses from denying jobs or housing to citizens for reasons of age, race, religion or sexual orientation. Activists in the lesbian, gay, bisexual and transgender community had lobbied for more than a year to include gender identity and expression.

The unanimous vote was the latest step the council has taken to demonstrate a more tolerant atmosphere — one that helped the city land the 2014 Gay Games, an international competition.

Councilman Joe Santiago introduced the ordinance last year, about the same time that the council began considering a domestic partner registry that allows same- and opposite-sex couples to declare a relationship without marriage.

OH: Two Counties add Sexual Orientation and Gender Identity to Anti Discrimination Laws

Wednesday, December 2nd, 2009

Discrimination in Akron and Summit County based on sexual orientation or gender identity is now illegal — sort of. Both Akron and Summit County councils passed ordinances Monday that added these to their protected classes.

But Akron City Council — after nearly an hourlong debate — carved out exemptions for contractors with the city who either serve minors or are religion-based.

City Council approved the amended ordinance 10-2, with councilmen Mike Freeman and Jim Hurley, both of whom voiced religious concerns, as the ”no” votes.

Analyses of Four States Reviewing their Anti Gay Marriage Laws

Friday, November 20th, 2009

The marriage equality drumbeat has rumbled on with news that several states will be attempting to re-examine their state constitutional amendments banning same-sex marriage and/or civil unions. Surprisingly, this hasn’t received as much attention as I assumed it would in the LGBT blogosphere.

Ohio state representative Tyrone K. Yates (D-Cincinnati), Kentucky state representative Mary Lou Marzian (D-Jefferson), and Michigan House Speaker Pro Tem Pam Byrnes (D-Washtenaw County) have all introduced legislation to repeal their state’s respective marriage amendments.

Texas Attorney General candidate Barbara Radnofsky, however, has discovered that the state’s amendment also inadvertently “eliminates marriage in Texas,” including common-law marriages. A Texas judge ruled the state’s amendment was unconstitutional last month.

Cleveland, Tampa Considering Transgender Protection Bills

Friday, November 13th, 2009

More cities are considering adding transgender protections in the wake of a critical vote in Kalamazoo, Michigan.

In Cleveland, gay rights group Ask Cleveland is lobbying to win approval of such a measure. The group delivered more than 2,500 postcards supporting an expanded law to council members on Monday. The bill is sponsored by openly gay, outgoing Council member Joe Santiago.

In Tampa, Florida, passage appears more certain, but opponents have only just begun to mobilize. A November 5 first reading of a transgender protections bill won unanimous approval after Council member Joseph Caetano altered his original no vote. Final passage is expected during a November 19th meeting.
