CA: New Law Recognizes Gay Marriage From Out of State… Sort Of

SB54 specifies that same sex marriages are recognized in California. The marriages must meet one of two qualifications: a) they must have been entered into legally during the period of time when California offered gay marriage; b) they must have taken place before 11-05-2008 in a state that legally performs same sex marriage.

Additionally, any gay marriage taking place after that date in a state that legally performs it will also be recognized in California – affording the brides or grooms all the rights and responsibilities that come with a marriage — but the union will not legally be designated as “marriage.”

NY Supreme Court to Hear Case on Out of State Gay Marriage Recognition Today

New York’s top court is set to hear arguments against providing government benefits to same sex couples married in Canada or other jurisdictions where such marriages are legal.

The state Department of Civil Service extended health insurance benefits to those spouses of state and local government workers in 2007. A year earlier, Westchester County agencies granted similar recognition and benefits.

The Court of Appeals will hear oral arguments Tuesday by the Alliance Defense Fund of Scottsdale, Ariz., contending those benefits are unlawful in New York, which does not permit same-sex marriages.

California Governor Schwarzenegger Signs Harvey Milk, Gay Marriage Recognition Bills

Gov. Arnold Schwarzenegger has signed two gay rights bills, one honoring late activist Harvey Milk and another recognizing same-sex marriages performed in other states.

In the last of hundreds of bill actions taken before midnight Sunday, Schwarzenegger approved the two bills by Sen. Mark Leno, D-San Francisco.

The governor last year vetoed the measure declaring May 22 a state day of recognition for Milk, suggesting that the former San Francisco supervisor be honored locally. But he subsequently named him to the California Hall of Fame.
