WI: Supreme Court Ruling Expected This Week on Gay Marriage Ban

The Wisconsin Supreme Court is expected to rule this week on whether the 2006 constitutional amendment banning gay marriage and civil unions is valid. The court is expected to decide Wednesday whether the amendment was properly put to voters.

A lawsuit claims the measure violated the constitution by asking two questions at the same time: whether to limit marriage to one man and one woman, and whether to outlaw any similar legal status for unmarried individuals. The constitution says ballot questions should be limited to a single subject.

A Dane County judge ruled in 2008 the question was valid. A ruling striking down the amendment would not legalize gay marriage because state law already defines marriage as a union between a husband and wife.

DC: Gay Marriage Foes Ask Supreme Court for Emergency Injunction

The Associated Press is reporting that foes of a DC gay marriage law set to take effect Wednesday are asking the Supreme Court to halt its start. The challenge was filed with Chief Justice John Roberts on Monday. Opponents say the law should be put up for a vote.

The government of DC approved the law in December, but has been defending gay marriage since it approved a law last spring that recognizes the marriages of gay and lesbian couples from other states.

A last-minute appeal to the District of Columbia Appeals Court, which was rejected Friday, left opponents with few legal options to head off the law from going into effect.

India: 16 Groups Petitioning Supreme Court to Reinstate Anti Gay Law

Using fresh arguments that range from imperiling India’s defence to making its people delusional, 14 new organisations have joined the final legal battle against the decriminalisation of homosexuality. On Saturday, the number of petitioners in the Supreme Court – challenging the July 2009 decision of the Delhi High Court to strike down an anti-sodomy law – stood at 16 from the original two.

Two Christian church coalitions, three Muslim NGOs, two Hindu astrologers, a disciple of yoga guru Baba Ramdev, an NGO run by a former Delhi police officer, and an environmentalist, will be among those in the Supreme Court when it hears an appeal next month against the overturning of the Indian Penal Code’ section 377.

Only one person, film director and Rajya Sabha MP Shyam Benegal, has quietly joined the original petitioner, Delhi NGO Naz Foundation, in support of gay rights in the Supreme Court. With the government saying it will not oppose the Delhi High Court judgement, which experts consider legally strong, the new opponents are readying a range of fresh arguments:

· “Medical opinion” that only the vagina has the muscles required for sex, not the anus (Utkal Christian Foundation, Cuttack)

· Expanding the constitutional right to non-discrimination to include sexual orientation could lead to demands for job reservations (Apostolic Churches Alliance, Thiruvananthapuram)

Mexico: Supreme Court Upholds Mexico City's Marriage Equality Law

Mexico’s Supreme Court on Friday rejected three out of five challenges to Mexico City’s gay marriage law, El Universal reported. The court said the challenges brought by the governors of three states controlled by the conservative PAN Party were “clearly inappropriate.”

The decision, written by Minister Sergio Valls, said the states did not have the legal authority to challenge the laws of another state or the nation’s federal district of Mexico City. The court’s ruling applies to lawsuits submitted by the states of Morelos, Guanajuato and Tlaxcala.

The law – approved in December and expected to take effect on March 4 – is a first for Latin America. It gives gay and lesbian couples all the rights and responsibilities of marriage, including the right to adopt children. Previously, the city government recognized gay couples with civil unions, but gay adoption was banned.

New Poll: 52% Think Supreme Court Will Rule Against Gay Marriage

Most Americans predict the U.S. Supreme Court will eventually define marriage as a union between a man and a woman, a national poll indicated Thursday. And most Americans would prefer the court to rule that way, the Angus Reid Public Opinion poll found.

The online survey of a representative national sampling of 1,000 U.S. adults indicated 52 percent believe the justices will define marriage as a heterosexual union, while 28 percent think the court will define marriage federally as a union between two people, regardless of gender.

Fifty-eight percent want the court to define marriage as heterosexual only, while 34 percent would like no gender limitations, the survey found. Slightly more than a third, or 34 percent, say couples of the same sex should be allowed to marry, while 26 percent say they should only be allowed to form civil unions.

India: Sodomy Ruling From Supreme Court Due Next Month

The Indian Supreme Court is expected to give a final ruling on repealing the ban on gay sex next month. Last year, the Delhi High Court ruled that the colonial-era law was unconstitutional. Although this decision applied only to the jurisdiction of Delhi, gay rights campaigners hope it will persuade other areas to follow suit.

Today, a Channel 4 News Online report suggested that along with legislative change, attitudes to homosexuality in the capital were slowly becoming more positive, with gay Bollywood storylines and even a gay pride shop.

However, the importance of marriage in society means that many gay men are still expected to marry women.

US: Supreme Court To Hear Referendum 71 Signature Case, Likely in April

The U.S. Supreme Court will decide whether the names of Washington voters who sign a petition to put a law on the ballot can be made public. The high court could hear the case of Doe v. Reed as early as April, taking up the fight over the names and addresses of people who signed petitions to put Referendum 71 on last year’s November ballot.

That referendum sought to overturn expanded rights for same-sex and elderly heterosexual couples. Supporters of gay rights filed a public records request for the names of everyone who signed the petitions; referendum sponsors objected, saying they feared the signers would be harassed.

A few hours after the nation’s high court announced it was adding the case to its schedule, a state legislative committee considered dueling bills spawned by the dispute. One would provide an exemption to the state’s Public Records Act for the names and addresses on initiative or referendum petitions; the other would state categorically that they are public records.

CA: Prop 8 Supporters Appeal Trial You Tube Posting to Supreme Court

Reporting from Washington – The lawyers defending California’s Proposition 8 and its ban on same-sex marriage urged the U.S. Supreme Court on Saturday to block video coverage of this week’s trial in San Francisco.

The attorneys filed an emergency appeal with Justice Anthony M. Kennedy and argued that their client’s right to a fair trial would be jeopardized if each day’s proceedings were posted on YouTube.com.

The trial “has the potential to become a media circus,” wrote attorney Charles Cooper. “The record is already replete with evidence showing that any publicizing of support for Prop. 8 has inevitably led to harassment, economic reprisal, threats and even physical violence. In this atmosphere, witnesses are understandably quite distressed at the prospect of their testimony being broadcast worldwide on YouTube.” Kennedy asked the state to respond by noon today.

NJ: Marriage Equality Groups to Petition Supreme Court

Gay rights activists failed in their attempt to have New Jersey become the sixth state to legalize gay marriage when a bill fell far short of passage Thursday in the state Senate. By a 20-14 vote, the Senate rejected the measure, despite a 100-minute debate dominated by legislators urging its passage and the presence of hundreds of gay rights activists.

Five state senators did not vote on the measure, including Sen. Stephen M. Sweeney, D-Camden, who is expected to be named the Senate president later this month, and Sen. James Beach, D-Camden. Sen. Andrew R. Ciesla, R-Ocean, was absent. Sen. Bill Baroni Jr., R-Mercer, was the only one of the upper house’s 17 Republicans to vote for the legislation.

After the vote, gay rights activists vowed to go to the state Supreme Court, where they planned to argue that the state’s civil union law has failed to provide equal rights and that the current law is a violation of the freedom of religion for those denominations that recognize homosexual marriage.

US: Referendum 71 Signature Case Decision Due by Mid January

John Doe vs. Sam Reed could well determine once and for all whether Washington’s Public Records Act, which seeks transparency of all government records, violates the First Amendment rights of voters who sign ballot petitions. The high court will decide at a Jan. 15 meeting whether to accept or reject the case and then announce later that day — or the following Monday, Jan. 18 — if it will hear arguments.

If justices take the case, attorneys representing the state and Protect Marriage Washington, which brought the original lawsuit, will likely argue before the court in April, with a decision likely by the end of June.

If the Supreme Court decides not to hear it, a 9th U.S. Circuit Court of Appeals decision allowing release of the names will take effect, according to the Secretary of State’s Office.
