Nate Silver on What Happened Last Night on Gay Marriage, Gay Rights

Wednesday, November 4th, 2009

Maine — Question 1. Maine votes Yes on Question 1 — which means no on gay marriage — by a margin of about 52-48. Turnout was extremely high and should eventually surpass 500,000 voters, about where it was during the 2006 midterms. This fact was initially thought to favor the pro-gay marriage side — but, obviously, it didn’t. The results showed a very strong urban-rural divide, with the initiative being rejected by a margin of about 2:1 in Portland but racking up big margins in smaller towns and rural areas, especially in the north of the state.

We had given Question 1 about a 70 percent chance of being defeated based on a combination of an analysis of the polling and a statistical model. I don’t know how much time I’m supposed to spend defending being on the wrong side of a 70:30 bet — we build in a hedge for a reason — but here comes a little self-reflection. As for the polling, I think we have to seriously consider whether there is some sort of a Bradley Effect in the polling on gay rights issues, although one of the pollsters (PPP, which had a very bad night in NY-23) got it exactly right.

As for the model, I think I’ll need to look whether the urban-rural divide is a significant factor in a state in addition to its religiosity: Maine is secular, but rural. At the end of the day, it may have been too much to ask of a state to vote to approve gay marriage in an election where gay marriage itself was the headline issue on the ballot. Although the enthusiasm gap is very probably narrowing, feelings about gay marriage have traditionally been much stronger on the right than the left, and that’s what gets people up off the couch in off-year elections.

Gay Activists to Ask DC Council to Keep Domestic Partnerships When Gay Marriage Legalized

Friday, October 23rd, 2009

At least three prominent LGBT activists are planning to ask a D.C. City Council committee to remove from gay Council member David Catania’s same-sex marriage bill a provision that would end city recognition of new domestic partnerships after January 2011.

The local activists, who are strong supporters of same-sex marriage, believe the city’s domestic partnership law should remain in place at least until it becomes certain that Catania’s same-sex marriage bill will survive any attempts by members of Congress to block or overturn it.

Some activists additionally believe that domestic partnerships should continue as an option for same-sex couples even if marriage emerges as a permanent part of D.C. law.

White House Issues Statement Supporting R71 in Washington, Opposing Q1 in Maine

Saturday, October 17th, 2009

In response to a question posed by The Advocate magazine, the White House has thrown its support behind two of the three major gay-rights ballot initiatives voters will face on November 3 – Maine’s up-or-down vote on upholding same-sex marriage, and Washington state’s up-or-down vote on domestic partnerships.

But there was no mention of Kalamazoo’s anti-discrimination ordinance right here in Michigan.

Unlike the Maine and Washington state measures, Kalamazoo’s isn’t about partner rights and benefits, but rather outlawing discrimination in employment, housing and public accommodations on the basis of sexual orientation or gender identity.

Federal Appeals Court Says Referendum 71 Signatures Must Be Released

Friday, October 16th, 2009

Protect Marriage Washington, which collected the signatures to get Referendum 71 on the November ballot, said it will appeal Thursday’s federal appeals-court ruling that cleared the way for public release of the names of those who signed petitions for the measure.

“That particular group of judges saw the law one way; we’ll take it to the next group of judges that may have the opportunity to see it the correct way,” said Stephen Pidgeon, attorney for the conservative religious organization.

Referendum 71 will ask voters to approve or reject the Legislature’s latest expansion of the state’s domestic-partnership law, which grants marriage-like benefits to gay and some senior couples.

"Christians" Behind Referendum 71 in Washington Have Checkered Marriage, Tax Pasts

Thursday, October 15th, 2009

With no real plan, a scattered base and well-heeled opponents, two political activists many people have never heard of are scoring unexpected victories in a campaign to roll back domestic-partnership benefits for gay couples in Washington state.

Facing resistance even from within their own ranks, they’ve landed wins in state and federal courts, and were triumphant where it mattered most: a contentious signature count in the Secretary of State’s Office that ultimately credited them with enough valid signatures to get Referendum 71 onto the Nov. 3 ballot.

Larry Stickney, campaign manager for Protect Marriage Washington, and Gary Randall, his philosophical soul mate, see the tightly contested battle as one not about pension rights and sick leave but as their last chance to protect traditional marriage in Washington.

Washington Domestic Partnership Opponents Register New PAC to Funnel Money Into State

Saturday, October 10th, 2009

The scenario that gay-rights advocates had feared may be coming true.

Vote Reject R-71, a political action committee, registered with the state’s Public Disclosure Commission yesterday to campaign against Referendum 71, thereby attempting to repeal the state’s domestic-partnership law.

Dave Mortenson, a conservative campaign consultant who filed the PAC, says, “A bunch of individuals contacted me to see if we could raise some money really quick.” He says, “I am not going to share who I’ve been talking to, but if we do get the money, we will report it.” Are these religious groups, corporations, wealthy donors? “We are working them all,” says Mortenson.

Utah'sRep Jeff Chaffetz Wants House to Vote Against DC Gay Marriage Bill

Wednesday, October 7th, 2009

U.S. House and Senate Democratic leaders are afraid to take a vote over same-sex marriages in Washington, D.C., says Rep. Jason Chaffetz, R-Utah.

Chaffetz, although only a freshman, is the ranking Republican on the House subcommittee overseeing District of Columbia issues. The Washington Post reported Tuesday that there are enough votes on the district council to pass a same-sex marriage bill in the district.

As the creator and overseer of the district, Congress has 30 days after any new district law is passed to overturn the measure. But congressional Democrats are afraid to take that vote, Chaffetz said. Republicans and conservative Democrats “would like to try to stop” a same-sex marriage law in the district, Chaffetz said. “And we should take a vote on it.
