Wisconsin Supreme Court Throws Out Challenge to State's Domestic Partnership Law

Wisconsin’s Supreme Court has thrown out a legal challenge to the state’s domestic partnerships law.

The law came into force on August 3rd, making Wisconsin the first mid-western state to pass such a law through legislation. Iowa allowed gay marriage earlier this year through a court ruling.

The court has not given any reason for rejecting the case, leading gay rights opponents to believe they may successfully refile their challenge in a lower court.

Wisconsin Asks State Supreme Court to Reject Challenge to Domestic Partnership Registry

Lawyers representing Gov. Jim Doyle, a gay rights group and several gay couples have asked the Wisconsin Supreme Court to reject a challenge to the state’s new domestic partnership registry.

Members of a social conservative group filed a lawsuit in July claiming the registry violates the constitutional ban on gay marriage and civil unions approved by voters in 2006. They asked the Supreme Court to take the case immediately, bypassing trial and appeals courts, because of its statewide significance.

The Supreme Court is considering whether to take the case and had ordered the state to respond by Tuesday. At least four justices have to agree to do so.

Wisconsin Gay Rights Group Hires Private Attorney to Defend Domestic Partner Law

A Wisconsin gay rights group has hired a national attorney to challenge a lawsuit aimed at striking down domestic partnership benefits enacted in the most recent state budget.

The group Wisconsin Family Action filed suit in July challenging the constitutionality of the state’s new Domestic Partnership Registry. Getting one’s name on the registry grants you the right to visit a partner in the hospital, help make end of life decisions and inherit assets when a partner dies.

Christopher Clark of the Lambda Legal Defense Fund has filed a brief on behalf of FAIR Wisconsin asking the State Supreme Court to reject the case.

Lambda Legal, Fair Wisconsin Submit Briefs in Defense of Wisconsin Domestic Partner Law

Gay rights groups have urged the Wisconsin Supreme Court to reject a challenge to the state’s gay-inclusive domestic partnership registry, Wisconsin Radio Network reported.

The group Wisconsin Family Action (WFA) and the Christian-based Alliance Defense Fund (ADF) have asked the state Supreme Court to strike down the law, arguing that it is prohibited by the state’s constitutional ban on gay marriage approved by voters in 2006. WFA supported the passage of the anti-gay marriage amendment as the Family Research Institute.

Despite being challenged, the law that gives gay and lesbian couples access to 43 rights, most of which center around estate planning and hospital visitation issues, took effect last month.
