TN: Attorney Says New Anti Gay Law Blocks Bullying Protections in Schools

A lawsuit filed in Nashville challenging a new state law says the legislation voids school board policies that protect gay and lesbian students from bullying and harassment, but the law’s sponsor disagrees.

The law prohibits local governments from creating anti-discrimination regulations that are stricter than the state’s and repealed a Nashville city ordinance barring companies that discriminate against gays and lesbians from doing business with the city. Nashville’s ordinance was broader than the state’s anti-discrimination laws, which only cover race, creed, color, religion, sex, age or national origin.

Attorney Abby Rubenfeld, who represents three Nashville councilmember and other residents of the city in the lawsuit, filed the lawsuit last Monday after the bill was signed into law in May. She said the text of the statute is written broadly enough that it could render invalid anti-bullying and harassment policies enacted by school boards that include sexual orientation or gender identity.

TN: Gay Groups to File Lawsuit Over Anti Gay Law

Gay legal activists are already working on a legal challenge to a new state law in Tennessee, signed into law Monday by Republican Governor Bill Haslam, which prevents local governments from requiring their contractors to abide by local human rights ordinances.

The legislation, entitled the “Equal Access to Intrastate Commerce Act,” was aimed at undermining a new Nashville metro area ordinance, signed into law in April. The ordinance prohibited city contractors from discriminating based on sexual orientation and gender identity. It was passed by the Nashville/Davidson County Metro Council.

Abby Rubenfeld, a Nashville attorney and a former legal director of Lambda Legal Defense and Education Fund, said Tuesday that the new state law will “definitely be challenged–we are working on it right now.”

TN: Governor Signs Anti Gay Bill Repealing Nashville’s Gay Rights Ordinance

The TN Chamber of Commerce, once of the forces behind anti-gay and anti-trans legislation that repeals a gay/trans civil rights ordinance in Nashville, and bans Tennessee cities from passing any civil rights legislation ever again, has just switched gears and is now opposing the bill.

Unfortunately, the Republican governor just signed the law.

Here is the Chamber’s statement:

“The Tennessee Chamber supports a standard regulatory environment at the state level as opposed to potentially conflicting local regulations covering employment practices. That principle was the only interest the Chamber had in this bill. Because HB600/SB632 has turned into a debate on diversity and inclusiveness–principles which we support–we are now officially opposing this legislation in its present form.”

TN: United Health Comes Out Against Gay Marriage Ban

I’m beginning to wonder just who did support this legislation, since the Tennessee Chamber of Commerce very much supported the legislation and very much lobbied for it. And UnitedHealth is on the chamber’s board. I’ve never seen so many board members so allegedly clueless about their own organization is doing. Here’s UnitedHealth’s statement:

TN: Nissan Clarifies Stance on Anti Gay Bill, Sort Of

Nissan in TennesseeThe dam has burst. Companies are now lining up to explain their involvement in the hateful repeal of Nashville’s civil rights ordinance. We’ve received confusing statements from both FedEx and AT&T, and now we’ve received a contradictory statement from Nissan, which chairs the board of the organization that repealed the gay/trans civil rights bill.

The following statement is being issued in response to your recent blog posts concerning HB600/SB632 here in Tennessee. You may attribute this directly to me:

TN: Alcoa Comes Out Against Anti Gay Bill

Alcoa in TennesseeFinally some courage. Alcoa is the only company so far to say explicitly that they oppose the Tennessee legislation that would repeal Nashville’s civil rights ordinance, and that they want the Governor to veto the bill.

Alcoa: “Alcoa provides equal employment opportunity without discrimination and supports state and local legislation protecting the rights of all community members. We do not agree with the chamber on this issue and would ask that the governor veto the bill.”

Beautiful statement. Simple, clear, to the point. No semantic games, no trying to have it both ways.

TN: Big Corporations Played Large Role in Passage of Anti Gay Bill

Anti Gay Bill in TennesseeThe Tennessee Chamber of Commerce – chaired by Nissan, and whose other board members include such companies as FedEx, AT&T, Comcast, DuPont, Pfizer, Blue Cross Blue Shield, Caterpillar, KPMG, Whirlpool, Embraer, Alcoa, and United HealthCare – actively lobbied for a religious right bill in the Tennessee legislature that would rescind Nashville’s civil rights protections for its gay and trans citizens, and which bans every city in Tennessee from passing any civil rights laws, for anyone, ever again.

The bill passed yesterday. It’s on its way to the state’s Republican governor for his signature, unless he vetoes it.

And these companies led the way in making it happen. And let me reiterate, these companies aren’t just members of the Tennessee Chamber of Commerce. These compares are all on the board of directors of the Tennessee Chamber of Commerce. They run the TN Chamber.

MT: Senate Committee Passes Anti Gay Rights Bill

The Senate Local Government Committee has backing a proposal to overturn a Missoula city ordinance that protects gay people from discrimination.

House Bill 516 has already passed the House will go to the Senate floor next. Lawmakers spoke heatedly for and against the measure Friday before the committee’s approval.

Supporters believe Missoula’s ordinance is unconstitutional because it goes beyond a city’s local authority.

MT: Senate Holds Hearings on Anti Gay Bill

People lined up to testify in a Senate hearing against a proposal to overturn a Missoula city ordinance that protects gay people from discrimination.

House Bill 516′s sponsor, Republican Rep. Kristin Hansen, says Missoula’s ordinance is unconstitutional because it goes beyond a city’s local authority.

Other supporters said Monday the measure protects businesses from expensive and unnecessary lawsuits that are bad for business.

KS: Anti Gay Bill Tabled in Committee

Kansas State CapitolWell, that was quick. It seems that lots of people were displeased about Kansas House Bill 2260. You know, the bill that says you can hate on gay and trans people all you want, as long as you do it in the name of God.

This is amazing news, and, to be honest, was a little unexpected. According to the Kansas Equality Coalition, there was no debate on the bill. Once it came up in committee, there was an immediate motion to table the legislation. And it wasn’t even close! The motion passed by either a 12-8 or 13-7 majority (KEC says the vote happened so quickly that it was hard to count). Wowza!

Technically, the bill is only tabled, so it could come up again in this legislative session, but since the session is about half over at this point, it’s unlikely to be picked back up again this year.
