NY: Attorney General Asks Court to Toss Out Anti Marriage Equality Lawsuit

Friday, September 16th, 2011

New York Gay Marriage LawsuitNew York’s attorney general asked a state court on Friday to throw out a lawsuit challenging the gay marriage law signed by Gov. Andrew Cuomo in June.

New Yorkers for Constitutional Freedoms and several other opponents of the law sued on July 25, claiming in part that the law should be nullified because the state Senate violated its own rules and the state’s open meetings law before the critical vote that led to its narrow passage.

Attorney General Eric Schneiderman argued in papers filed Friday that the opponents haven’t been harmed by the law, don’t have standing to challenge the actions of the Senate and any procedural actions of the Senate and governor aren’t subject to judicial review. He has asked for a hearing on Oct. 17 at the Livingston County Courthouse.

Anti Marriage Equality Groups Try to Keep Prop 8 Hearing Hidden

Friday, August 26th, 2011

Prop 8On Monday Federal District Judge James Ware will hear arguments on whether to release video tapes recorded during Perry v. Schwarzenegger, the case that struck down Proposition 8 as unconstitutional in August 2010. Yesterday, the court released a statement stating that the hearing will not be taped because anti-equality advocates would not consent.

In response, Equality California Executive Director Roland Palencia released the following statement: “The Proponents of Prop 8 are not only trying to keep the trial tapes under wraps, but also do not want the public to see the arguments they will be making at Monday’s hearing. This lack of transparency makes clear that what anti-LGBT extremists fear most is an open examination by the public of their malicious lies and fallacious arguments.

“Unfortunately, their tactics are not confined to the courtroom. The same shadowy strategy is at work right now as these same people collect signatures to overturn the FAIR Education Act.

US: Is There Reason to Worry About An Anti Gay Marriage Amendment?

Saturday, August 13th, 2011

I would forgive the majority of So So Gay’s readers for answering this question with a simple ‘no’. If the USA decides to insert a ban on same-sex marriage into its Constitution – its centremost document of government – most LGBT people in Britain would not be affected beyond feeling sympathy for their fellows across the Atlantic. It would be a pity, but a distant one.

It’s a question that has personal resonance for me, however: a naturalised citizen of the UK but an American also; my family all live in the States, and I may want to again as well some day.

For me, and for our US readers, the possibility of a constitutional amendment defining marriage as existing solely between one man and one woman is a threat to our equality and future happiness. The threat has grown more real recently, with support for such an amendment being pledged by Mitt Romney, the former governor of Massachusetts and current frontrunner to challenge Barack Obama in the 2012 presidential election.

Scotland: Anti Marriage Equality Motion Draws Controversy

Friday, August 5th, 2011

Perth and North Perthshire MP Pete Wishart took the unusual step of criticising politicians from his own party as controversy over same-sex marriage raged at Holyrood.

The row was sparked after Glasgow Shettleston MSP John Mason lodged a parliamentary motion pointing out that, “While some in society approve of same-sex sexual relationships, others do not agree with them.”

But the most controversial passage of the motion, lodged ahead of a Scottish Government consultation on legalising same-sex marriages, said, “No person or organisation should be forced to be involved in or to approve of same-sex marriages.” His comments were immediately criticised by opposition MSPs, with the motion branded “bizarre” and “spurious.”

IA: Bachmann Signs Anti Gay Pledge

Friday, July 8th, 2011

Michelle Bachmann Signs Anti Gay PledgeWell, that was fast.

Iowa conservatives yesterday asked Republican presidential candidates to sign a pledge that opposes marriage equality, Sharia law and bans pornography. None of those stipulations are that controversial — not for conservatives, at least.

The document, however, also contends that homosexuality is a choice, rather than a biological trait. I honestly thought, or at least hoped, candidates would be hesitant to back such an inflammatory declaration.

IA: Anti Marriage Equality Rally Planned for Tuesday in Des Moines

Thursday, March 10th, 2011

Iowans who want a vote on banning gay marriage will rally at the Iowa Capitol on Tuesday. The marriage rally is set for 11:30 a.m. on the west steps of the building, according to Bob Vander Plaats of the Family Leader, a social conservative advocacy group.

One guest will be Roy Moore, the chief justice of the Alabama Supreme Court who defied an order from a federal judge to remove a monument of the Ten Commandments from the inside the state’s judicial building. Alabama’s court of the judiciary unanimously removed Moore in 2003 for placing himself above the law.

Moore, a Republican who believes that God is the sovereign source of the country’s laws, has visited Iowa several times in recent months, making appearances with U.S. Rep. Steve King, R-Iowa, and state Sen. Kent Sorenson, R-Indianola.
