NY: O’Donnell Introduces Marriage Equality Bill in Assembly

Daniel O'DonnellOpenly gay New York state Representative Daniel O’Donnell on Tuesday introduced a gay marriage bill in the Assembly.

O’Donnell, a Democrat from Manhattan, has successfully shepherded the bill through the chamber three times since 2007.

“It is with great pride that I am introducing the Marriage EqualityAct,” O’Donnell said in a statement. “Since the Assembly last passed the bill in 2009, there has been an overwhelming groundswell of support for marriage equality across our state. Recent poll numbers have shown a strong majority of New Yorkers now stand firmly in support of marriage equality.”

NV: Three Republicans Cross Party Lines to Support Marriage Equality

Members of the transgender community chalked up a victory Monday when the Nevada Assembly approved a bill to protect them from employment discrimination. Democratic lawmakers, with limited Republican support, approved the bill to add “gender identity or expression” to a list of characteristics employers may not discriminate against.

“Voting for this bill is voting against discrimination,” said Las Vegas Democratic Assemblyman Paul Aizley, who sponsored the legislation.

State law already prohibits employers from singling out job candidates based on race, religion, sexual orientation and other attributes. But transgender people told lawmakers that they are left out of those categories and suffer higher unemployment than the general population.

IL: House Approves Civil Unions Bill

Illinois Civil UnionsIllinois took a major step Tuesday night toward allowing civil unions for same-sex couples, a sign that gay rights keeps gaining momentum inside a Capitol where it languished for decades.

As onlookers broke out into cheers, the House for the first time ever approved civil unions, with one vote to spare. Supporters expect the Senate to follow suit Wednesday, and Democratic Gov. Pat Quinn campaigned this fall on a pledge to sign it into law.

“We have a chance here, as leaders have had in previous generations, to correct injustice and to move us down the path toward liberty,” said sponsoring Rep. Greg Harris, D-Chicago, one of two openly gay lawmakers, his voice breaking with emotion. “It’s a matter of fairness, it’s a matter of respect, it’s a matter of equality.”

Prop 8 Author Loses State Assembly Race

A couple weeks ago, Chris Moore, the President of the Stonewall Democratic Club of Greater Sacramento, sent us an update on the Assembly race between Democrat Richard Pan, a pediatrician, and Andrew Pugno, a leading homophobe who had the support of NOM. As Chris noted:

Pugno is the golden boy of the nation-wide anti marriage equality effort. His career sets him apart from your standard anti marriage equality activists and includes such highlights as: Chief of Staff to the notoriously homophobic late Senator Pete Knight, Co-Author of Proposition 8, and lead attorney for the Yes on 8 Campaign. It is no surprise that NOM is spending big to have their go-to California political operative elected to the Assembly.

NOM has spent over $112,000 to air a new television ad in which they warn that Pugno’s opponent, Richard Pan, will support the teaching of gay marriage to 2nd graders.

The good news: Pugno lost yesterday.

CA: Stonewall Democrats Organize Against Prop 8 Author’s Assembly Run

Andy Pugno, self-described Proposition 8 author, always struck me as the true believer among the legal team in Judge Vaughn Walker’s courtroom during the Perry v. Schwarzenegger trial (see all of FDL’s Prop 8 coverage here). Some days, Charles Cooper and other members of his team looked beat, after a dose of David Boies’ cross-examination or Ted Olson’s remarks. Not everyone on the team looked like they thought they were winning, or even making very sensible arguments.

But you could always count on Andy to provide a surreal summary during press time after court – things were going wonderfully, the withdrawal of all but one expert was a masterful legal strategy, the Plaintiffs hadn’t made their case, the Judge’s questions showed how convincing the Defendant-Intervenors’ case was – despite their lack of evidence, absent credible witnesses, or expert testimony unfortunately ended up actually making the other side’s case, and used by Olson in his closing.

Never fazed Andy Pugno. In Andy Pugno’s view, the voters of the state of California had spoken, even if narrowly: traditional marriage between one man and one woman was the law. Lesbian and gay couples’ civil rights had been snatched away at the ballot box, but – hey, majority rule, that’s democracy, gotta take your lumps.

CA: Gay Divorce Bill Passes Assembly, Heads to Senate

California’s same-sex domestic partners and married couples seeking breakups should find those processes simpler if the Separation Equity Act bill that passed in the state Assembly on Thursday passes the Senate as well.

Some couples are united as domestic partners and as legally married spouses. That is because many domestic partners chose to marry each other when the option became legally available to them. But current divorce law requires them to dissolve each of the unions separately.

According to proponents of the bill, couples who represent themselves in their divorce might not be aware that both processes have to be completed. They are also required to pay a separate fee for each.

CA: Assemblywoman Sponsors Measure to Remove “Cure the Gays” Law From the Books

California lawmakers narrowly advanced a bill Tuesday that would repeal a state law designed to find the causes and cures of homosexuality. The law, written in 1950, classifies homosexuals as “sexual deviants” and requires the state Department of Mental Health to conduct research on “deviations conducive to sex crimes against children.” The research would be used to help identify potential sex offenders.

The bill moved out of the Assembly Committee on Public Safety on a 4-0 vote, with one Democrat and two Republican members abstaining from voting. They said the law’s reference to homosexuality should be removed but that they want the state to continue researching sex crimes.

California put the law on the books as a response to public outcry after a series of sex crimes in Los Angeles, which included the rape and murder of a 6-year-old girl. The murderer, who openly confessed his crime, was not gay.
