Governor Schwarzenegger has signed the Unemployment Benefits Act (AB 2055), which ensures that same-sex couples in California have access to unemployment benefits. The bill was introduced by Assemblymember Hector De La Torre (D-South Gate) and sponsored by Equality California.
“We thank the governor for signing this bill, which will provide same-sex couples who plan to enter into a domestic partnership with access to benefits that heterosexual couples who are engaged already enjoy and that affect the wellbeing and security of their families,” said Geoff Kors, executive director of Equality California.
“Although this legislation helps chip away at the discrimination same-sex couples face, the fact is that domestic partnerships are not the same as marriage, and the only real solution is to restore the freedom to marry in California so that same-sex couples are truly equal under the law. We thank Assemblymember De La Torre for his advocacy and leadership.”

The Courage Campaign’s Prop 8 Trial Tracker reports that yesterday’s launch of NOM’s latest bus tour is another laughable failure.
Only one stop into The Latino Partnership for Conservative Principles “Vota Tus Valores” bus tour (vote your values, for those who don’t speak Spanish), sponsored by the National Organization for Marriage, and we’re already questioning whether to take these folks seriously. The tour bus arrived 15 minutes late to the Park at Riverwalk, which could have caused confusion if anybody had bothered to come (or if the tour had actually taken the time to invite people).
There was no setup for speakers, just Spanish music blaring from the bus, a few organizers handing out literature and an opportunity to be interviewed by a Univision reporter who was forced to guess the location after poor directions from the organizing staff.

The California State Senate passed the Unemployment Benefits Act (AB 2055) yesterday in a 23-11 vote. The bill seeks to ensure that same-sex couples in California have access to unemployment benefits. Previously approved by the State Assembly, the bill was introduced by Assemblymember Hector De La Torre (D-South Gate) and sponsored by Equality California.
“Because domestic partnerships are not the same as marriage, the California legislature took another necessary step toward eliminating discrimination against same-sex couples,” said Geoff Kors, executive director of Equality California. “The Unemployment Benefits Act will provide same-sex couples in committed relationships who plan to register as domestic partners equal access to benefits that affect the wellbeing and security of their families.”
Currently, heterosexual couples who are planning to marry are eligible for unemployment benefits if one of the partners loses his or her job. This bill would extend the same rights to same-sex couples planning to enter into a domestic partnership.

Of the 700,266 same-sex unmarried partners counted by the U.S. Census Bureau, one in seven of them reside in California, according to an analysis by Social Explorer.
The Social Explorer website provides demographic analysis in a limited free format and via a more robust subscription service. The site blog also features certain stats pertinent to current social events.
With the recent overturning of California’s ban on same-sex marriage, which voters passed as Proposition 8 in November 2008, Social Explorer parsed out the Census data.

California Republican gubernatorial nominee Meg Whitman on Friday told the Sacramento Bee that, if elected, she would defend Proposition 8, which prohibits marriage equality in the state, by appealing a federal judge’s ruling that declared the proposition unconstitutional.
Judge Vaughn Walker overturned Prop. 8 on August 4, but his ruling is now under the consideration of the ninth circuit court of appeals, which has scheduled a December hearing on the case.
At a San Diego press conference on Friday, the Bee asked Whitman, the former CEO of eBay, if she – unlike current California governor Arnold Schwarzenegger and her opponent for governor, attorney general Jerry Brown – would defend the law.

Los Angeles District Attorney Steve Cooley says that if he is elected as state Attorney General in November, he will defend Proposition 8 in court. Current AG Jerry Brown had declined to do so.
“The role of the attorney general is to defend the will of the people,” says [Cooley spokesman Kevin] Spillane. “He would defend (Prop. 8 ) and appeal” U.S. District Court Judge Vaughn Walker’s ruling that found the anti-gay marriage ballot measure to be unconstitutional. Spillane says Cooley considers his position on Proposition 8 to be a matter of “general policy” if he became the next attorney general, not an issue of whether or not he opposes same-sex marriage.
Two weeks ago, Walker found Proposition 8, the 2008 ballot measure that banned gay marriage in California, to be unconstitutional. The ruling has been appealed by proponents of Prop. 8, with the U.S. Ninth Circuit Court of Appeals taking the case. Legal experts are not certain what role, if any, the next attorney general or governor in California will play in the appeal, but there is a possibility those offices could get involved.

Nine people were arrested Thursday during a demonstration outside the county clerk’s office by a group demanding that same-sex marriages be allowed in the San Diego area, despite court and ballot-box setbacks that have put the issue in legal limbo.
Weddings between gay and lesbian couples in the state had been scheduled to become recognized by law again Wednesday evening. Two days earlier, however, an appeals-court decision put that prospect on hold for at least four months.
Nonetheless, several same-sex couples arrived at the bayfront San Diego County Administration Center first thing Thursday morning to demand marriage licenses as a constitutional right, and dozens of others gathered to rally in support.

Hosting a reception today for Tammy Bruce, the lesbian conservative radio show host who believes marriage should be reserved for heteros, GOProud has taken over part of the Manchester Grand Hyatt in San Diego. And they’re loving it!
Chairman Christopher Barron, who will likely be working on his red tan by the pool, isn’t afraid of you homos calling for a boycott of the hotel over owner Doug Manchester’s $125,000 donating to pass Prop 8. “Dear Boycotters of the Manchester Grand Hyatt – It’s really really nice here. That is all

This morning the Field Poll published new results on California voters’ support for same-sex marriage. On the whole, the poll was inconclusive. About 51 percent of those surveyed said they approved of gay marriage, with some 42 percent opposed. That’s hardly great news, however, since it’s the exact result the poll obtained in May 2008, mere months before Californians passed Proposition 8, which amended the state constitution to ban same-sex nuptials.
One interesting thing about the latest poll, however, is how it brings a new level of detail to one of the stickier wickets confronted by proponents of same-sex marriage: distaste for gay rights among ethnic minorities. It’s been known for some time that Asian Americans are the ethnic group most opposed to gay marriage in California, but the new poll marks the first time that subsets of Asians have been singled out and asked what they think about it. The results: Koreans as a group are the most anti-gay marriage. And it isn’t even close.
The new Field Poll reveals that Korean Americans disapprove of same-sex marriage by a margin of 70 to 25 percent. They were followed in their dislike of same-sex couples by Vietnamese Americans (64 percent disapproval) and Chinese Americans (54 percent disapprove.)

A trans woman hopes to make history by becoming the first trans person to be elected as a trial court judge in the United States. Victoria Kolakowski, 48, is the frontrunner candidate for superior court judge in Alameda County, California.
She has over 20 years of legal and judicial experience and currently serves as a judge for the California Public Utilities Commission. She is also co-chair of the board of directors of the Transgender Law Centre and has represented trans plaintiffs in court.
Writing on her website, Ms Kolakowski said: “If I am elected, I would be the first openly LGBT superior court judge elected in Alameda County, the first openly LGBT person elected countywide, and the first transgender trial court judge in the United States.
