Chile Constitutional Tribune to Vote 9-1 Against Marriage Equality

Chile’s Constitutional Tribunal will make an official verdict next week in which they will reject as “inapplicable” arguements made in favor of legalizing same-sex marriage. The case has been going on for a year now, and sought to challenge the decision of a Civil Registry official who refused to grant a marriage license to a same-sex couple.

The vote came down 9 to 1. There were four different opinions from the judges, apparently, and some may mean that there can be future litigation.

The case involves three same-sex couples and Chile’s Movement for Homosexual Integration and Liberation, and is part of a push to challenge the constitutionality of Article 102 of the Civil Code. That article defines marriage as being between one man and one woman.

Chile: President Doesn’t Support Full Marriage Equality

Chile Gay MarriageLast Tuesday, Chilean President Sebastian Pinera sent a bill to Congress proposing legislation that would recognize gay civil unions, granting them inheritance rights and other privileges currently reserved for heterosexual marriages.

Two days later, Chile’s Independent Democrat Union introduced a constitutional amendment that would define marriage as the union of a man and a woman. But is the amendment a backhanded response to Pinera’s legislation or actually a way to do President’s dirty work?

Even though members of Independent Democrat Union refused to attend last week’s signing ceremony–where President Pinera put his John Hancock (or Juan Mano-pollo) on the legislation for Life Partner Agreements–they also know that the President opposes full-marriage equality. In fact, Pinera has repeatedly said, “I deeply believe that marriage is by nature between a man and a woman,” though he adds, “that conviction does not prevent me from recognizing that other forms of affective relationships exist.”

Chile: Constitutional Ban on Marriage Equality Introduced

Members of Chile’s Independent Democrat Union (Union Democrata Independiente) on Thursday will introduce a constitutional amendment that seeks to define marriage as the union of a man and a woman, La Tercera reported.

The move comes 2 days after President Sebastian Pinera sent to Congress a bill that would grant gay and lesbian couples many of the rights and benefits of marriage. The Life Partner Agreement (Acuerdo de Vida en Pareja or AVP) would allow gay and straight couples who have lived together for more than one year to enter the union.

The president signed his bill to the cheers of gay rights activists, but angry leaders of his center-right coalition, which includes the UDI Party, refused to attend the signing ceremony.

Chile: President Proposes Civil Unions Bill

The president of Chile has proposed legalising civil unions for gay and straight couples.

Sebastian Pinera said that all couples deserve “respect, dignity and support of the state” in a speech this week.

The bill, which must be approved by Congress, would give gay couples and straight unmarried couples the same inheritance and social welfare rights as married couples.

Chile: A Thousand March Against Marriage Equality

Anti Gay Marriage March in ChileRoughly one thousand people took to the streets of Santiago, Chile on Saturday in support of the nation’s ban on gay marriage, the Spanish news agency EFE reported.

The march, organized by the Christian conservative groups Transforma Chile and Muevete Chile, stepped off at Plaza Italia and ended at the Palacio de la Moneda.

“Today the Chilean constitution and the law defines marriage as a union between a man and woman, but this is daily threatened by the influence of the homosexual lobby that day by day take more force to lobby Parliament,” the coalition said on its website.

Chile: Civil Unions Bill To Be Introduced Next Week

Chile President Sebastian Pinera is expected next week to introduce a bill that would legalize civil unions for gay and lesbian couples, the Santiago-based La Tercera reported.

Pinera’s bill would allow gay and straight couples who have lived together for more than one year to enter a legal contract called the Non-Marital Cohabitation Agreement.

The conservative lawmaker told daily El Mercurio that his measure seeks to “protect and safeguard” the civil rights of couples living outside of marriage and “safeguard the dignity of those couples, whether of opposite sex or even the same sex.”

Chile: Government Considering Civil Unions

Chile Civil UnionsThe government of Chile appears prepared to consider legalizing civil unions for same-sex couples.

Bloomberg reports:

Chile’s government is preparing legislation that would legally recognize civil unions between gay couples, newspaper La Tercera reported today. The bill, which could be presented to Congress by next week, would grant legal rights to gay couples who have lived together for more than one year, the Santiago-based newspaper reported, citing a copy of the draft legislation it obtained.

Chile: President Pushes for Domestic Partnership Law

While the world did not end when Argentina became one of the few South American nations to legalize same-sex marriage, Chile has been reluctant to follow suit.

Still, Chilean President Sebastian Pinera has said that he wants Congress to legalize a certain amount of civil unions in that nation in order to “regulate and protect” the rights of more than two million unmarried couples in that nation, which include a large number of lesbian and gay couples.

Pinera has stressed that the proposal will not make way for same-sex marriages in the nation, and said that his belief that “marriage in its essence and nature is between a man and a woman” remains unchanged. However, he did campaign on domestic partnerships, but not all within his conservative coalition can be too happy with it.

Chile: Activists Call for National Marriage Equality March

President Sebastian PineraChile’s largest gay rights group Movimiento Chileno de Minorias Sexuales (MOVILH) on Tuesday called for a national march in support of gay marriage.

“It’s time to mobilize,” the group said. “It seems the only way officials listen. We are confident that we will be thousands and thousands of people.”

The June 25 demonstration will be held in the nation’s capital and largest city, Santiago, starting at 3PM at the Plaza Italia.

Chile: Supreme Court May Legalize Gay Marriage

Chile Gay MarriageWhile civil unions in Uruguay and marriage in Argentina were approved by legislatures — and civil unions in Ecuador were approved by voters under a new constitution — the Chilean Supreme Court may approve same-sex marriage in that country.

According to the Santiago newspaper El Mercurio, three couples have filed a lawsuit, and the Supreme Court has agreed to hear the case.

An attorney for the couples, Jaime Silva, argues that two provisions of the Marriage Act are unconstitutional. The first states that marriage is a solemn contract in which a man and woman come together. The second recognizes that a marriage concluded abroad will be recognized in Chile provided it is between a man and a woman.
