Chile: Supreme Court May Legalize Gay Marriage

Chile Gay MarriageWhile civil unions in Uruguay and marriage in Argentina were approved by legislatures — and civil unions in Ecuador were approved by voters under a new constitution — the Chilean Supreme Court may approve same-sex marriage in that country.

According to the Santiago newspaper El Mercurio, three couples have filed a lawsuit, and the Supreme Court has agreed to hear the case.

An attorney for the couples, Jaime Silva, argues that two provisions of the Marriage Act are unconstitutional. The first states that marriage is a solemn contract in which a man and woman come together. The second recognizes that a marriage concluded abroad will be recognized in Chile provided it is between a man and a woman.

Chile: 79% Say OK to Cohabitation Before Marriage, But Only 34% Say OK To Marriage Equality

Chile Gay MarriageThe national survey, conducted by the Universidad Diego Portales’ Institute of Social Sciences between Sept. 11 and Sept. 30, polled more than 1,300 Chileans older than 18 on various political and social topics. Other topics that received wide public support were cohabitation before marriage, and divorce as the best alternative when a couple has exhausted all other possible solutions.

Nearly 79 percent said it was acceptable to live with a partner before marriage, yet the ultimate intention of marriage was still important. Only 56.7 percent said it was acceptable to cohabitate with a partner without the long-term expectation of marriage.

Nevertheless, questions dealing with homosexuality continued to divide the population, with only 54.7 percent of Chileans surveyed saying they believed it was as valid a sexual option as any other. Rights for gay individuals received even less support, with only 33.8 percent in favour of gay marriage, and a mere 22.5 percent supporting gay couples right to adopt.

Chile: Homophobic Stunt Mars Gay Film Festival

A homophobic stunt has led to increased security measures at a GLBT film festival in Santiago, Chile. The stunt occurred on Tuesday evening at the Spanish Embassy in the Chilean capital, one of six venues at the third Festival of Sexually Diverse Cinema.

Vials of an odorous liquid of undetermined origin and pamphlets saying “no more lies, promoting homosexuality is not culture” and “your taxes are being used here” were launched in the embassy’s theatre and entrance.

The attacks follow a campaign against the festival by anti-gay group Acción Familia, whose various complaints included an allegation that pedophilia was being promoted by using the faces of the 11-year-old protagonists of one of the films in the festival’s publicity.

Chile: President Supports Civil Unions, But Not Gay Marriage

On March 11, 2010, Sebastián Piñera was sworn in as the Republic of Chile’s 35th president in a ceremony at the National Congress in Valparaíso.

In terms of social policy, running a divided country will be more difficult. Alianza por el cambio, the coalition that helped Piñera win the presidency, is largely composed of socially conservative Catholics. This powerful portion of Chilean society has prevented the passage of the left’s socially progressive legislation, successfully blocking divorce until 2004.

Abortion is still illegal in Chile, and it is doubtful that this will change anytime soon. In August, the left introduced a bill in Congress to legalize same-sex marriage. Such a bill is unlikely to pass in the socially-traditional country, especially without the support of its chief executive. The President has promised to expand the rights of homosexual couples seeking civil unions, but opposes gay marriage.

Chile: Catholic Church Bullies Senators Supporting Gay Marriage Bill

Chile Senator Fulvio Rossi, the president of the Socialist Party, has implied the Roman Catholic Church had a hand in the recent decision of four senators to withdraw their support for a gay marriage bill.

Rossi, who introduced the bill in August, said he would “not accept intimidation from any church” in criticizing the senator’s request to have their names withdrawn from the bill.

He called the departure of Senators Alejandro Navarra (MAS), Isabel Allende (PS), Guido Girardi (PPD) and Ricardo Lagos Weber (PPD) a “bad sign.”

Chile: Two Senators Introduce Gay Marriage Bill

Two leftist senators introduced a bill to legalize gay marriage Tuesday, drawing predictions from colleagues on both the left and right that the measure has little chance of approval in conservative Chile.

Chile adopted a law allowing divorce only six years ago, and the influential Roman Catholic Church is sure to oppose the legislation. Santiago Cardinal Francisco Javier Errazuriz sharply criticized Argentina’s recent legalization of gay marriage.

The two senators who introduced the proposal defended it as a matter of fairness.

Chile: Senator Will Sponsor Gay Marriage Bill

The head of Chile’s Socialist party, Fulvio Rossi, told reporters on Sunday that he planned to sponsor a bill to legalize gay marriage in the country, as occurred last month in neighboring Argentina.

“This is a project that I will present… and I am also calling on the Church to be more welcoming, and I say that as part of the Church,” the senator said, responding to remarks from Chilean Cardinal Francisco Javier Errazuriz who described the same-sex weddings in Argentina as “an aberration.”

A gay couple from Chile was among the first to marry in Argentina, in the wine-making Mendoza region, when the country become the first in Latin America to allow same-sex nuptials.

Chile: Catholic Cardinal Calls Gays Defective

According to Cardinal Jorge Medina Estévez in Chile believes that being homosexual is a defect like lacking an eye (writes the reporter wearing an eye patch). According to Estévez “the Church distinguishes the homosexual tendency and homosexual practice. If a person has a homosexual tendency it is a defect, as if one lacked an eye, a hand, a foot.”

Of course, he believes that homosexual conduct is immoral, apparently so is wearing an eye patch or having to have an artificial hand or foot. “In my life as a priest, I have had [pastoral] care of many people with this problem.” He apparently goes on to explain how, like alcoholics, some have overcome this ‘tendency’ through “discipline, education or reeducation.” Estévez made these comments in the wake of Argentina’s decision to legalize same-sex marriage.

Of course, Estévez also believes that same-sex marriage “is something in opposition to the law of God, and no human law can go against the law of God. If a human law goes against the law of God, that human law does not exist.”

Chile: Couple Asks to Be Married in Argentina

A Chilean couple is acting fast after hearing that the Argentinian government approved gay marriage this past Thursday. Already they have called the Civil Registry of Mendoza, Chile’s neighboring city, to inquire about marriage procedures.

Although the law was passed, it has not yet taken effect and there are minor issues to work out still. Tomorrow, for example, the law will be first published in the Official Bulletin. For this reason, the Chilean couple was asked to call back once things are ready.

To get married by law in the Civil Registry, couples will have to wait 20 days. If a couple wanted to get married by law at their ceremony, they would have to wait about a month in order to create a book of records among other procedures. Government minister of Mendoza Mario Adaro said that he personally instructed the Civil Registry offices to adapt the records for times when same-sex marriages are to occur.

Chile: Activists Hold Forum on Gay Rights and Education

Students of all sexual orientation need to know they are not alone, say activists who came together for Chile’s first forum on education and sexual diversity.

The forum was held Wednesday afternoon at the National Library in Santiago for teachers, secondary school and university students, and was sponsored by Chile’s gay rights group, MOVILH.

The event was designed to open the discussion on topics relating to schooling (of all levels) and sexual orientation in Chile. The date of the forum was strategic, in order to talk to students in the beginning of the first semester.
