Marriage Equality in South Africa Threatened by Constitutional Review

Since the end of Apartheid and the inception of South Africa’s new constitution some twenty years ago, the country has been lauded for its lead on the entrenchment of anti-discrimination rights that renders it one of the few in the world to protect sexual orientation and gender identity in its Constitution.

Gays and lesbians (LGBTI) enjoy full equality in South Africa, including rights to marry and full immigration equality.

Notwithstanding this South Africa has never managed to escape the brutality of rampant homophobia which is underscored by the high incidence of so called “corrective” rape in its townships, the deployment of an anti-gay ambassador to homophobic Uganda, and its failure to lead the decriminalization of homosexuality in the rest of Africa.

Now the time has come for a Constitutional review and gay rights activists fear the worst. There is a move to consider a change to the Constitution’s provisions on sexual orientation and property rights have been referred to party caucuses for consideration.

Die Burger a local Afrikaans newspaper reported on Thursday that Parliament’s constitutional review committee has made the unusual move of referring these proposals to political parties.

Madibe Nelson Mandela sought to ensure protection against all forms of discrimination in South Africa at the time the new Constitution was formed. Now LGBTI activists fear that African traditionalists and religious fundamentalists are interfering by seeking a direction to bring South Africa back to draconian pre-apartheid era, where homophobia will be ingratiated rather than the protections the Constitution currently provides.

Once a year, the committee considers proposals from the public on possible changes to the Constitution. Normally it rejects most of the proposals, but at a recent committee meeting, these proposals were the only ones not to be thrown out.

There was a proposal that section 25 of the Constitution (enshrining the right to property and the rights of property owners and of society as a whole) be amended in order to create a new window period for the submission of land claims, while the PAC proposed that section 25 be scrapped and replaced.

Sexual orientation
The House of Traditional Leaders made a proposal regarding scrapping the sexual orientation section from the bill of rights contained in Chapter 2 of the Constitution. The Constitution reads: “The state may not unfairly discriminate directly or indirectly against anyone on one or more grounds, including race, gender, sex, pregnancy, marital status, ethnic or social origin, colour, sexual orientation, age, disability, religion, conscience, belief, culture, language and birth.”

ANC MP and review committee chairperson Chief Patekile Holomisa told Die Burger that none of the 17 constitutional amendments since 1996 have been handled by the committee, and that with the exception of two cases (allowing and then scrapping floor-crossing between political parties), the Constitution has never been drastically amended.

Holomisa said the proposed amendments could mean comprehensive changes in people’s lives, and the committee wanted to play a greater part in constitutional amendments than it had done in the past.

However, he said the mere fact that the amendments were being discussed in no way implicated that they would be accepted. They will be discussed by the committee once feedback had been received from party caucuses.

Yet activists such as Eugene Brockman the designer of the Gay Flag of South Africa notes:-

“I am truly concerned that decades of lobbying and progress for LGBTI rights in South Africa are under threat.The constitutional review committee of South Africa are actually allowing for discussion on scrapping protections for “sexual orientation” from the South African constitution. The house of traditional leaders have put forward that the inclusion of “Sexual orientation” should be discussed, in over 80 applications put to the constitutional review committee, they allowed for “sexual orientation” and land rights to be discussed. Gay rights equal human rights, there should no discussion period!”

SA GLAAD’s Cobus Fourie told me that they are alarmed that the equality clause of the Bill of Rights is even considered for amendment to summarily wipe out the rights of a significant portion of the South African society:

“We have always been very proud of our very progressive Constitution. We hope that the Congress of Traditional Leaders and political parties keep this profound statement by our first democratically elected president, Nelson Mandela, in mind: ” Never, never and never again shall it be that this beautiful land will again experience the oppression of one by another”

The mere fact that they are being discussed causes a shiver and imposes an ominous dark cloud, as surely these are constitutional rights entrenchment ought to be ensured to such a degree that they the rights should be untouchable.

In essence surely any amendment or change will be unconstitutional.

OH, USA: Local Views on Proposed Marriage Equality Amendment

OH, Marriage Equality Amendment ViewsVoters in the November 2013 election could decide if Ohio will become the 10th state to allow same-sex marriages if proponents of a petition to amend the state constitution can gather the necessary signatures to place it on the ballot.

New York, Connecticut, Massachusetts, Iowa, Vermont and New Hampshire currently allow same-sex marriages as does Washington D.C. while California, Maryland and Washington have statutory or judicial recognition of same-sex marriage that has not yet taken effect.

On April 3, Ohio Attorney General Mike DeWine certified a petition from the Ohio Freedom to Marry Coalition that seeks to repeal and replace Section 11, Article XV of the Ohio Constitution.

Ireland: New Poll Says 73% Believe Marriage Equality Should Be a Constitutional Right

New York Gay Marriage PollMarriage Equality today welcomed the results of a new Red C poll which indicate that 73% of voters believe marriage equality should be enshrined in the Constitution.

Three in four of those polled agreee with the statement, “Same-sex marriage should be allowed in the Constitution.” The research was carried out by academics and polling company Red C on behalf of the government, to examine the reasons why last year’s referendum on Oireachtas inquiries was defeated.

The survey follows yesterday’s news that the government will soon issue draft proposals for the make-up of the Constitutional Convention pledged in the Programme for Government last year. The Convention will consider, among other issues, the provision of marriage equality for same-sex couples.

Hungary: New Constitution Explicitly Bans Marriage Equality

Hungary’s new constitution, which bans gay marriage and does not explicitly protect gay people from discrimination, has come into force amid public unrest.

The constitution was enacted 262-44 in April of last year, with 80 members of parliament boycotting the drafting and voting process, and took effect on 1 January 2012.

The document specifically restricts marriage to straight couples and appears to ban abortion by saying that foetuses will be protected from conception onwards.

Ron Paul The Only Candidate to Oppose Marriage Equality Ban Amendment

Texas Rep. Ron Paul was the only candidate at a Christian forum on Saturday opposed to amending the U.S. Constitution to define marriage as a heterosexual union.

Also appearing at the Thanksgiving Family Forum in Des Moines, Iowa were Newt Gingrich, Rick Santorum, Herman Cain, Rick Perry and Michele Bachmann. Former Massachusetts Governor Mitt Romney was invited but did not attend. Also not in attendance was former Utah Governor Jon Huntsman, who has not placed an emphasis on Iowa.

The candidates gathered around a dinner table festooned with pumpkins as moderator Frank Luntz kept the conversation flowing for two hours as nearly 3,000 religious and socially conservative activists listened in.

Hungary: New Constitution Bans Marriage Equality

Hungary Gay MarriageHungarian lawmakers approved a new Constitution Monday which bans same-sex marriage and includes a number of other socially conservative tenets, the AP reports:

Hungary’s political opposition and human rights groups including Amnesty International say other measures are attempts to limit freedoms. The constitution protects the life of a fetus from the moment of conception, a move seen as opening the possibility for a future ban or restrictions on abortion.

Same-sex couples may legally register their partnerships but marriage is restricted to heterosexual relationships.

Hungary: Gays to Protest New Constitution

Gay HungaryHungarian gay civil rights groups will hold a demonstration in Budapest on April 15 against the new constitution draft’s passages on marriage and equal rights for gay people, the organisers said on Wednesday.

Daniel Kaderjak, the chairman of one of the groups, said the draft defines marriage in a way which causes segregation. The gay groups have started an online petition on this subject, signed by 700 so far, including some famous public figures, said Kaderjak.

The petitioners have started to operate a Coalition for Gay Equality (MEGYEK), which will organise the demonstration on the square in front of parliament.

Hungary: New Constitution Would Ban Marriage Equality

Human life will be protected from conception and marriage will be defined as heterosexual co-existence in the new Constitution, according to the specimen The Principles of Regulating the Constitution of Hungary.

Hungary would continue to be a republic and a democracy governed by the rule of law.

The Royal Crown will be included in the preface to the Constitution and will be emblazoned on the state flag, the concept adds.

Scalia: 14th Amendment Does Not Apply to “Homosexual Sodomy”

Antonin ScaliaSpeaking on Friday at the University of Richmond, Supreme Court Justice Antonin Scalia denounced the concept of a “living Constitution” and said the 14th Amendment was not written with the intent of granting equal protection to ALL Americans. Just the heterosexual ones.

“The due process clause has been distorted so it’s no longer a guarantee of process but a guarantee of liberty,” Scalia expounded. “But some of the liberties the Supreme Court has found to be protected by that word – liberty – nobody thought constituted a liberty when the 14th Amendment was adopted.

“Homosexual sodomy? It was criminal in all the states. Abortion? It was criminal in all the states. The way to change the Constitution is through amendments approved by the people, not by judges altering the meaning of its words,” he added.

Hungary: Proposed New Constitution Would Ban Gay Marriage

Hungary Gay MarriageThe constitution which is now being drafted at the behest of the ruling Fidesz-Christian alliance will declare marriage suitable only for men and women, according to a section of the draft document seen by MTI.

Further the draft states that “the family is the alliance of the generations,” and a sentence in support of bringing up children and work will also figure in the document.

The Socialist party and green formation Politics Can Be Different also represented in the committee drawing up the new supreme law said they objected to the proposal to set in stone outlawing gay marriage.
