Costa Rica’s President Would Not Fight Court Ruling for Marriage Equality

Costa Rican President Laura ChincillaWhen Costa Rican President Laura Chinchilla was elected in February 2010 she was adamant about her belief in “traditional” marriage, but clarified those remarks this week by saying she would not oppose a court ruling legalizing same-sex marriage.

The Tico Times reports:

Two gay couples, as part of the Diversity Movement, asked a Costa Rican court Monday to be married in a civil union, drawing attention to the issue. Chinchilla made the statement during the last day of her visit to California, as part of a 6-day visit to the United States.

Religious Right Fuming Over Court Denial of Gay Marriage Vote

Religious leaders and anti-gay activists in Costa Rica are fuming over a court decision that strikes down a plan to put the rights of LGBTs up to popular vote, Proposition 8-style.

The court’s Aug. 10 decision strikes down a plan by religious conservatives to put civil unions for same-sex couples up to a referendum. GLBT equality advocates in Costa Rica are not seeking full marriage parity, but they are pressing for national reform, as opposed to adopting a state-by-state or regional strategy, reported The Global Post on Aug. 29.

“The majority [of magistrates] considered that the rights of minorities borne out by struggles against majorities cannot be subjected to a referendum process where the majority rules,” the Costa Rican Supreme Court ruling said.

Costa Rica: Struggle for Gay Rights

Some are celebrating, some cursing, a new federal court ruling to restore gay marriage in California – even though same-sex weddings are on hold pending an appeal process. Meanwhile, in Costa Rica, the country’s high court ensured that the battle over gay rights won’t be fought through the ballot box.

A public referendum on recognizing same-sex civil unions was set for December. Proponents had submitted enough signatures – at least 5 percent of the electorate – to hold the vote. But on Aug. 10, the Supreme Court canceled the referendum.

So why is the Costa Rican lesbian, gay, bisexual and transsexual (LGBT) community ecstatic? Because those opposed to recognizing same-sex weddings were almost certain to win a referendum as opinion polls in this predominantly Catholic country indicate that the vast majority see gay rights as contravening traditional family values.

Costa Rica: Supreme Court Blocks Public Vote Against Marriage Equality

More amazing news today from Latin America by way of Andres Duque:

OMG. What IS going on in Latin America! Just a couple of hours ago, the Supreme Court in Costa Rica ruled that a referendum scheduled for December 1st which would have banned marriage rights for same-sex couples was unconstitutional.

The article does not give the vote total but says that the majority determined that the issue of marriage rights was a judicial issue and not an electoral issue and that the rights of minorities should never be subjected to a referendum process where they might be subjected to the wishes of a majority.

Costa Rica: Court Temporarily Blocks Referendum on Gay Marriage

The Sala Constitucional (Constitutional Court) has ordered the Tribunal Supremo de Elecciones (TSE) to suspend the process of the referendum on same sex marriages that was to have been included in the December 2010 municipal elections.

The court order was based on an appeal filed against the referendum.

The Recurso Amparo (appeal) was presented by an individual identified only by the last names, Quirós Salazar, alleging that the referendum violates the rights and freedoms of individuals.

Costa Rica: Gay Marriage Put on the Ballot

Same sex marriage is still not legal in Costa Rica; a referendum is about to decide whether a new law will pass permitted the gay community to get married. This decision involves various gay groups, the Catholic Church, The Supreme Court and civil lawyers.

Why a Referendum to decide upon the fate of such a delicate issue like same sex civil union is questionable, when Costa Rica is so proud of being a democratic Country? The new President of Costa Rica, Laura Chinchilla, is strongly opposed to same sex marriage and abortion rights, where is this democracy?

The new president was elected, like many before her, by giving a bag log of promises that will never concretizes. Now the gay community is about to be the first one to pay.

Costa Rica: Gay Groups Fight to Put Gay Marriage on the Ballot

The possibility of a referendum to allow homosexual marriages, is ever closer. The referendum is to be included in the year end municipal elections if proponents of the bill manage to obtain the number of signatures required by the Tribunal Supremo de Elecciones (TSE).

However, opponent gay groups are not sitting on their hands and say they are working in different ways to prevent the bill from going to referendum and approval. And if their tactics don’t stall the process, they vow that the proponents of the bill will get a surprise, though no details were given.

If the pro gay marriage group are able to obtain the signatures, Costa Ricans will be able to vote for or against gay marriages in the December elections.

Costa Rica: President Comes Out in Favor of Gay Marriage

Costa Rican president Oscar Arias on Wednesday called the doctrine of celibacy of Latin Catholic priests wrong and against nature.

Arias said it’s time for the Roman Catholic Church to stop demanding celibacy from its priests, optimistic that the 2.000 year religion will correct the error, as he calls it.

During the mid day remarks, the prez also expressed of being in favour of same sex marriage. “We are made as we are. A young boy (or girl) does not ask if he or she will grow up gay or straight. sexual orientation is given by God or by nature”, said Arias urging respect for homosexuals.
