Federal Judge Rules DOMA Unconstitutional

DOMA RulingAnother day, another victory for equality. Today, Judge Jeffrey White, a George W. Bush appointee to the federal bench, declared the Defense of Marriage Act (DOMA) was unconstitutional as it applied to Karen Golinski.

Ms. Golinski is a married lesbian who wishes to put her wife on the health plan she gets through her employer, the Ninth Circuit Court of Appeals. But, by declaring that federal law only recognizes opposite sex marriages, DOMA Section 3 prevents her from doing this, something that every heterosexual married federal employee can do. Also, you may recall, President Obama refused to defend DOMA in this case, ceding that role to Republicans in the House.

Today’s decision in Golinski v. Office of Personnel Management is notable for a number reason, not the least of which is its role as the latest nail in DOMA’s coffin.

IL: Catholics Form Group to Fight Marriage Equality

Responding to the advent of civil unions in Illinois, the Catholic Conference of Illinois (CCI) announced the formation of a Defense of Marriage department Sept. 22.

According to a press release from the Catholic lobby organization, the department will battle anticipated attempts at legalizing same-sex marriage in Illinois.

“The teachings of the Church are not overwhelmingly popular everywhere, nor are they always easily explained,” said Zach Wichmann, head of the department, in a statement. “But our message will be proclaimed for the sake of stronger families, secure children and an enriched spiritual life.”

Three Democrats Press Boehner on New DOMA Law Firm

Three Democrats are asking House speaker John Boehner for more information about the new law firm hired by House Republicans to defend the Defense of Marriage Act in federal court.

House Administration Committee ranking member Robert A. Brady and committee members Zoe Lofgren of California and Charles A. Gonzalez of Texas sent a joint letter to Boehner after the law firm of King and Spalding decided to pull out of the case; one of its partners, former solicitor general Paul Clement, had signed on to defend the government.

Soon after King and Spalding withdrew its resources, Clement resigned from the firm and joined Bancroft PLLC.
