US Labor Department Announces New Regulations Protecting Transgender Employees

Newly issued Department of Labor regulations have added gender identity to the class of employment protections. Via press release:

The U.S. Department of Labor today announced its full commitment to implementing equal employment opportunity policies for all department employees and applicants. The policies ensure equal protections for all employees and applicants regardless of race; color; religion; national origin; sex, including pregnancy and gender identity; age; disability, whether physical or mental; genetic information; status as a parent; sexual orientation; or other non-merit factor.

New, robust statements signed by Secretary Solis include updated policies on prohibiting discrimination on the basis of sex, including gender identity and pregnancy.

Facebook Joins Google, Will Reimburse Gay Employees for Extra Taxes

FacebookFacebook is joining the small but growing list of companies who are reimbursing their gay employees for the tax inequities incurred by carrying their partners on their insurance.

The new policies follow similar announcements by Barclays, and also this year, Google. A handful of other large organizations, including Cisco, Kimpton Hotels and the Gates Foundation also cover these costs.

Under federal law, employer-provided health benefits for domestic partners are counted as taxable income, if the partner is not considered a dependent. The tax owed is based on the value of the partner’s coverage paid by the employer.

MD: Annapolis Extends Benefits to Partners of Gay/Lesbian City Employees

Mayor Josh Cohen has extended employment benefits to the same-sex partners of Annapolis’ workers, giving them access to medical plans. Under the new city rules taking effect July 1, the same-sex partners of city employees can enroll in city-offered medical, dental, vision and prescription drug benefits. Those benefits do not extend to unmarried heterosexual couples.

Only same-sex partners are eligible for the domestic partnership benefit option because they don’t have the ability to marry in Maryland. The city’s policy comes months after state employees and retirees and their same-sex domestic partners were allowed to enroll in benefit programs.

“This is very exciting and it’s a move in the right direction towards equality in Maryland. And it’s appropriate because it’s the seat of our government,” said Morgan Meneses-Sheets, executive director for Equality Maryland, an advocacy group for lesbian, gay, bisexual and transgender Marylanders.

IL: Treasurer Signs Executive Order Giving Family Leave Benefits to Gay/Lesbian Employees

Illinois Treasurer Alexi Giannoulias signed an executive order June 13 that brings same-sex partners in committed relationships into the ranks of treasurer’s office employees covered by the Family and Medical Leave Act ( FMLA ) .

At a signing ceremony and press conference, Giannoulias said, “Signing this executive order is a step toward marriage equality.” Giannoulias, a Democrat, faces Republican Mark Kirk in this fall’s U.S. Senate race.

Under current FMLA guidelines, married individuals are able to take up to 12 weeks off of work to care for a sick spouse, child or parent. Under the new rules, these benefits will be extended to treasurer’s office employees in same-sex committed relationships. The policy also allows for maternity, paternity, and bereavement leave, granting a measure of job security where previously there was no legal protection
