Today is the Deadline for Appeal Decision on DOMA Gay Marriage Case

As we enter the final three weeks of the 2010 election cycle, there are grave concerns about the enthusiasm of progressive voters. For LGBT voters, there has been a grave disappointment with the lack of action on critical legislation. Over the next couple weeks, we’re not going to see legislative progress. Instead, we’re going to see the Obama administration defending the constitutionality of two discriminatory, anti-gay laws: DOMA and DADT.

Chris Johnson reported last week:

The deadline for making a decision in the Commonwealth case – filed by Massachusetts Attorney General Martha Coakley – is Oct. 12.

The Justice Department doesn’t have to appeal the decision in the Gill case, filed by Gay & Lesbian Advocates & Defenders, until Oct. 18 because the court didn’t enter judgment in the case until later.

NY: AG candidate Promises to Sue Federal Government to Repeal DOMA if Elected

Nassau County District Attorney Kathleen Rice said yesterday that she plans to sue the federal government over the Defense of Marriage Act if she becomes New York’s next attorney general.

“It’s time attorneys general around the country begin to challenge the legality of this discriminatory law,” Rice said. “I will be proud to be among the first AG’s to challenge DOMA and to tell the federal government that New Yorkers refuse to be subjected to government-mandated discrimination.”

The lawsuit would allege that by defining marriage between a man and a woman, DOMA infringes on state’s rights to define and regulate marriage as they see fit. Although same-sex marriage is not legal here, New York does recognize gay marriages performed in other states.

CA: June 16th Set for Prop 8 Trial Closing Arguments

Paul Hogarth, reporting for the Prop 8 Trial Tracker, reported today that closing arguments for the controversial Prop 8 trial, which decides the fate of gay marriage in California, have finally been set for June 16th.

Justice Vaughn Walker set the June court date on Wednesday, along with a supplemental date of May 9 as the deadline for the defendants, the Prop 8 supporters, to “suppress testimony” by one of the few witnesses they called to the stand, San Francisco extreme-right leaning minister, Dr. Tam.

Dr. Tam famously admitted to the court his belief that if gay marriage were legalized, it would result in an escalation of kids becoming gay, an unsubstantiated notion. His testimony is a definitive example the prosecution could reference to tie the proposition to social prejudice against a minority group.

CA: Gay Allies Agree to Turn Over Emails in Prop 8 Case

The lawsuit against Prop 8 took one teeny-tiny step forward today, as Equality California and the ACLU agreed to release a handful of previously secret emails that their opponents had demanded.

The organizations had both worked to oppose Prop. 8, the ban on equal marriage rights for gay couples. Although neither group is a plaintiff in Perry v. Schwarzenegger, the current challenge against the ban, the Prop. 8 proponents had requested emails from both organizations. EQCA estimated that gathering and releasing the documents will cost $20,000.

When EQCA and the ACLU resisted the court’s order to release the documents, they risked being held in contempt, at which time they would have been fined $2,000 per day and could have contested the order. But that’s not what happened – instead, today they both agreed to release the internal emails.

CA: Prop 8 Judge Issues Ultimatum to No on 8 Groups

U.S. District Court Judge Vaughn Walker has issued a warning to Equality California and the ACLU that they have until tomorrow to hand over the documents that he ordered them to so that the pro-Prop 8 groups could go through them. If they failed to do so, they would be fined a total of $2,000 per citation.

Neither Equality California nor the ACLU are, in fact, party to the lawsuit which makes the order for them to spend the $20,000 necessary to reproduce the documents rather baffling. This may be a stalling tactic on part of the “Yes on 8″ coalition which fear that this case could overturn not only Prop 8, but make same-sex marriage legal across the country.

This lawsuit, Perry v. Schwarzenegger, also has national implications as many national anti-LGBT groups fight to keep a gay man or lesbian from sitting on the Supreme Court.

CA: Prop 8 Trial Judge May Set Date for Closing Arguments Soon

In Prop 8 trial news, Judge Vaughn Walker has notified trial participants that he intends to close the evidentiary record, and seeks comments on that intention by this Friday:

The point of closing the evidence record, of course, would be to end the opportunity to submit any new evidence, such as the discovery materials sought by the Defendant-Intervenors from non-parties who fought Prop 8 during the election. These were the subject of last month’s hearing.

Additionally, the court filed an order earlier this week regarding new Amicus Briefs. Presumably, Judge Walker has had enough of those! While he did say (when last discussing them) that he would read them all, because the case was particularly ‘well-lawyered’ Walker expected that friends-of-the-court would have little new light to shed. But, he said, in case that new light did exist, he would read amicus briefs looking for it. But, now, he may be done with them.

GLAD DOMA Court Challenge Starts in Federal Court on May 6th

On Thursday, May 6, 2010, the Federal District Court in Boston will hear oral arguments on the constitutionality of the federal Defense of Marriage Act (DOMA), in the case of Gill v. Office of Personnel Management, brought by GLAD in March 2009.

The hearing will address the central issue of the case – is DOMA constitutional? –six years after the first same-sex couples in the country started marrying in Massachusetts, the result of GLAD’s groundbreaking marriage case, Goodridge v. Department of Public Health.

Arguing before U.S. District Judge Joseph L. Tauro on behalf of seven married same-sex couples and three widowers will be Mary L. Bonauto, GLAD’s Civil Rights Project Director. Bonauto was the lead attorney in Goodridge.
