Germany, France Moving on Marriage Equality?

Marriage Equality in France and Germany?Germany’s Social Democrat opposition (Sozialdemokratische Partei Deutschlands, SPD) backed marriage equality at its national convention in early December.

The vote from delegates was unanimous that the party should seek to change German law should the party form the next government, almost certainly in alliance with smaller parties which already back gay marriage such as the Greens. They also voted unanimously to end discrimination in adoption law.

Ansgar Dittmar, National Chairman of lesbians and gays in the SPD (Schwusos), said that the party had decided that there was now no more legitimacy in maintaining two parallel institutions of marriage and life partnership.

France: Gay Wedding Re-Opens Marriage Equality Debate

France Gay WeddingThe mayor of a small French town challenged the country’s ban on same-sex marriage by presiding over the wedding of two men on Saturday, reviving the debate on gay marriage as France’s presidential election campaign heats up.

The move drew a swift rebuke from a junior minister in President Nicolas Sarkozy’s government who described it as an “electoral provocation.” Jean Vila, the mayor of the town of Cabestany, wore his tricolore sash as he presided over the wedding of Patrick, 48 and Guillaume, 37, and said afterward that he did so as a “militant act.”

“To outlaw homosexual marriage is to deny the reality of thousands of homosexual couples,” he said after the ceremony in the city hall of the town about 40 km (25 miles) from the Spanish border.

France: Sex Change Tests Marriage Equality Ban

France Gay MarriageA French citizen who changed sex to become a woman but stayed with her wife of 15 years and their children is seeking legal recognition for her altered status, in a case that could reopen debate over France’s ban on same-sex marriage.

Wilfrid Avrillon, a 41-year-old computer engineer, became Chloe Avrillon after a sex switch operation five years ago and still lives with wife Marie-Jeanne, a lesbian, and their three children in the west of France.

Avrillon presented her case to court officials in a closed-door hearing on Thursday and is now waiting for a ruling in mid-December, her lawyer said.

France: Parliament Says No to Marriage Equality

France’s lower house of parliament Tuesday rejected a bill that would have allowed gays to marry.

The house, dominated by the ruling right-wing UMP party, voted by 293 votes to 222 to block the bill, with most left-wing lawmakers backing it and most of the right opposed.

“We are against homophobia but we do not want to alter the image and function of marriage in the collective subconscious,” said UMP lawmaker Michel Diefenbacher.

France; Parliament Likely to Reject Marriage Equality Bill

French lawmakers are expected to reject a bill that would legalize same-sex marriage five months after the country’s highest court ruled that laws banning it don’t violate the constitution.

Ruling conservatives of French President Nicolas Sarkozy’s UMP party are expected to reject the bill in Tuesday’s vote.

Supporters say it is needed to bring France into line with countries like the Netherlands, Belgium and Spain, which have already legalized gay marriage.

French Women Defy Gay Marriage Ban

It may not be legal for same-sex couples to marry in France but two women found a way around the law in that country when they successfully exchanged vows in the city of Eastern city of Nancy yesterday. How did they pull it off? One of the women was born a man and has recently completed sex reassignment surgery.

AFP reports:

Stephanie Nicot, 59, wed 27-year-old partner Elise in a town hall ceremony in Nancy in eastern France in what is said to be the first marriage of its kind in the country. Stephanie, formerly Stephane, had sex reassignment surgery to become a woman but has refused to lodge documents, as required by French law, to also have her gender changed on the population register.

Gay French Couples Face Hurdles Having Children

Paris Gay AdoptionGay couples in France are resorting to drastic measures to have children, according to campaigners. Couples were resorting to costly and legally precarious methods, said Philippe Rollandin, spokesman for APGL, the largest association representing homosexual parents in France.

Campaigners are also unhappy that the children of homosexual couples have less protection than the offspring of heterosexual pairs if one parent dies or the couple separates. “Homosexual couples are becoming more dismayed and angry about this clear discrimination in France, particularly as we are seeing the situation changing so clearly in Europe,” he said.

Unlike in the UK, where gay parents have equal rights over their child, in France only one – the biological or adoptive parent – has automatic parental rights, said Caroline Mecary, a specialist gay, lesbian, bisexual and transgender rights lawyer.

France: Mayor of Montpellier Marries Gay Couple

A GAY couple have been “married” by the maire of Montpellier. Socialist Helene Mandroux married a local radio boss, Florent Robin, 49, and a teacher of Portuguese, Tito Santos-Mota, 51, in a symbolic ceremony designed to raise the issue of the unequal treatment of gay people.

Ms Mandroux did not officially enter the marriage in the register and the couple decided not to kiss, saying they would wait for it to be made official first.

The local councillors of the Socialist majority lined up outside the mairie to make a traditional haie d’honneur for the couple to walk between as they came out.
