New Zealand: Marriage Equality Supporters March on Parliament

About 300 protesters marched on Parliament on Thursday in a bid to convince the Government to legalise same-sex marriage and allow gay couples to adopt children.

Organisers of the Legalise Love protest say marriage offers more rights than civil unions, which gay couples have been able to enter into since 2004. At present, gay, bisexual and transgender couples cannot adopt.

One of the speakers at the protest, Brooklynne Kennedy, says people are starting to feel the negative impacts of civil unions – especially when they want to start a family.

VA: New Poll Says Bare Majority Opposes Marriage Equality

Virginia Gay Marriage PollOn the subject of same-sex marriage, 52 percent of voters oppose legalizing it. Voters addressed the subject nearly five years ago when they approved an amendment to the state constitution defining marriage as a union between one man and one woman.

Yet voters support allowing gay couples to adopt children by a 51-43 percent margin. Under current law, married couples and individuals, regardless of their sexuality, are eligible to adopt in Virginia.

The gay adoption debate reignited recently over proposed revisions to regulations for state-licensed private adoption agencies. Gay rights advocates are seeking to prohibit agencies from discriminating against prospective adoptive parents because they are gay. Some faith-based groups disagree, saying they would have to disregard their religious beliefs to meet that standard. The Quinnipiac poll found that by a 48-45 percent margin, voters favor allowing church-run agencies to disqualify prospective parents because of their sexual orientation.

AR: Supreme Court to Hear Arguments on Gay Adoption Ban March 17th

The Arkansas Supreme Court has set a date to hear arguments challenging an adoption ban on unmarried couples.

In 2008, voters approved the law after a high court overturned a state child welfare policy barring gay couples from being foster parents.

A lower court ruled this law unconstitutional, but the attorney general’s office is appealing that.

Israel Will Allow Second Parent Adoption for Gay/Lesbian Couples

Israel Gay AdoptionA ruling by a Jerusalem court has cleared the way for Israeli gay couples to adopt each others’ children.

“This is a big step for the gay, lesbian, bisexual and transgender community in Israel,” commented lawyer Irit Rosenblum, executive director of New Family, an organization that champions the rights of Israelis to marry and build families outside the traditional system.

“However, there is still a long road to the desired recognition, since each issue pertaining to gay rights is decided by the courts, and not by the legislature.”

FL: State Won’t Appeal Ruling Against Gay Adoption Ban

The Florida Department of Children and Families (DCF) announced Tuesday evening that it would not appeal a court ruling that found the state’s gay adoption ban unconstitutional, CNN reported.

Last month, a 3-judge appeals court unanimously upheld a lower court’s ruling that found the law to be unconstitutional and to have “no rational basis.”

“We had weighed an appeal to the Florida Supreme Court to achieve an ultimate certainty and finality for all parties,” DCF spokesman Joe Follick told CNN. “But the depth, clarity and unanimity of the DCA opinion – and that of Miami-Dade Judge Cindy Lederman’s original circuit court decision – has made it evident that an appeal would have a less than limited chance of a different outcome.”

FL: Appeals Court Upholds Earlier Ruling: Ban in Gay Adoptions Unconstitutional

In November, 2008, Judge Cindy Lederman ruled that Florida’s ban on gay adoption is unconstitutional. The ruling allowed Frank Martin Gill to move forward with adopting two brothers, ages 4 and 8, who had been in Gill’s foster care since 2004.

In the 53-page 2008 ruling, Lederman wrote: “It is clear that sexual orientation is not a predictor of a person’s ability to parent.” The state of Florida appealed the ruling, and today a Miami appeals court ruled against the state:

“The 3rd District Court of Appeal issued its decision Wednesday affirming a lower court’s decision that the ban is unconstitutional. Florida is the only state with a law flatly banning gays from adopting children without exception. Gays can be foster parents in Florida. A Miami-Dade County judge ruled the gay adoption ban unconstitutional in 2008, but the state appealed. The case will ultimately go to the state Supreme Court. Martin Gill and his male partner, along with the American Civil Liberties Union, filed the lawsuit in their attempt to adopt two brothers, whom they have cared for as foster children since December 2004.”

Brazil: 51% Oppose Gay Adoption, 39% Support It, New Poll Says

Half of people in Brazil oppose allowing gay couples to adopt children, according to a poll by Datafolha published in Folha de Sao Paulo. 51 per cent of respondents share this opinion, while 39 per cent disagree.

In April, the Superior Court of Justice of Brazil issued what it called “a historic” ruling which allowed a lesbian couple to retain custody of two girls that one of the partners had adopted. While the unanimous ruling does not mean that Brazilian states have to permit adoptions by same-sex couples, it sets a precedent for future decisions and prevents legislation that would directly ban these adoptions.

Brazilian President Luiz Inacio Lula da Silva has long voiced supports for same-sex civil unions, but legislators have voted down initiatives that would allow them.

Malta: Parliament Committee Talks About Gay Rights

What happens in the bedroom is, up to a point, the government’s business, because it often had to solve problems caused there, the chairman of the House Social Affairs Committee, Edwin Vassallo said.

Speaking during a sitting on Tuesday where the Malta Gay Rights Movement gave a presentation to the committee on the situation of homosexuals and transgender individuals in Malta, Mr Vassallo said: “What we’re learning in this committee is that what happens in the bedroom often ends up before the state to do something about it.” As examples, he cited single parents and teenage pregnancies.

The MGRM’s Gabi Calleja presented to the committee a 2008 report detailing problems gay people faced in Malta. One of the major topics was the issue of homosexual couples and children. Even though Malta did not allow adoption by gay couples, Ms Calleja said “we’re creative and still find a way to have children”. These methods included surrogacy, artificial insemination and IVF and also intercourse with a member of the opposite sex.

Denmark: Parliament Passes Bill Allowing Gay Adoption

Danish parliament passed a vote giving equal adoption rights to couples in registered partnerships yesterday, but without the support of the government. The opposition, together with breakaway members of the government’s Liberal Party, voted in favour of the legislation which will allow all same sex couples in registered partnerships the same adoption rights as married couples from 1 July.

Danish homosexuals could previously adopt as individuals or adopt the children of their partner under the step-child adoption laws. Figures from Statistics Denmark show that of the 712 step-child adoptions in 2007, 103 were from couples in a registered partnership.

The Liberal-Conservative government was left in a difficult position, being forced to introduce a legislative bill without backing it.

LA: Senate Kills Gay Adoption Bill

The Louisiana Senate Judiciary Committee killed a bill yesterday similar to the one proposed in the House by Rep. Juan Lafonta, which I posted about last week, that would have allowed gay parents to adopt children together, the AP reports:

Senators on the Judiciary A Committee voted 3-1 against the bill, siding with opponents from Catholic, Baptist and other church groups who argued the adoptions would encourage immoral behavior and violate the spirit of a voter-approved constitutional ban on gay marriage.

“What these children will learn from structures which are not moral or spiritual will only hurt them,” said Willie Wooten, a minister and founder of Gideon Christian Fellowship in New Orleans.
