IL: Man Sues to Overturn Springfield Health Benefits Decision

Springfield, IL Health Benefits and Civil UnionsA lawsuit has been filed by Bruce Rushton, a reporter for the Illinois Times, claiming that the Springfield Joint Labor/Management Health Care Committee voted to grant health benefits to couples in civil unions. Rushton claims that the Committee violated the Open Meetings Act. He hopes to have the decision by the committee declared void.

The Civil Rights Agenda stated in a press release:

The Civil Rights Agenda is currently working with members of the Springfield City Council and other allies to determine the best course of action. The Civil Rights Agenda’s Legal Council confirms that the Committee meeting, held in private with no notice to the public, could in fact be a violation of the Open Meetings Act. While it is unfortunate that this may impede the enforcement of civil union health benefits that should be granted to Springfield city employees, The Civil Rights Agenda must address the larger issues of freedom of speech, freedom of the press, and access to decision-making bodies acting on behalf of the public, which is addressed under the Open Meetings Act.

IL: Springfield Reverses Earlier Decision, Will Provide Health Benefits to Civil Union Partners

Springfield, IL Health Benefits and Civil UnionsThe City of Springfield decided Tuesday to reverse an earlier ruling and voted unanimously to extend benefits for city employees in a civil union.

The Springfield Joint Labor and Management Insurance Committee, which has sole decision making power on matters concerning the city of Springfield’s insurance plan, initially decided to deny benefits to couples in a civil union based on financial concerns.

The Civil Rights Agenda (TCRA) worked with multiple city council members, other interested parties and citizens to ensure that the committee reversed its discriminatory decision.

IL: Springfield Civil Union Cost Estimate Revised

Springfield, IL Health Benefits and Civil UnionsA St. Louis-based actuary says he is revising his estimate that providing benefits to spouses of employees in civil unions would cost the city of Springfield an extra $725,000 a year.

The revision comes as the city’s Joint Labor/Management Health Care Committee on Tuesday is scheduled to reconsider its 10-0 decision not to provide the benefits.

The actuary’s estimate has been questioned by Mayor Mike Houston, who has said he believes the city, which is self-insured, can offer the coverage without a significant increase in premiums.

IL: Springfield Committee to Reconsider Health Coverage After Mayor Announces Support

Springfield, IL Health Benefits and Civil UnionsSpringfield Mayor Michael Houston announced his support for providing health insurance benefits for partners of employees in civil unions at a news conference on Tuesday, Jan. 3.

Mayor Houston’s decision comes as a response to a vote on Dec. 20 by the Joint Labor/Management Healthcare Committee, which voted 10-0 (Ward 1 Ald. Frank Edwards and Ward 9 Ald. Steve Dove were absent) to not provide spousal benefits to city employees who have entered into civil unions. The committee’s decision is largely based on an actuarial estimate of an additional $725,000 in premiums that the city would have to pay for spouses of employees in civil unions.

The city of Springfield is self-insured, a right which is granted by the Illinois Municipal Code. Since its creation in 2002, the committee has acted as the controlling and policy-making body for Springfield’s employee health insurance coverage.

AZ: Governor Brewer Appeals Court Decision, Wants to Throw Gays Off Health Care Plan

Arizona Health BenefitsTwo top state officials are asking the 9th U.S. Circuit Court of Appeals to let Arizona deny benefits to the domestic partners of its gay state and university employees.

Legal papers filed by Attorney General Tom Horne contend a three-judge panel of the appellate court wrongfully concluded earlier this month that it is illegal for the state to provide health care and other benefits to the partners of married workers while refusing to do the same for same-sex couples. He said the state is allowed to make such distinctions.

Horne, who filed the appeal on behalf of Gov. Jan Brewer, also said it is legally irrelevant that Arizona voters constitutionally banned gays from getting married, even though that means they have no legal way to get benefits for their partners.

MI: GOP Tries to Drop Gay Partner Health Benefits Again

Michigan Gay Partner BenefitsA pair of measures is due for consideration and a vote in the Michigan House of Representatives on Thursday that would eliminate health care benefits for unmarried partners of public employees.

The language contained in both measures specifically prohibits any state government entity in Michigan from providing the health care benefits, and would also prohibit unions from including similar benefits in collective bargaining agreements.

According to the advocacy group Equality Michigan, Rep. Dave Agema (R-Grandville) and the State Attorney General, Bill Schuette, both of whom have publicly stated their opposition to LGBTQ equality rights, have been trying to strip away health care benefits for same-sex couples since February.

DOJ Switches Sides, Supports Lesbian Couples’ Health Benefits Claim

The Department of Justice appears to be stepping up its work against the Defense of Marriage Act.

After months of taking vague stands against the 15-year old law’s unconstitutionality, the DOJ offered a more robust and forceful objection in a brief filed yesterday supporting federal court employee Karen Golinski’s lawsuit asking for equal health benefits for her wife.

Golinski’s case had previously been dismissed, although a judge left the door open for more arguments on the matter.

OH: Cleveland Lawmaker Hopes to Extend Healthcare to Gay Partners

Cleveland, OhioA Cleveland city councilman has introduced legislation that would extend healthcare benefits to domestic partners of city employees.

Councilman Joe Cimperman introduced the legislation and said that, although he also knows it will be a hard sell to council members who oppose the bill, it appears he has enough support to see it passed.

Council members were expected to assign the ordinance to at least one city committee, and Cimperman said as many as three — the finance, health and employment, and legislative committees — could consider its merits.

CA: Judge Rejects Lesbian’s Suit for Benefits for Her Wife

Judge Jeffrey WhiteWithout weighing in on the constitutionality of the Defense of Marriage Act or addressing the Obama administration’s changing position on gay marriage, U.S. District Judge Jeffrey White today rejected a federal court employee’s effort to get federal health benefits for her wife.

The judge, however, gave Ninth Circuit U.S. Court of Appeals staff attorney Karen Golinski time to file an amended complaint.

The ruling comes after the Obama administration last month announced that it would stop defending DOMA in certain cases, finding it unconstitutional as applied to legally married same-sex couples. The administration, however, said the executive branch would continue to enforce the law unless it’s repealed — an effort newly under way in Congress.

PA: Allentown Debates Adding Health Benefits for Partners of Gay Employees

Allentown, PAIf you’ve ever listened to the soundtrack of 42nd Street, or picked up a copy of Billy Joel’s greatest hits, you’ve heard of Allentown, Pennsylvania. But beyond just the pop culture lore, the city is gaining prominence as growth from nearby Philadelphia continues to move in its direction.

I have a particular bone to pick with Allentown, as toward the end of the 1990s, the city was in a competition with my hometown (Erie, Pennsylvania) for third most populous city in Pennsylvania. Allentown won, and hasn’t looked back.

But here’s one way that Allentown can earn back some good graces, not only from me but from LGBT residents throughout Pennsylvania’s Lehigh Valley — the city is set to consider offering medical benefits to partners of gay municipal employees. If it adopts the measure, Allentown will become another example of local advances for LGBT equality in the Keystone State, and the first city to offer such benefits in the region.
