CA: 9th Circuit Judges Skeptical of Prop 8 Proponents’ Claims

Prop 8 HearingIn what was likely the last hearing before a ruling is delivered on the constitutionality of Proposition 8, the Ninth Circuit Court of Appeals on Thursday appeared unconvinced that a previous ruling on the ban be tossed because the judge was in a longterm same-sex relationship.

Before the issue of whether former Chief District Judge Vaughn Walker should have recused himself from the 2010 case where he ruled Prop. 8 unconstitutional, the Ninth Circuit dealt with the release of videotapes of that trial. Prop. 8 proponents have been fighting for years to keep the tapes unavailable to the public, while gay rights advocates want the public to see them. Both David Thompson, arguing for the Prop. 8 proponents, and Ted Olson, arguing against Prop. 8 for the American Foundation for Equal Rights, were grilled by Ninth Circuit judges. Thompson made the case that witnesses would be harassed and intimidated should the tapes be made public; judges didn’t seem convinced. Nontheless, they argued with Olson over whether tapes of the trial were necessary when transcripts were available.

Moving to the issue of Walker, it seemed the Prop. 8 proponents had a much bigger mountain to climb. Lawyer Charles Cooper tried to convince the judges that Walker had a stake in the Prop. 8 case, since he was in a longterm gay relationship. The judges questioned whether it was clear Walker wanted to marry, since he didn’t during the brief period when same-sex marriage was legal in California.

Prop 8 HearingOn Thursday, a federal appeals court panel in San Francisco will hear two issues related to the Proposition 8 lawsuit: Whether video of the 2010 trial can be released to the public and whether Judge Vaughn Walker’s decision striking down the anti-marriage equality ballot measure should be vacated because he is gay.

On the latter issue, U.S. district judge James Ware, who took over the case following Judge Walker’s retirement earlier this year, ruled in June against throwing out Walker’s decision. In his order, Ware wrote that it was unreasonable to presume that a judge is biased, as Prop 8 proponents assert Walker is, “solely because, as a citizen, the judge could be affected by the proceedings.”

Prop. 8 supporters, whom the California Supreme Court ruled last month have the right under state law to defend the initiative in court after state officials declined to do so, appealed Ware’s decision to the U.S. Court of Appeals for the ninth circuit, where the case is on appeal.

Rally Tomorrow in San Francisco Before Prop 8 Hearing

Prop 8 HearingOn Thursday, December 8, a three-judge panel in the Ninth Circuit Court of Appeals will hear oral arguments on the efforts to release video of the Prop. 8 trial as well as the anti-gay proponent ProtectMarriage motion to throw out the case.

Same-sex couples allies and family will hold a “Free the Tapes” and “Motion to Marry” rally on the steps of the Ninth Circuit Court of Appeals Building at 1:00 pm on Thursday, Dec. 8, 2011, immediately preceding the Ninth Circuit’s hearing on whether videotapes of the Prop. 8 trial should be made public and whether the trial court’s exhaustive decision invalidating Prop. 8 should be overturned because the trial judge was gay and in a long term relationship. The hearing itself will begin at 2:30 pm and last 2 hours.

The hearing will be delayed broadcast and will have remote viewing that include locations in Pasadena, Portland and Seattle.

CA: Next Prop 8 Hearing Thursday

Prop 8 HearingIn the next few months look for progress in the fight to uphold Judge Walker’s decision to strike down Proposition 8 due to the fact that it is unconstitutional.

On Thursday, December 8, a three-judge panel in the Ninth Circuit Court of Appeals will hear oral arguments on the efforts to release video of the Prop. 8 trial as well as ProtectMarriage’s motion to throw out the case. The hearing is expected to take two hours, beginning at 2:30pm. The hearing will be delayed broadcast and will have remote viewing locations in Pasadena, Portland and Seattle. Thousands of other interested parties on both sides of the issue, including the LGBT community here is Sacramento will follow the hearing’s progress on Twitter and other social media.

On the web site of the American Foundation for Equal Rights, it was explained that in the first hour, Ted Olson will argue that the “public has a First Amendment right to see video footage of the historic Prop. 8 trial. Olson will site that the other side is “trying to keep the video under lock and key because they don’t want anyone to know they failed in court, where reason and facts matter.”

CA: Ninth Circuit Consolidates Prop 8 Cases; Arguments December 8th

Prop 8 HearingThe U.S. Court of Appeals for the Ninth Circuit will be deciding the appeal of U.S. District Court Judge Vaughn Walker’s ruling striking down Proposition 8 as unconstitutional alongside the appeal of U.S. District Court Judge James Ware’s ruling denying the Proposition 8 proponents’ attempt to have Walker’s ruling vacated because they argued he was biased because he is gay and has a partner.

The decision was announced in a one-sentence order issued this afternoon in granting a request from the proponents that the matters be consolidated.

On June 14, Ware ruled that the Aug. 4, 2010, decision by now-retired Judge Walker could not be vacated — as the proponents of Proposition 8 argued in court on June 13 — because Walker is gay and has a partner.

Australia: Groups Air Views on Queensland Civil Unions

Queensland Civil Unions Hearing21 groups spoke at a public consultation on a state civil unions bill in the Queensland Parliament on Thursday. Groups speaking against civil unions included the Australian Christian Lobby (ACL), the Catholic Archdiocese of Brisbane, the Presbyterian Church, Family Voice Australia, the National Marriage Coalition, the Australian Family Association and the Family Council of Queensland.

Groups speaking in favour of the bill included PFLAG Australia, the Anglican Church’s Social Responsibilities Committee, Queensland Association for Healthy Communities (QAHC), Queensland Council for Civil Liberties, the Queensland Anti-Discrimination Commission, the Metropolitan Community Church, the Queensland Law Society, and Australian Marriage Equality (AME).

ACL spokeswoman Wendy Francis claimed Queensland should not be considering civil unions because marriage was a Federal issue, and said civil unions would undermine children’s “right” to begin life with their biological parents.

NJ: Marriage Equality Case to Be Heard Today

New Jersey Marriage EqualityIn the latest attempt to legalize gay marriage in New Jersey, same-sex couples are headed to court today to try to convince a judge their partnerships are more than civil unions.

The couples, defeated in their efforts last year to get the state Legislature to recognize same-sex marriages, turned to the courts to obtain what they say would be true marriage equality.

Superior Court Assignment Judge Linda Feinberg will hear arguments from Garden State Equality, a civil rights organization for same-sex couples, and the state Attorney General’s Office, which is defending New Jersey’s civil union law.

US: Senate Schedules Repeal Vote on DOMA

Defense of Marriage ActVermont Senator Patrick Leahy, the chairman of the Senate Judiciary Committee, has scheduled a vote for a bill that would repeal the Defense of Marriage Act (DOMA), the law that defines marriage for federal agencies and the military as a heterosexual union.

The committee will begin debate on the bill next Thursday, Leahy announced on Tuesday.

“The march for equality continues, and now is the time to ensure equality for gay and lesbian Americans who are lawfully married,” Leahy said in announcing consideration of the bill in the committee. “This is part of the nation’s continuing fight for civil rights for all Americans.”
