NY: Marriage Equality Victory’s Lessons for Immigration Reform

New York Gay WeddingsUltimately, New York enacted gay marriage because the issue became personal. Legislators previously opposed to gay marriage and key Republicans previously uninvolved both moved into the “yes” camp out of personal relationships with gay and lesbian family members. Grassroots activism and Governor Andrew Cuomo’s political savvy joined with people’s unwillingness to discriminate against gays and lesbians who they cared about to dramatically turn the political tide.

The same approach could also create a breakthrough on immigration reform. As New York’s victory was being celebrated, journalist Jose Antonio Vargas’ emotional memoir of his life as an undocumented immigrant (“Outlaw”) appeared in the June 26 New York Times Magazine. On the heels of last fall’s march by four undocumented students in support of the DREAM Act, Vargas’ visceral account of the immorality of current U.S. immigration policy could lead to a wave of undocumented immigrants telling their stories; while this risks deportation, such a powerful strategy appears necessary to personalize the issue and broaden support for reform.

There are obvious differences between the struggles for gay marriage and comprehensive immigration reform. The latter requires federal action, benefits primarily non-whites with much lower incomes and political power, and has far greater electoral implications. Further, while the declining political clout of the Catholic Church reduced opposition to gay marriage, this weakening has also reduced the Church’s power to positively impact immigration reform efforts.

Religious Right Complains About Inclusion of Same Sex Couples in Immigration Reform

Immigration ReformWill the push for same-sex couples in federal immigration legislation strain an ostensibly wide coalition for comprehensive reform? My contention is – government ought not be influenced by religious perspectives at all – hence there should be no religious coalition of support. It should simply be out of the ambit of religious influence. This may seem like Church vs. State 101 – yet it is so far from what is really happening. What is really happening is that our LGBTQ rights are being dictated by the Church and its simply reprehensible!

Mark Tooley writing at The American Spectator, in his piece, Amnesty for Same-Sex Couples, where sets out an analysis of church views, delineating the religious right’s objection to same-sex partners having the basic human right to share their life with a partner of their choice, and the basic constitutional right to pursue happiness with parity under the law. The general excuse for the discrimination is same-sex immigration rights leads to same sex marriage!

The Article starts “Liberal Democratic Senators Robert Menendez of New Jersey and Patrick Leahy of Vermont introduced their ‘Comprehensive Immigration Reform Act’ on September 29 . . . It also includes a ‘Uniting American Families Act’ (UAFA) allowing ‘permanent partners’ of U.S. citizens, which seems to mean same-sex couples, to obtain U.S. residency . . . Speaking for the Catholic bishops, who typically support liberalized immigration, Bishop John Wester of Salt Lake City reportedly wrote Senator Menendez explaining ‘that a controversial provision, which would confer marriage-like immigration benefits to same-sex couples,’ would ‘preclude the U.S. bishops from supporting’ it as introduced.”

Will Immigration Reform Proceed Without Gay/Lesbian Couples?

When gay couples were given the right to marry in the District earlier this year, John Beddingfield and Erwin de Leon were among those who quickly obtained marriage licenses. In April, the Woodley Park couple – who have been together for 12 years – quietly exchanged vows before a justice of the peace.

Yet even as they pledged to stand by each other in sickness and in health, Beddingfield, 46, the rector at All Souls Episcopal Church, and de Leon, 44, a doctoral student from the Philippines, were aware that their marriage still hadn’t guaranteed them the same rights as heterosexual couples. The District recognizes their marriage, but the federal government does not. The country that had given de Leon a home, given him an education and given him Beddingfield would not allow him to start the process of becoming a citizen, even as it extends that benefit to the foreign-born spouses of heterosexual U.S. citizens.

Once de Leon’s student visa runs out next year, he will likely be forced to join the 11 million undocumented immigrants in the United States.

US: Two Democratic Lawmakers Endorse the Uniting American Families Act

Trying to broaden support for immigration reform, key Democratic lawmakers on Thursday will endorse legislation that would grant gay and lesbian Americans the ability to legally bring their foreign partners to the United States.

Rep. Luis Gutierrez of Illinois, Rep. Mike Honda of California and others will urge Congress to pass the Uniting American Families Act this year as part of a comprehensive immigration reform package.

But both Democrats and Republicans are skeptical of that strategy. They warn that introducing a contentious issue just months before the midterm elections could add fuel to the immigration debate and erode support from lawmakers in socially conservative districts.

US: Catholic/Evangelical Groups to Call For Immigration Reform – Without GLBT Provisions

Next week, on June 9th The USCCB (US Conference of Catholic Bishops) and the NAE (National Association of Evangelicals) will run full page ads in various Newspapers to announce that they will be Lobbying in D.C. for Comprehensive immigration reform.

They plan to emphasize their objection to the LGBT immigration equality language that is currently present in the recently introduced Framework for immigration reform. “Part of their lobbying effort will be a push to take the same-sex provisions out of the immigration plan.”

The Catholic Bishops and their brethren in opposition to the recognition of LGBT rights and the continued invalidation of gay families together with the National Association of Evangelicals, (NAE) are joining forces to ensure their ongoing effort against the inclusion of the Uniting American families Act (UAFA) in Comprehensive Immigration Reform (CIR.)

IL: Congressman Now Wants Gay/Lesbian Partners Included in Immigration Bill

Hopes that foreign-born partners of gay and lesbian Americans could follow the same path to citizenship as heterosexual spouses got a boost Thursday when U.S. Rep. Luis Gutierrez of Chicago said he would fight to include such a proposal in the campaign for comprehensive immigration reform.

Six months ago, when Gutierrez first laid out plans to introduce an immigration reform bill in the U.S. House, the inclusion of same-sex partner rights seemed too politically risky. But the Democrat now says he believes the coalition in favor of immigration reform is strong enough to make the bill “truly inclusive.”

“The underlying part of any comprehensive immigration bill is family unity,” Gutierrez said in an interview with the Tribune. “We need to speak more clearly and more articulately and more frequently that the (lesbian, gay, bisexual and transgender) community, and same-sex couples and their binational relationships, are part of families.”
