IN: Marriage Equality Ban Vote in Senate Today

A constitutional ban on same sex marriage — an issue that brought hundreds to protest outside the Indiana State House earlier this week — could be one of the few pieces of legislation that makes it out of this session.

The Indiana House of Representatives passed a resolution on the matter in February. An Indiana Senate committee is scheduled to take up the matter today.

Numerous bills have been stalled as a protest walkout by Democratic legislators continues over labor and education issues. Because the marriage ban is a resolution — rather than a bill — a conference committee between both chambers is not necessary, explained Emily Landis, press secretary for the House Republicans. That means it could be approved without House Democrats returning from their protest. It’s expected to pass as the Senate is heavily controlled by the GOP, which is largely responsible for its passage in the House.

IN: Debate to Begin on Gay Marriage Ban Wednesday

An Indiana Senate panel will begin debate on a resolution that aims to ban gay marriage in the state.

The Senate Judiciary Committee is set to consider the measure, which was approved overwhelmingly by the House with a 70 to 26 vote late last month, on Wednesday. The Senate has approved a similar measure in the past and the bill is expected to face little opposition in the Republican-controlled chamber.

Voters, however, won’t vote on the proposal to alter the state constitution until 2014 at the earliest, after a separately-elected General Assembly approves the resolution. If approved by voters, the amendment would also ban civil unions.

IN: House Passes Gay Marriage Ban Amendment

Indiana Gay Marriage BanThe Indiana House approved a constitutional amendment on Tuesday, Feb. 15 to ban gay marriage and civil unions — a step opponents said was unnecessary since same-sex marriage is already illegal in the state.

Supporters say the amendment would provide an additional layer of protection for traditional marriage in case courts later overturn Indiana’s law. The Republican-controlled House voted 70-26 to advance the proposal, which must clear two separately-elected Legislatures to get on the ballot for a public vote.

“Marriage is — and should be — the union of one man and one woman,” said Rep. Eric Turner, R-Marion.

IN: House Votes to Ban Marriage Equality and Civil Unions

The Republican-controlled Indiana House voted 70-26 today in favor of a constitutional ban on gay marriage. The bill now goes to the Senate for a vote. Republicans also have a majority in the state Senate.

Evan Wolfson, founder and president of Freedom to Marry, urged the Indiana Senate to reject House Joint Resolution 6, a constitutional amendment that would ban not only marriage, but any measure of protections or support for same-sex couples and their families in Indiana.

“Freedom to Marry calls on the Indiana Senate to reject this punitive amendment, which would write discrimination into the state constitution. Government should be on the side of all families, not putting barriers in their paths as they seek to care for their loved ones,” Wolfson said.

IN: Anti Gay Marriage Vote Delayed Until Tuesday

Indiana Gay MarriageA vote in the Indiana House on a constitutional amendment banning gay marriage has been delayed for at least a day.

Resolution sponsor Rep. Eric Turner of Marion said he wouldn’t call it for a vote on Monday because some House members who want to support it were absent for the day. He didn’t specify when he expected a vote.

The proposed amendment stalled in the House under Democratic majorities the last four years, but is expected to advance since Republicans won control of the House in last year’s election.

IN: House May Vote on Anti Marriage Equality Bill Monday

The Republican-controlled Indiana House could vote as early as Monday on a constitutional amendment banning gay marriage.

Opponents say the amendment isn’t needed because Indiana law already bans gay marriage, but supporters worry that courts could overturn that law.

An amendment banning gay marriage passed the General Assembly in 2005 when Republicans controlled the House and Senate, but constitutional amendments must go through two separate Legislatures before being put to a public vote. Democrats won control of the House in 2006 and the proposal never cleared that chamber that year.

IN: Proposed Gay Marriage Ban Would Also Block Civil Unions

Indiana’s proposed constitutional ban on same-sex marriage is poised to become one of the stricter bans in the nation after lawmakers voted Thursday not to take out a clause prohibiting civil unions.

The measure, which must be approved by two separately elected legislatures and by voters, will get an up-or-down vote by the House in the next few weeks. It would add to the state constitution not only the marriage ban but also a ban on anything “substantially similar” to marriage.

Civil unions are not allowed in Indiana, and the ban on “substantially similar” arrangements would not change that. Preserving that authority was one goal cited by supporters of the amendment, proposed by Rep. Terri Austin, which would strike out the “substantially similar” language.

Indiana Anti Gay Marriage BillAn amendment to ban same-sex marriage in Indiana moved forward on Monday, as a House committee voted in favor of sending the bill to the House floor.

Same-sex marriage is already illegal in the state of Indiana, but marriage equality opponents say it needs to be in the constitution.

The state Senate has passed the constitutional ban in recent years, but it has always died in the House, which Democrats controlled up to this year.

IN: Lawmakers Considering Constitutional Ban on Gay Marriage

After last week’s ice storm froze out action in the House and Senate for two days, lawmakers are making up for lost time this week with a hectic schedule of committee hearings.

Among the key issues being debated this week: local government reforms; same-sex marriage; illegal immigration; abortion; and education reforms.

At the same time [today], the House Judiciary Committee will be hearing from those who support and oppose amending Indiana’s state constitution to ban same-sex marriage, civil unions or anything else that grants the same legal rights as marriage.

IN: GOP May Introduce Gay Marriage Constitutional Ban Again in 2011

Indiana Gay MarriageWhile Indiana Gov. Mitch Daniels has called for a “truce” on social issues like same-sex marriage, there are some Indiana legislators ready to put up a fight.

Conservative state lawmakers say they expect to reintroduce legislation in the next session that would clear the way for a constitutional amendment to define marriage as a union between one man and one woman. Indiana already has a law that bans gay marriage but supporters of a constitutional amendment say it would offer protection against court action.

“I’m all for it,” said State Rep. Wes Culver, R-Goshen, co-author of a bill that was blocked by House Democrat leaders when they were in control. “At the least, it needs to come up for a vote.”
