The federal case to decide whether the U.S. Constitution guarantees the right to gay marriage takes a new turn Monday, when lawyers on both sides will for the first time make their arguments before more than just judges. The proceedings will be televised on C-SPAN and be seen in live feeds to law schools throughout the country.
But those arguments – already spelled out in the parties’ court filings and amplified by some 47 friend-of-the-court briefs – will be tailored to just three sets of ears, those belonging to the ideologically diverse panel of appellate judges who will decide whether the case can be appealed, and if so which side should win.
Earlier this year, Chief District Judge Vaughn Walker ruled that the 2008 ballot initiative that changed California’s constitution to ban gay marriage had violated the U.S. Constitution. The backers of the initiative, known as Prop 8, appealed, setting up Monday’s showdown before the Ninth Circuit Court of Appeals.

A staunch California liberal, a conservative Idaho Republican and a moderate Arizona Democrat were announced Monday as the members of the federal court panel that will hear next week’s appeal of a ruling striking down California’s ban on same-sex marriage.
Judges Stephen Reinhardt, N. Randy Smith and Michael Hawkins of the Ninth U.S. Circuit Court of Appeals will hear two hours of arguments next Monday in San Francisco over Proposition 8, the 2008 initiative that defined marriage as the union of a man and a woman.
The panel was chosen by random selection several months ago but was not disclosed until a week before the hearing, a court policy designed to limit the parties’ ability to seek grounds to disqualify the judges.

Former Arkansas Gov. Mike Huckabee said Sunday that Iowa voters likely launched a national movement when ousting three state Supreme Court justices who agreed with a decision to strike a ban on gay marriage.
Huckabee was in Des Moines courting evangelical conservatives who pushed him to victory in Iowa’s leadoff precinct caucuses in the last election.
“The significance and historic nature of the judicial elections here in Iowa were far bigger than the borders of Iowa,” he said. “It was a very important statement that voters made, a statement that resonated across the country and one that I think will give legs to a larger movement over the next few years.”

Sioux City businessman and former GOP gubernatorial candidate Bob Vander Plaats, who spearheaded the successful effort to oust three Iowa Supreme Court justices who ruled in favor of gay marriage, says the remaining four judges should resign, Radio Iowa reported.
Vander Plaats launched the Iowa for Freedom campaign after losing the Republican nomination for governor. His campaign was heavily financed by out-of-state anti-gay marriage groups, including the National Organization for Marriage (NOM), the nation’s most vociferous opponent of gay marriage, the Family Research Council (FRC), and the Christian-based American Family Association (AFA).
NOM had previously worked to repeal gay marriage laws in California and Maine.

All three Iowa Supreme Court justices up for retention election have been ousted from the bench. Around 54 percent of Iowans voted not to retain each of the three judges: Supreme Court Chief Justice Marsha Ternus and associate justices Michael J. Streit and David L. Baker. The campaign for the judges ouster was based on the court’s unanimous 2009 ruling that legalized same-sex marriage in Iowa.
There were 74 judges, including three Supreme Court justices, on the ballot Tuesday. Only the Supreme Court justices, however, came anywhere close to being removed from the bench.
The highly charged campaign featured more than $1 million in spending against the judges from national anti-gay organizations like the Mississippi-based American Family Association, Washington, D.C.-based Family Research Council, Arizona-based Alliance Defense Fund, Georgia-based Faith & Freedom Coalition and New Jersey-based National Organization for Marriage. The campaign culminated in a 20-city bus tour across Iowa.

Voters remain split over the retention of Iowa’s Supreme Court justices, yet a new Des Moines Register Iowa Poll shows more than one-third now want to oust all three. Thirty-seven percent of likely voters say they will vote to remove all three Iowa Supreme Court justices in Tuesday’s election. Thirty-four percent say they will vote to keep all three, and 10 percent plan to retain some.
The poll shows movement toward the ouster of at least one justice, a result unseen in Iowa history since the merit-selection and retention process was adopted in 1962.
On the ballot are Chief Justice Marsha Ternus and Justices David Baker and Michael Streit, who were among seven justices who voted in the unanimous 2009 decision that allowed same-sex marriage, triggering a political uproar.

If event attendees are any indication of ballot totals following midterm elections Tuesday, three Iowa Supreme Court justices up for a retention vote next week will overwhelmingly maintain their seats.
At least 150 people filed through security at the Linn County Courthouse Wednesday afternoon in order to stand in support of the justices, who have been targeted by several national anti-gay groups for their unanimous 2009 ruling that legalized same-sex marriage in Iowa.
An hour later and five blocks east, supporters of the movement to oust the justices numbered 20 – and were nearly matched in numbers by counter-demonstrators. Supporters on both sides view the conflict as fundamental to the fabric of an ideal society, albeit for differing reasons, and emotions ran high when those of opposing views met face to face.

Equality supporters 98, NOM 42. That was the tally at the first stop for the NOM tour bus in Iowa.
NOM simply doesn’t give up, and sadly there has been a lot of money poured into Iowa to get rid of the judges responsible for marriage equality in that state. But the kickoff stop has proven that hate doesn’t draw crowds for Brian Brown or Maggie Gallagher. It’s embarrassing from a PR perspective. Prop 8 Trial Tracker has coverage:
This morning on the steps of the Iowa State Capitol in Des Moines, 98 equality supporters and several media outlets assembled to kickoff the Homegrown Justice Tour, a counter-tour organizing events in cities across Iowa to greet the Judge Bus.

Two Polk County judges are the targets of an automated phone campaign that urges voters to remove them from the bench. The calls to Polk County households advocate a “no” vote for District Judges Robert Hanson and Scott Rosenberg, for their roles in Iowa’s same-sex marriage case.
The one-minute message is financed by the West Des Moines-based Everyday America PAC, which promotes socially conservative values. The phone message opens with a pre-recorded male voice:
“We are concerned citizens of Iowa who believe our great state is in a downward spiral. One aspect of the downward spiral is that of single individuals assuming power to override our will by usurping legislative powers and duties.”

Two Iowa Supreme Court judges defended their ruling in a same-sex marriage case and say opponents are wrong to claim the court was obligated to refer the issue to the state Legislature.
Chief Justice Marsha Ternus and Justice David Baker on Wednesday told the editorial board at The Gazette in Cedar Rapids that opponents misinterpret the Iowa Constitution when they argue the court was wrong in 2009 when it struck down a state law that banned marriage by same-sex couples. Some opponents contend the court was obligated to send the matter back to the Legislature.
Baker says the court would have overstepped its role if it told another branch of government to take up the issue.
