NRA Fires Law Firm Over DOMA Case Refusal

The NRA has joined the state of Virginia in firing the Atlanta-based law firm King & Spalding. According to the NRA, the organization has no official position on DOMA.

In a letter dated today to King & Spalding chairman Robert Hays, NRA general counsel David Lehman said the firm’s decision was “indefensible” but emphasized that the NRA’s action in dropping King & Spalding is “not motivated by any position on the statute itself.”

Virginia: AG Fires Law Firm That Dropped DOMA Defense Case

Virginia AG Ken KuccinelliVirginia’s Attorney General, Ken Cuccinelli, says he has terminated that states relationship with King & Spalding, the Atlanta law firm that suddenly dropped the U.S. House of Representatives Defense of Marriage Act defense case.

Earlier this month, Speaker John Boehner hired the law firm to defend the Defense of Marriage Act, or DOMA, after the Obama Administration refused to do so saying they believed to be unconstitutional.

K&S then came under incredible pressure to pull out by LGBT rights groups.

Taking the DOMA Lawsuit Divided Management, Staff at King and Spalding

The law firm King & Spalding stunned many observers Monday by abruptly withdrawing from representing the federal Defense of Marriage Act (DOMA) — barely a week after coming under fire for signing on to defend the law on behalf of House Republicans. But the real shockwaves may have taken place within the firm, where, according to one insider, employees were at each other’s throats over its decision to take on the case.

A source at the firm described the “mayhem” that ensued after employees learned King & Spalding agreed to defend DOMA.

“Management was divided, people were threatening to quit,” the source said. In addition, it was unclear if members of the firm’s Diversity Committee had been consulted ahead of time about taking on the case.

King & Spalding Drops DOMA Case, Lawyer Jumps Ship to New Firm That Takes on Case

As a follow on to Joe’s earlier post, I wonder whether Paul Clement, the Bush administration lawyer who agreed to John Boehner’s request to defend the DOMA case, would be all high and mighty about defending segregation or anti-miscegenation laws.

“My thoughts about the merits of DOMA are as irrelevant as my views about the dozens of federal statutes that I defended as Solicitor General,” he wrote in the letter. “Instead, I resign out of the firmly-held belief that a representation should not be abandoned because the client’s legal position is extremely unpopular in certain quarters. Defending unpopular positions is what lawyers do.”

Speaking of his new firm, Clement said: “They put clients first and deliver results,” he said in the statement. “Bancroft offers its clients premier talent, without all the baggage of a mega firm. We are shaking up the D.C. legal establishment.”

Defense of Marriage ActKing & Spalding is the law firm that is being paid to defend DOMA even though the President and our Attorney General have decided to agree with the Courts that – The Defense of Marriage Act is unconstitutional and hence the related appeals and cases should not be defended.

King & Spalding is an international law firm with more than 800 lawyers in Abu Dhabi, Atlanta, Austin, Charlotte, Dubai, Frankfurt, Geneva, Houston, London, New York, Paris, Riyadh (affiliated office), San Francisco, Silicon Valley, Singapore and Washington, D.C. Speaker Boehner is retaining a $250 -$450 per hour attorney, Paul Clement – from King Spalding to defend the DOMA cases.
