Group Challenges Anti Gay Law in Northern Cyprus

A case has been lodged at the European Court of Human Rights against Turkey today to decriminalise homosexuality in Northern Cyprus.

The move, by the Human Dignity Trust, follows reports that Northern Cyprus’s anti-gay law continues to be employed despite assurances given by its leader that it would be repealed.

Cyprus was required by the ECHR to decriminalise consensual sex between consenting adults in 1993, but in the Turkish-occupied part of Northern Cyprus, homosexual acts are still illegal.

Kansas Group Seeks Repeal of Anti Gay Sex Law

Kansas Gay Sex LawWhen Gov. Sam Brownback last year issued his first executive order, which created the Office of the Repealer, he said he wanted to get rid of laws that were unreasonable, unduly burdensome, duplicative, onerous or in conflict.

Such laws, Brownback said, “are detrimental to the economic well-being of Kansas; hinder the growth of liberty and opportunities for Kansans and Kansas businesses; and defy a common-sense approach to governance. … ”

The Kansas Equality Coalition, a group that advocates for lesbian, gay, bisexual and transgender rights, wants to hold Brownback to his word.

Could Spain Lose Its Marriage Equality Law?

Six and a half years after Spain passed a law allowing marriage between same sex couples, could Spain be about to turn its back on LGBT equality?

Many Spaniards fear the possibility that the country will become the first to withdraw that right if, as expected, Spain elects a conservative Partido Popular (PP) led government in November’s elections.

Benigno Blanco, president of the Spanish Family Forum, a conservative lobby group, has asked the PP to repeal the law.

Ireland: Partnership Law Takes Effect Today

Ireland Civil PartnershipsNew laws allowing same-sex couples to register their civil partnership have received a mixed reception as they come into force today.

The Gay and Lesbian Equality Network (Glen) described the Civil Partnership Act as a “new dawn” for gays and lesbians in Ireland, but another group condemned the Government’s failure to give full marriage rights to same-sex couples.

LGBT Noise criticised the lack of parental rights for homosexuals and called on the Government to follow the example of other countries and “open up the choice of civil marriage to all citizens”.

Philippines: Lawmaker Calls for Gay Anti-Discrimination Law

PhilippinesHOMOPHOBIA has put the lesbian and gay rights in the Philippines in the backseat, a lawmaker said Saturday. Rep. Kaka Bag-ao of Akbayan party-list, the principal author of House Bill 515, or the Act prohibiting discrimination on the basis of sexual orientation and gender identity and providing penalties, noted that such homophobia is stirred by the fact that the country has no standing policy on human rights abuses against lesbians, gays bisexual and transgenders (LGBT).

“Here in the Philippines, you can fire a gay or lesbian employee simply because of their sexual orientation or gender identity and get away with it. You can expel lesbian and gay students arbitrarily or impose arbitrary rules against them and you won’t face any charges. It’s wrong,” Bag-ao said.

Without any enabling law, Bag-ao noted that the constitutional rights and freedoms of LGBTs can be easily violated and discrimination against LGBTs goes unpunished.

IL: The Ins & Outs of the New Civil Unions Law

Wednesday the Illinois legislature passed the Illinois Religious Freedom Protection and Civil Unions Act. Once the Governor signs it (he says he will), it’ll become law. Here’s how it works:

Who Can Enter a Civil Union: Any 2 people who are 18 or older, including straight couples. The law says a union can be between “2 persons of either the same or opposite sex.” However, just as with marriage, certain people cannot enter into a civil union. These include siblings, first cousins, nephews and nieces, or those already married or already in a civil union. It appears that people from another state can travel to Illinois and enter into a civil union if they wish. However, the civil union can only be dissolved in Illinois.

Rights Compared to Marriage: People in a civil union will be given the same rights as people married.

Lithuania: Gay Youth Group Takes Parliament to Task for Homophobic Bill

Lithuanian parliamentarians have a complete disregard for human rights and democracy, the Tolerant Youth Association (TJA) have charged in the wake of Friday’s 31-7 vote in the Seimas (Parliament) in favour of a Bill to make “the promotion of homosexuality” an offence punishable by fine of 2,000 to 10,000 litas (£500 to £2,500).

“Once again, the Lithuanian parliamentarians are demonstrating their complete disregard for human rights and the values of democracy,” Artūras Rudomanskis, chairman of a Lithuanian NGO, the Tolerant Youth Association, told UK Gay News last night.

“It’s yet another sign of the new round of homophobic legislation that might be coming,” he added.

NH: GOP May Try to Repeal Gay Marriage Law in 2011

Portsmouth-Newington state Rep. Jim Splaine said an effort in the Legislature next session to repeal the state’s gay marriage bill is afoot, with three bills already filed.

Splaine was speaking to students in a family programs and policy class at the University of New Hampshire on Thursday night. Professor Malcolm Smith invited Splaine, a Democrat and sponsor of the gay marriage bill signed in June 2009.

Splaine said in primary voting last week, seven Republicans who had been supportive of gay marriage faced competition from more conservative Republicans, and two of the seven were defeated.

FL: Appeals Court Upholds Earlier Ruling: Ban in Gay Adoptions Unconstitutional

In November, 2008, Judge Cindy Lederman ruled that Florida’s ban on gay adoption is unconstitutional. The ruling allowed Frank Martin Gill to move forward with adopting two brothers, ages 4 and 8, who had been in Gill’s foster care since 2004.

In the 53-page 2008 ruling, Lederman wrote: “It is clear that sexual orientation is not a predictor of a person’s ability to parent.” The state of Florida appealed the ruling, and today a Miami appeals court ruled against the state:

“The 3rd District Court of Appeal issued its decision Wednesday affirming a lower court’s decision that the ban is unconstitutional. Florida is the only state with a law flatly banning gays from adopting children without exception. Gays can be foster parents in Florida. A Miami-Dade County judge ruled the gay adoption ban unconstitutional in 2008, but the state appealed. The case will ultimately go to the state Supreme Court. Martin Gill and his male partner, along with the American Civil Liberties Union, filed the lawsuit in their attempt to adopt two brothers, whom they have cared for as foster children since December 2004.”

CA: Senate Dumps Gay “Cure” Law From the Books

The California state senate passed measures Monday to reverse an archaic law that requires the state mental health agency to research “cures” for homosexuality, and to call on President Barack Obama and Congress to repeal the Defense of Marriage Act. According to the Associated Press, Sen. Roy Ashburn (pictured above), who came out this year after a drunk driving incident involving a gay bar, carried the bill to reverse the gay “cure” law, which the assembly already approved. It passed on a 36-0 vote with no debate.

“The law passed in 1950 classifies gays as sexual deviants,” reported the AP. “It requires the Department of Mental Health to research the causes and potential cures for homosexuality.”

The senate also approved a resolution already passed in the assembly calling on the president and federal lawmakers to repeal the discriminatory DOMA. The vote was 22-12, according to the AP.
