Senators Plan to Offer Stand-Alone Don’t Ask Don’t Tell Repeal Bill

Don't Ask Don't Tell RepealTwo senators said they will introduce a separate measure to repeal a U.S. ban on gays serving openly in the military after Democrats yesterday failed to get enough votes for the Senate to consider the legislation.

Senators Joe Lieberman, a Connecticut independent, and Susan Collins, a Maine Republican, will jointly introduce a stand-alone proposal to end the :don’t ask, don’t tell” policy, they told reporters yesterday in a news conference.

The 57-40 vote fell short of the 60 senators needed for the chamber to take up a defense spending bill that included the repeal. Senate Majority Leader Harry Reid, a Nevada Democrat, said he couldn’t reach agreement with Republicans on terms that would have allowed debate of the broader spending legislation.

Malta: Legislation Proposed to Simplify Sex Change Registration

Labour MP Evarist Bartolo is to present a Private Member’s Bill that would make it easier for trans-gender people to change the gender annotation on their official documents, without having to undergo a lengthy and intrusive court process.

The draft Bill was prepared by the Malta Gay Rights Movement and announced this morning by its president, Gaby Calleja. The Gender Identity Act, as the draft bill has been called, aimed to minimise the legal problems which trans-gender people have, Ms Calleja said.

At present, anyone who wishes to change the gender shown on his birth certificate must file an application in court. Such persons must be single.

IL: Senate Vote on Civil Unions Bill Today?

Gay and lesbian couples in Illinois are a big step closer to having their unions legally recognized by the state after the Illinois House Tuesday passed an historic civil rights bill. The Illinois Religious Freedom Protection and Civil Union Act (SB 1716), co-sponsored by openly gay Rep. Greg Harris (D-Chicago), passed to cheers in the chamber by a 61-52 majority vote.

The crucial piece of legislation now moves to the Illinois Senate for a vote that could happen as soon as today.

The Senate, which is expected to pass the bill, has until Dec. 2 to vote. Illinois Gov. Pat Quinn will then sign it into law, taking effect July 2011.

Australia: NSW Will Probably Wait Until After Election to Consider Gay Marriage

Australia Gay MarriageWhile the issue of gay marriage has become a state election issue in Victoria, a bill is on the table in Tasmania and another proposed in South Australia, NSW may need to wait until after its election next year before anything similar comes about. The tri-state moves follow two constitutional law experts’ advice that while the federal Government excludes same-sex couples from marrying, “the [Marriage] Act says nothing about such unions if recognised by state law”.

There are only three scheduled weeks of Parliament left before it rises ahead of the NSW poll on March 26, but the last week is tipped to be canned by the Government so election campaigning can begin. Australian Marriage Equality (AME) national convenor Alex Greenwich is scheduled to meet with Sydney MP Clover Moore this week to discuss a strategy following her questions in Parliament to the state Government on the issue last month.

According to a spokesperson for Moore the NSW Attorney-General John Hatzistergos has not “indicated any interest” on the issue and doubts a response will be received before Parliament rises. Moore asked the Government in October whether it had sought advice or assessed the legal options for same-sex marriage in NSW and what action it “would provide for improved recognition of same-sex relationships and marriage”.

IL: Governor Quinn Pushes for Civil Unions Vote in Lame Duck Session

IL Governor Pat QuinnIllinois Governor Pat Quinn is making good on a campaign promise to back a bill that recognizes gay and lesbian couples with civil unions. According to the Chicago Sun-Times, Democratic leaders, including Quinn and Senate President John Cullerton, are looking to bring the bill up for a vote during the veto session that begins Tuesday.

Openly gay Illinois State Representative Greg Harris’ civil unions bill passed out of committee in the spring, but lawmakers have yet to vote on it.

Quinn said during the campaign that he wanted to sign the bill into law before the end of the year.

Australia: Greens Ready Gay Marriage Legislation in South Australia, Too

Australia Gay MarriageThe Advocate reports that a coalition of Green and Labor Party legislators are readying a marriage equality bill for the state of South Australia.

Tammy Franks of the Green Party and the Labor Party’s Ian Hunter will formally announce their plan to the state parliament. A similar bill was recently introduced in Tasmania, and one is waiting in the wings in Victoria.

Hunter said in a statement, that while it will be more difficult to pass nationwide legislation to legalize marriage equality regional bills could be effective.

Lithuania: Parliament Considering Ban n “Public Promotion” of Homosexuality

Lithiania Gay RightsLithuania’s parliament, the Seimas, is considering legislation to criminalise “promotion of homosexual relations in public places,” says the Lithuanian Gay League.

One bill says that “a person promoting homosexual relations in public places is committing a criminal offense which is punishable with community work or a fine or imprisonment.” Another says that “the promotion of homosexual relations or financing of the promotion in public places is to be punished by a fine from 1,000 ($400/£270) to 5,000 litas.”

“If these amendments are ultimately adopted, the Lithuanian government will have the authority to prosecute on an extremely wide variety of actions and activities,” LGL said.

Uganda: “Kill the Gays” Bill May Be Close to Approval

UgandaDavid Bahati, the sponsor of Uganda’s “kill gays” bill, says the proposal is close to being made law. “We are very confident because this is a piece of legislation that is needed in this country to protect the traditional family here in Africa, and also protect the future of our children,” said Parliament member David Bahati.

Approximately a year ago the bill was introduced. There was wide world condemnation and it was eventually shelved. Bahati insists he’s been doing the behind the door work to make the bill a reality, which according to him is soon.

“Every single day of my life now I am still pushing that it passes.”

IL: If GOP Candidate Becomes Governor, Civil Unions Legislation is Dead

Illinois Gay MarriageIf gay rights groups want to make civil unions the law of the land in Illinois, they might have a tight window in which to get it done. The epic saga to guarantee the LGBT community with many of the same legal protections straight couples take for granted is coming to a head. Gov. Pat Quinn is supportive of State Rep. Greg Harris’ (D-Chicago) legislation (SB 1716), which would provide same-sex couples with all the “benefits afforded or recognized by the law of Illinois to spouses.” If approved, gay partners could sit bedside with their loved one in the hospital, receive survivor benefits, and be given authority to help make end-of-life decisions.

On the Democratic incumbent’s campaign website, there’s a lengthy LGBT section where he states that committed same-sex couples deserve “basic recognition rights.” A few weeks ago, Quinn told the Daily Herald editorial board that “the votes are there” to legalize civil unions this year. It’s a bill he would like to sign “earlier” rather than later.

GOP gubernatorial nominee Bill Brady is of a different mind. When asked to clarify his position on gay rights last week, the Republican promised to veto SB 1716 if he’s elected governor on November 2 and the bill lands on his desk next year. That’s not surprising; just days after winning the GOP nomination, he introduced a constitutional amendment (SJRCA 95) that would have forbidden same-sex marriage or civil unions. (He took his name off the bill shortly thereafter.) Just this month, he defended his dissenting vote in 2004 on legislation banning discrimination against gays and lesbians in matters of housing and employment. “I don’t think we should have special legislation,” he opined.

Religious Right Complains About Inclusion of Same Sex Couples in Immigration Reform

Immigration ReformWill the push for same-sex couples in federal immigration legislation strain an ostensibly wide coalition for comprehensive reform? My contention is – government ought not be influenced by religious perspectives at all – hence there should be no religious coalition of support. It should simply be out of the ambit of religious influence. This may seem like Church vs. State 101 – yet it is so far from what is really happening. What is really happening is that our LGBTQ rights are being dictated by the Church and its simply reprehensible!

Mark Tooley writing at The American Spectator, in his piece, Amnesty for Same-Sex Couples, where sets out an analysis of church views, delineating the religious right’s objection to same-sex partners having the basic human right to share their life with a partner of their choice, and the basic constitutional right to pursue happiness with parity under the law. The general excuse for the discrimination is same-sex immigration rights leads to same sex marriage!

The Article starts “Liberal Democratic Senators Robert Menendez of New Jersey and Patrick Leahy of Vermont introduced their ‘Comprehensive Immigration Reform Act’ on September 29 . . . It also includes a ‘Uniting American Families Act’ (UAFA) allowing ‘permanent partners’ of U.S. citizens, which seems to mean same-sex couples, to obtain U.S. residency . . . Speaking for the Catholic bishops, who typically support liberalized immigration, Bishop John Wester of Salt Lake City reportedly wrote Senator Menendez explaining ‘that a controversial provision, which would confer marriage-like immigration benefits to same-sex couples,’ would ‘preclude the U.S. bishops from supporting’ it as introduced.”
