MD: Equality Leaders Urge Patience Until Time is Right for Gay Marriage Bill

When Attorney General Douglas Gansler issued his February opinion recognizing same-sex marriages from out of state, it made Maryland the next state to watch on gay marriage. The prediction seems logical in a state dominated by Democratic voters and legislators, many of them liberal-leaning. But far from calling a victory, advocates are counting on a counterintuitive strategy: Stalling.

That’s because a referendum is likely to follow passage of any new marriage law, and voters have not favored gay marriage in states where a popular vote was held. Advocates here want to put off that possibility until public opinion moves more in their favor.

In more than a decade of bills on same-sex marriage, none have passed the General Assembly. And as Maryland follows the trajectory of states that have legalized gay marriage, advocates may not want a vote anytime soon.

MD: State Legislature Considers Repeal of Sodomy Laws (Southern Maryland

One of these romantic spring nights, you and your spouse, in the heat of passion, might be committing a felony – an uncomfortable legal position that the sponsor of a bill heard Thursday is trying to correct. Maryland’s criminal code (27§553) includes two sections on sodomy and “unnatural or perverted sex practices,” both of which can carry a 10-year prison sentence.

The laws are not typically enforced in cases of private contact between consenting adults. But Delegate Frank M. Conaway Jr., D-Baltimore, wants to change the code’s language to specifically protect consensual sex acts between adults.

A giggling House Judiciary Committee heard testimony Thursday on the bill. “It’s a very touchy subject,” Conaway said.

MD: Gay/Lesbian Couples Flock to DC for Weddings

Dupont Circle on a recent sunny afternoon: Workers on lunch break gather for impromptu picnics; others relax on park benches, drawn by the springlike warmth. And under one budding tree, barely noticed by a passing stream of pedestrians, Baltimore residents Jessica Leshnoff and Holly Beatty prepare to wed.

We gather today to marry Jessica and Holly. This is your time; this is your day. Today you once again declare your love and commitment to each other: this time sanctioned not only by your love, your vows and your solemn commitment, but by the law.

With these words officiant Todd Waymon of the Washington Ethical Society begins a simple ceremony that will grant the women the legal recognition they’ve yearned for during nine years together. Looking on are five friends and Leshnoff’s 88-year-old great-uncle Ben, who’s come from Florida.

MD: House Delegate Warns “Heterosexualness is in Danger” Because of Gay Marriage Bill

This week the state of Maryland was embroiled in the battle for marriage equality as committees in the state’s house and senate heard arguments in favor of and opposition to same-sex marriage. On Wednesday a senate committee heard testimony on a proposal to legalize same-sex unions in the state and one to deny recognition to those authorized by other states, the Associated Press reported.

“I do believe that if any law were proposed to legalize gay marriage, it would not pass the Maryland senate, and if it did, I believe it would be petitioned to referendum,” senate president Thomas V. Mike Miller said. “I don’t think we’re going either forward or backward on either bill.”

On Thursday members of the house of delegates argued over the issue, The Washington Examiner reported. A bill to legalize same-sex marriage and one to amend the state’s constitution to prevent such unions are before the house. “Heterosexualness is in danger,” said Del. Emmett C. Burns Jr., a Democrat from Baltimore County. “I never thought I would live to see this day.”

MD: Senate Holds Hearings on Opposing Gay Marriage Bills

Gay marriage advocates in Maryland urged state lawmakers Wednesday to follow the lead of nearby Washington, D.C., where same sex couples were applying for marriage licenses for the first time.

The Maryland Senate’s Judicial Proceedings Committee had hearings scheduled on one bill that would legalize gay marriage in Maryland and another that would invalidate a recent attorney general opinion and prohibit the state from recognizing same sex marriages authorized by other states. Maryland Attorney General Doug Gansler said last week in a long-awaited opinion that state agencies must now recognize out-of-state gay marriages until the Legislature or courts decide otherwise. In addition to the District of Columbia, same sex marriage is legal in Connecticut, Iowa, Massachusetts, New Hampshire and Vermont.

Baltimore resident Donna Martin says she married her wife in California in 2008 before voters there repealed laws that permitted gay marriage. “We knew when we got married that we would be coming back here with no rights as spouses,” Martin said. “We’re here today to try to push that idea along so that people in Maryland can have the same rights as people in other states do.”
