MI: GOP Falls Short on Domestic Partner Repeal Vote

Michigan Domestic PartnershipsMichigan lawmakers have failed to repeal a policy providing domestic-partner benefits to state employees, largely assuring the policy will go into effect, the Lansing State Journal reports.

A proposal to rescind the policy failed to receive the required two-thirds vote in the house of representatives Thursday. Sixty-six members voted in favor of repeal, eight short of the number needed. A repeal measure had passed the senate by the required margin.

The state Civil Service Commission had approved the policy in January, affirming an agreement Jennifer Granholm had negotiated with state employee unions while she was governor. It extends health care benefits to the same-sex partners of state employees as well as any other adult living in an employee’s household, and it applies to both unionized and nonunion workers. The state employs about 35,700 people.

MI: House Lacks Votes to Repeal Domestic Partner Benefits

Michigan Gay Partner BenefitsChange.org is reporting that, for the moment, the Michigan House does not have enough votes to strip away domestic partner benefits for lesbiana nd gay state employees. They need a 2/3rds majority- or the need eleven Democrats to side with them. They report:

All is not over yet. As GOP leader Jase Bolger’s office stated: “We understood there would not be enough Democrats voting yes on the resolution; we need 11 to join the 63 Republicans prepared to approve the resolution.

We have until April 18 to address this issue. We are giving the House Democrats more time to think about standing up for taxpayers by overturning the Civil Service Commission’s irresponsible actions before we put this up for a vote again.”

MI: GOP Fails to Overturn Ruling Granting Benefits to Partners of Gay State Employees

Michigan Gay Partner BenefitsThe partners of unmarried state employees will continue to receive benefits from the state after the House was unable to repeal the ruling which created them.

The Michigan Civil Service Commission granted the benefits, which can go to unmarried straight or gay couples or even roommates if one works for the state.

Several majority Republicans in the House were unhappy they weren’t able to get a supermajority to overturn the ruling. Republicans are expected to continue their efforts to rescind the ruling before it takes effect on April 18th.

MI: GOP Trying to Repeal Domestic Partner Benefits for State Employees

The Michigan senate has taken the first step toward overturning a state commission’s ruling granting domestic-partner benefits to state employees, the Lansing State Journal reports.

The senate reforms, restructuring, and reinventing committee Wednesday approved a resolution that would overturn the state civil service commission’s January ruling that extended health benefits to state workers’ same-sex partners and other household members. The measure now goes to the full senate; it will take a two-thirds majority vote in both the house and senate to override the ruling.

Proponents of the repeal say it’s not a social issue but a matter of money. “We don’t have the funds to cover a benefit that could be in the tens of millions of dollars,” said Jan Winters, director of the Office of the State Employer. Winters estimated the benefits would cost $8 million the first year and more thereafter.

MI: GOP Lawmaker Wants to End Commission that Recommended Partner Benefits for State Employees

GOP Representative Peter LundThe Michigan Civil Service Commission on Wednesday voted in favor of extending health benefits to the domestic partners of gay and lesbian state workers, prompting a Republican lawmaker to call for abolition of the commission, the Detroit Free Press reported.

The commission voted 3-1 in favor of extending the benefits to more than half of the state’s civil servants.

The plan was approved over the concerns of Governor Rick Snyder’s administration, which argued that the state could not afford the benefits. Michigan is facing a $1.8 billion budget shortfall.

MI: Partners of State Employees Can Receive Benefits

Michigan CapitolThe Michigan Civil Service Commission has decided to allow benefits for domestic partners of state employees.

Previously, only legal spouses were allowed benefits from the state.

A spokeswoman for Equality Michigan, a lesbian, gay, bisexual and transgender advocacy and anti-violence organization, said in a news release Monday that the organization applauds the commission’s decision.

MI: New Poll: Voters Opposed to Marriage Equality 50.2% to 38.5%

Michigan voters are much more optimistic about the direction the state is headed compared to just a few short months ago, according to the latest poll conducted by WDIV-TV and the Detroit News.

By a margin of 38.5%-50.2%, Michigan voters oppose allowing gay men and lesbians to get married. 54.9% of Democratic voters support gay marriage, 42.3% of Independent voters support gay marriage, but only 19.6% of Republican voters support gay marriage.

But when asked if they support granting the alternative of civil unions to provide the legal benefits of marriage while still preserving the word marriage as something between a man and a woman, voters support civil unions by a margin of 55.7%-36.5%.

63.7% of Democratic voters, 61.1% of Independent voters and even 44.3% of Republican voters said they could support civil unions for gay and lesbian Michiganders.

MI: Transgender Man and Fiancee Denied Marriage License

Transgender Man in MichiganThis occurred in Pontiac, Michigan. Via Michigan Messenger with video from the local Fox affiliate:

“Jordan Swan, who is a female to male transgender man, says he went to the Oakland County Clerk this week to marry his fiancee. The two paid for their marriage license, swore their oaths and signed on the dotted line. Then they were off to the chapel to get married… or so they thought. Swan tells Fox 2 News that shortly after the happy couple left the clerk’s office they received a call telling them they had to return to the offices to get a refund for their marriage license fee. The reason they were offered when they got to the offices? Swan is not a man because he doesn’t have a penis.”

Unfortunately for the county officials, it’s the penis that makes the man.

MI: Plan for Health Coverage of Same Sex Partners Tabled

The Michigan Civil Service Commission has postponed action on a proposal that would have allow same-sex partners or other adults living with state employees to be covered by state-paid health insurance.

The administration of Michigan Gov. Jennifer Granholm had been pushing a plan Wednesday that would have allocated nearly $6 million next year to extend health insurance benefits to unmarried same-sex partners of state employees, plus the partner’s dependents.

However the commission delayed action on the proposal after hearing concern about a lack of clarity in agreements between the Office of State Employer and employee unions.

MI: AG Assistant Who Harassed Gay Student is Fired

An assistant state attorney general accused of harassing the gay student assembly president at the University of Michigan was fired Monday. Andrew Shirvell, 30, went on leave about a month ago after national criticism erupted over a blog he wrote characterizing student leader Chris Armstrong as a “racist” and a “liar” who promoted a “radical homosexual agenda.”

Shirvell’s attorney has said his actions were constitutionally protected as free speech. Shirvell had attended the first day of a disciplinary hearing Friday and expected that hearing to continue later this week, but then was called in and fired.

Cox said the firing came after a state investigation revealed that Shirvell “repeatedly violated office policies, engaged in borderline stalking behavior and inappropriately used state resources. To be clear, I refuse to fire anyone for exercising their First Amendment rights, regardless of how popular or unpopular their positions might be,” Cox said in a statement.
