MN: Solicitor General Asks Judge to Throw Out Gay Marriage Ban Lawsuit

Minnesota Gay MarriageMinnesota’s solicitor general says a 1971 state Supreme Court ruling that banned gay marriage is still strong enough that a judge should dismiss a Hennepin County lawsuit seeking to let gays marry in Minnesota.

Three same-sex couples sued in May to overturn the 1997 Minnesota ban on gay marriage with a claim that it violates their rights to due process and equal protection under the state constitution.

But the Star Tribune reports that Solicitor General Alan Gilbert on Friday argued the lawsuit should be dismissed because the Minnesota Supreme Court ruled in 1971 that a male couple barred from marrying were not deprived of equal protection.

MN: Judge Rejects Minnesota Family Council’s Intervention in Marriage Equality Lawsuit

A judge has rejected an attempt by the Minnesota Family Council to intervene in a lawsuit challenging state law that bans same-sex marriage. Three same-sex couples filed a lawsuit against the state of Minnesota earlier this year arguing that the Defense of Marriage Act signed into law in 1997 violates the state Constitution.

The Family Council argued that it should be part of the lawsuit, in part, because if DOMA is ruled unconstitutional, it will cost them millions to fight same-sex marriage. The court said the group has no standing to defend DOMA.

Peter J. Nickitas, the Attorney for the couples, said, “This decision is a great victory for the plaintiffs and their families, marriage equality, and the integrity of the court system.”

NJ: Maplewood Passes Domestic Partner Ordinance

The city of Maplewood has passed a domestic partnership ordinance that would allow same-sex couples to register with the city.

City council member James Lanas said the measure makes Maplewood the sixth city to do so in Minnesota. He said he thought it indicated the city’s respect for gay and lesbian residents.

Lanas said opponents called it a step toward same-sex marriage. But Lanas said it would not redefine marriage, and would hopefully benefit the rest of the community by welcoming non-traditional couples and families.

MN: Instead of Marriage Equality, State Now Looks to Constitutional Ban Effort in 2012

Gay rights activists in Minnesota thought 2012 would be the year they could finally make a serious push for gay marriage in the state, but a surprise Republican takeover of the Legislature has them back on the defensive instead.

Tom Prichard, president of the Minnesota Family Council, said Thursday his group will push for a statewide vote in 2012 to ban gay marriage and civil unions in Minnesota’s Constitution. Previous efforts to do so in 2004, 2005 and 2006 met a firewall in the strongly Democratic state Senate, but that liberal majority crumbled in Tuesday night’s election.

And despite a vow by new Republican legislative leaders to focus primarily on job creation and spending cuts when they take over in January, the likely new chairman of the Senate Judiciary Committe said there’s “a lot of bottled-up desire” in his party to finally put gay marriage before state voters.

MN: Catholic Church Denies Communion to Gay Marriage Supporters

Minnesota Gay MarriageA small group of Catholics were denied communion Sunday because they wore rainbow sashes in support of same-sex marriage to Mass at the St. Paul Cathedral. Minnesota Public Radio News reports the protest has been an annual event for a decade.

Each year organizers ask the archbishop for permission to receive communion while wearing the sash, but a St. Paul-Minneapolis Archdiocese spokesman says that would be sacrilege.

Archdiocese spokesman Dennis McGrath says communion simply must not be used for a political statement.

MN: Catholics Protest Anti-Gay Marriage DVD at Archbishop’s Home

Some Catholics took their protest of a DVD to the front of the Archbishop’s home on Sunday morning. Some protesters held signs reading “Say No to the DVD” and “I support Gay Marriage.”

The church sent 400,000 DVD’s to Catholic households. It highlights the church’s teaching on marriage — that it only exists between a man and a woman.

A diocese spokesperson has said the church is making no attempt to go after a particular group. They just want to preserve and protect traditional marriage.

MN: Archbishop Denies Communion to Gay/Lesbian Students

About 25 students from St. John’s University and the College of St. Benedict say they were turned away from communion because they were wearing rainbow buttons that indication membership in, or solidarity with a gay and lesbian student group.

Archbishop John Nienstedt of the Roman Catholic Archdiocese of Saint Paul and Minneapolis, led a student mass at St. John’s Abbey in Collegeville, MN, on Sept. 26, and offered the students a sign of the cross over their heads, but refused to grant them Eucharist.

He took one look at that pin and it felt like he was saying, ‘you are not worthy of receiving Jesus,’” Elizabeth Gleich, a member of the student group PRiSM (People Representing the Sexual Minority), told the student newspaper, The Record.

MN: Various Takes on the Catholic Church’s Anti Gay Marriage Initiative

Minnesota’s Catholic bishops are undertaking a campaign to urge Catholics to support a constitutional amendment banning gay marriage. The bishops have generated considerable criticism for the timing of the campaign just weeks before the November elections. Here’s a sample of what people are saying:

The editorial board of the Winona Daily News blasted the bishops’ campaign. The opening sentence? “Let’s face it, it’s a lot easier to pick on gay people than it is to feed the hungry, clothe the naked and give shelter to the homeless. It’s probably cheaper, too.”

A reader of the Winona Daily News is upset of the editorial board’s criticism. Thomas A. Szyszkiewicz says gay marriage will lead to incest.
